Available in PDF, EPUB and Kindle. Book excerpt: This book provides an analysis of the institutional and constitutional effects of EU international agreements, with a particular focus on their potential effects on private parties. The European Union has entered into a number of international agreements that raise serious fundamental rights concerns due to a lack of parliamentary and judicial scrutiny. The book addresses these issues in the context of developments contained in the Lisbon Treaty, focusing on primary and secondary sources, including German/French scholarship, as well as EU and national case law.

Available in PDF, EPUB and Kindle. Book excerpt: This new edition provides a definitive, comprehensive and systematic analysis of the law governing the EU's action in the world. Updated to take into account the Lisbon Treaty and recent case law, the book covers all constitutional aspects of the EU's international action and the procedures for treaty-making. It analyses the relationship between the EU and its Members with emphasis on mixed agreements, and the status of international law in the EU legal order. It explores the links between the EU and international organisations (such as the WTO) and examines the EU's external economic and political relations and its various links with third countries, including its neighbours. It analyses, amongst others, the Common Commercial Policy, sanctions, the Common Foreign and Security Policy, and the Common Security and Defence Policy. This new edition is the most up-to-date work of its kind, examining both the law and practice in a wide range of external policies, placing the law in its political and economic context and exploring the links between the EU's external and internal actions.

Available in PDF, EPUB and Kindle. Book excerpt: EU external actions have deep constitutional and institutional implications for EU law and practices. The EU's competences in external relations have continuously increased, including with the entry into force of the Treaty of Lisbon. As a result, the EU has become ever more active in external relations. This has in turn increased the internal constitutional and institutional effects of EU external actions. This book traces these legal effects and the broader constitutional implications, including potential integrative forces. EU external actions affect the power division between the EU and its Member States and between the different EU institutions; the unity and autonomy of the EU legal order; the role and position of Member States on the international plane; their autonomy; the relationship between national, international and EU law; and the ability of EU citizens to identify who is responsible for a particular action or policy, as well as their legitimate expectation that the EU takes action on their behalf. The chapters demonstrate the interpretation of organizational principles, such as sincere cooperation, subsidiarity, primacy and coherence, changes in the context of external relations; how the choice of an external legal basis rather than an internal legal basis affects the powers of the Union and its Member States; what power shifts happen when policies are determined in international agreements, rather than in internal decision-making; and how EU participation in international dispute settlement mechanisms affects the autonomy and legitimacy of the EU.

Available in PDF, EPUB and Kindle. Book excerpt: The third edition of this book incorporates more than 10 years of fascinating dynamics since the entry into force of the Lisbon Treaty. Apart from analysing the general basis of the Union's external action and its relationship to international law, the book explores the law and practice of the EU in more specialized fields of external action, such as common commercial policy, neighbourhood policy, development cooperation, cooperation with third countries, humanitarian aid, external environmental policy, and common foreign and security policy, as well as EU sanctions. Five years after the second edition published, this fully updated edition contains major developments within the law itself, along with changes and restructuring of the themes within the book. Carefully selected primary documents are accompanied with analytic commentary on the issues they raise and their significance for the overall structure of EU external relations law. The primary materials selected include many important legal documents that are hard to find elsewhere but give a vital insight into the operation of EU external relations law in practice.

Book excerpt: "Part I describes and analyses the ESDP, including all 22 military and civilian crisis management operations launched up to 31 August 2009 as well as developments under the Lisbon Treaty, and briefly discusses the international law issues raised, offering a unique insight into ESDP practice and its legal aspects. Part II examines this practice in the framework of the status and obligations of international organizations under international law: it looks at the legal status and personality of international organizations and of the EU as well as at how international organizations, including the EU, are bound by international obligations. Part III extensively addresses the international law applicable to the conduct of ESDP operations, in particular the law of armed conflict and international human rights law, filling a gap in the literature."--Jacket back cover.

Book excerpt: U.S. and outside assessments of the effort to stabilise Afghanistan are mixed and subject to debate; the Administration notes progress on reconstruction, governance and security in many areas of Afghanistan, particularly the U.S.-led eastern sector of Afghanistan. However, a November 2007 Bush Administration review of U.S. efforts in Afghanistan reportedly concluded that overall progress was inadequate. This mirrors recent outside studies that contain relatively pessimistic assessments, emphasising a growing sense of insecurity in areas previously considered secure, increased numbers of suicide attacks, and increasing aggregate poppy cultivation, as well as increasing divisions within the NATO alliance about the relative share of combat among the nations contributing to the peacekeeping mission. Both the official U.S. as well as outside assessments are increasingly pointing to Pakistan as failing -- either through lack of attention or eliberatestrategy -- to prevent Taliban commanders from operating from Pakistan. To try to gain momentum against the insurgency, the United States is considering new initiatives including adding U.S. troops to the still combat-intense south, possibly assuming U.S. command of the southern sector, and increasing direct U.S. action against Taliban concentrations inside Pakistan. Politically, the Afghan government remains reasonably stable. The post-Taliban transition was completed with the convening of a parliament in December 2005; a new constitution was adopted in January 2004, successful presidential elections were held on October 9, 2004, and parliamentary elections took place on September 18, 2005. The parliament has become an arena for factions that have fought each other for nearly three decades to debate and peacefully resolve differences, as well as a centre of political pressure on President Hamid Karzai. Major regional strongmen have been marginalised. Afghan citizens are enjoying personal freedoms forbidden by the Taliban, and women are participating in economic and political life. Presidential elections are to be held in the fall of 2009, with parliamentary and provincial elections to follow one year later. To help stabilise Afghanistan, the United States and partner countries are deploying a 47,000 troop NATO-led International Security Assistance Force (ISAF) that now commands peacekeeping throughout Afghanistan, including the restive south. Of those, 19,000 of the 31,000 U.S. forces in Afghanistan are part of ISAF. The U.S. and partner forces also run regional enclaves to secure reconstruction (Provincial Reconstruction Teams, PRTs), and are building an Afghan National Army and National Police. The United States has given Afghanistan over $23 billion (appropriated, including FY2008 to date) since the fall of the Taliban, including funds to equip and train Afghan security forces.

The authors examine current mission in light of NATO's history and with an eye toward the future. NATO faces a long and daunting list of issues that extends beyond the borders of the member countries. The alliance must confront them, however, because failure to do so would risk its long-term success and sustainability.

Available in PDF, EPUB and Kindle. Book excerpt: How, despite the enormous investment of blood and treasure, has the West's ten-year intervention left Afghanistan so lawless and insecure? The answer is more insidious than any conspiracy, for it begins with a profound lack of understanding of the rule of law, the very thing that most dramatically separates Western societies from the benighted ones in which they increasingly intervene. This volume of essays argues that the rule of law is not a set of institutions that can be exported lock, stock and barrel to lawless lands, but a state of affairs under which ordinary people and officials of the state itself feel it makes sense to act within the law. Where such a state of affairs is absent, as in Afghanistan today, brute force, not law, will continue to rule.
