Available in PDF, EPUB and Kindle. Book excerpt: The third edition of this book incorporates more than 10 years of fascinating dynamics since the entry into force of the Lisbon Treaty. Apart from analysing the general basis of the Union's external action and its relationship to international law, the book explores the law and practice of the EU in more specialized fields of external action, such as common commercial policy, neighbourhood policy, development cooperation, cooperation with third countries, humanitarian aid, external environmental policy, and common foreign and security policy, as well as EU sanctions. Five years after the second edition published, this fully updated edition contains major developments within the law itself, along with changes and restructuring of the themes within the book. Carefully selected primary documents are accompanied with analytic commentary on the issues they raise and their significance for the overall structure of EU external relations law. The primary materials selected include many important legal documents that are hard to find elsewhere but give a vital insight into the operation of EU external relations law in practice.

Available in PDF, EPUB and Kindle. Book excerpt: In The EU and the Security-Development Nexus, Hans Merket unravels the long-standing commitment of the European Union (EU) to integrate its policies across the security-development nexus. By fine-tuning the Common Foreign and Security Policy (CFSP) – which includes the Common Security and Defence Policy (CSDP) – with its development cooperation policies, the EU aims to end the devastating vicious cycle of insecurity and poverty in fragile states. This book undertakes a comprehensive analysis of the EU’s words and deeds that result from this engagement across its entire policy, and its institutional and legal system. This gives a complete picture of the significance, impact, limits, potential and remaining challenges of this policy commitment, and simultaneously elucidates the practical impact of Treaty reform in the area of EU external action.

At the same time, the ‘neighbours of the EU’s neighbours’ have presented new challenges. This book addresses the EU’s broader neighbourhood, comprising of the ENP countries and the neighbours of its neighbours. With specific focus on Saharan Africa, the Middle East and Central Asia, it discusses trans-regional policy issues that arise from the EU’s relations with regions beyond the ENP. Based on an interdisciplinary, policy-oriented approach, this volume explores major political, legal, security and socio-economic challenges and identifies opportunities for cooperation across the EU’s broader neighbourhood. This book will be of interest to students, experts and scholars interested in EU affairs and politics, international relations, EU and international law, diplomacy and area studies.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a comprehensive analysis of regional integration in East Africa in the last century, reflecting the general trends of integration processes in the East Africa sub-region with a focus on the East African Community. Particular attention is paid to the cyclicality of integration dynamics, as well as the analysis of the interconnection and competition between different regional organizations in East Africa. In this context, the specificity of the so-called overlapping membership of African states in regional organizations with similar roles but conflicting treaties and mandates is explored. This situation to a certain extent affects the relations of states in the region with external actors specifically trade negotiations with EU that the book comprehensively analyses. This book therefore offers a deeper understanding of the processes of regional integration in East Africa that had been missed before, which reflects the general integration dynamics on the African continent.

Available in PDF, EPUB and Kindle. Book excerpt: Constitutional orders constitute political communities – and international orders deriving from them – by managing conflicts that threaten peace. This book explores how a European political community can be advanced through EU constitutional law. The constitutional role of the Union is to ensure peace by addressing two types of conflict. The first are static conflicts of interests between the national polities in the EU. These are avoided by ensuring reciprocal non-interference between Member States in the Union through deregulation in Union law. The second are dynamic conflicts of ideas about positive liberty held by the peoples of Europe. These can be resolved through regulation in a European political space. Here, EU law enables a continuous process of re-negotiating a shared European idea of positive liberty that can be accepted as its own by each national polity in the EU. These solutions to the two types of conflicts correspond to the liberal and republican models for Europe. The claim of this book is that the constitutional design of Europe presents both liberal and republican features. Taking an innovative approach, which draws on arguments from substantive law, constitutional theory, case law analysis, insights from psychology and philosophy, it identifies how best to strengthen the Union through constitutional law.

The implementation of EU law and policy and its balance between economic and social values continues to provoke debate. Providing fresh insight, Nuno Ferreira and Dora Kostakopoulou present a novel analytical framework, centred on the notion of humaneness, for assessing EU law and policy. This innovative approach leads to recommendations for policy change towards a more humanistic philosophy for the EU. Broad in its scope, this remarkable volume draws together interdisciplinary perspectives from contributors who examine key EU law and policy fields, including economic integration, asylum and free movement, citizenship and development, and security. This book is essential reading for scholars, students and policy-makers seeking new ways of exploring the economic versus social values debate in EU law.

Available in PDF, EPUB and Kindle. Book excerpt: Principles of International Economic Law provides a comprehensive overview of the central topics in international economic law, with an emphasis on the interplay between the different economic and political interests on both the international and domestic levels. Following recent tendencies, the book sets the classic topics of international economic law, like WTO law, investment protection, commercial law and monetary law in context with aspects of human rights, environmental protection and the legitimate claims of developing countries. The book draws a concise picture of the architecture of international economic law with all its complexities, without getting lost in fragmented details. Providing a perfect introductory text to the field of international economic law, the book thoroughly analyses legal developments within their wider political, economic, or social context. Topics covered range from codes of conduct for multinational enterprises, to the human rights implications of the exploitation of natural resources. The book demonstrates the economic foundations and economic implications of legal frameworks. It puts into profile the often complex relationship between, on the one hand, international standards on liberalization and economic rationality and, on the other, state sovereignty and national preferences. It describes the new forms of economic cooperation which have developed in recent decades, such as the growing number of transnational companies in the private sector, and forms of cooperation between states such as the G8 or G20. This fully updated second edition covers new aspects and developments including the growing importance of corporate social responsibility, mega-regional-agreements like CETA, TTIP, and TPP, trade and investment related aspects of human rights law.

Book excerpt: Despite regionalism having developed into a global phenomenon, the European Union (EU) is still more often than not presented as the ’role-model of regionalism’ whose institutional designs and norms are adopted by other regional actors and organizations as part of a rather passive ’downloading process’. Reaching beyond such a Eurocentric perception, Mapping Agency provides an empirically rich ’African perspective’ on regionalisms in Sub-Saharan Africa. It adopts an actor-centred approach but departs from a rather simplified understanding of agency as exerting power and instead scrutinizes to what extent actors actually participate in or are excluded from processes of regionalism. The value of this volume derives from the inclusion of historical dimensions, its open multi-actor approach to both formal and informal processes and its comparative perspective within but also beyond Sub-Saharan Africa. The chapters offer a multifaceted picture of agency beyond disciplinary divides where the EU is one actor amongst many and where local, national, regional and global state and non-state actors shape - and sometimes break - processes of regionalisms in Sub-Saharan Africa.
