Book excerpt: This paper discusses the preliminary perceptions and understandings of African countries on an arms trade treaty (ATT). Pursuant to the General Assembly Resolution 61/89, "Towards an arms trade treaty: establishing common international standards for the import, export and transfer of conventional weapons", adopted in December 2006, a group of 28 governmental experts were appointed by the United Nations Secretary General to assess the feasibility, scope and parameters of a possible ATT. Experts from five African countries, namely South Africa, Egypt, Nigeria, Algeria and Kenya, took part in the study. These countries' perceptions and understandings of an ATT will be discussed and analysed with the aim of highlighting the reservations and uncertainties that have been raised. The possible reasons for these reservations will also be discussed.

SALW are the primary source of violations and abuses of humanitarian and human rights principles by states, rebels, terrorists and criminals. Many consider them the real weapons of mass destruction of our time, causing about half a million deaths annually. The unrestricted international transfer of SALW by states (99 states and 1000 companies involved in manufacturing and supply) is one of the major contributory and aggravating factors of this crisis; another is the illicit traffic in small arms. This book deals with the proliferation of SALW and their unregulated trade and transfer across borders. It addresses questions of definition, manufacturing, trade/transfer, and issues relating to state responsibility. The primary focus is on conventional small arms, in particular military-style weapons. The book tackles the core and most divisive legal problem of whether or not the laws relating to arms control and relevant norms of international law provide substantive restrictions upon the transfer of small arms by states. The application of the norms of international peace and security, non-intervention, humanitarian and human rights laws, and evolved relevant customary rules of arms control relating to these norms are considered particularly carefully. Questions of application and enforcement of relevant rules and institutional responses to the problem are also examined. The UN began considering an arms trade treaty in 2006; the publication of the book at this critical moment in time will make a positive contribution towards shaping the debate and aims to further enhance understanding in an area where close analysis is required.

Most states support its inclusion and point towards the negative impact of irres- ponsible and poorly controlled transfers of ammunition. The insecurity and tremendous human suffering associated with such transfers in the context of armed violence in Africa are a case in point. A few states, however, oppose the inclusion of ammunition in the ATT and argue that controlling international ammunition transfers would be unfeasible and highly cost-intensive. This report discusses the chal- lenges of ammunition controls in Africa against the background of the international discussions on the ATT. It demonstrates that concerns re- garding ammunition-inclusion in the ATT are unfounded. It also argues that complementary action will be required by African stakeholders and their international partners to strengthen ammunition controls in the region. Holger Anders is a consultant on arms control with several years of work experience in sub-Saharan Africa, including as expert monitoring the imple- mentation of a UN arms embargo. He holds post-graduate degrees in peace studies and international relations and has published and presented widely at global and regional levels in Europe and Africa on the scope for action to combat illicit trafficking of arms and ammunition.

This report examines arms transfers to the region and explores some common principles that can be applied by states when authorizing arms transfers, and which should underpin the Treaty's framework. Amnesty International is urging all states that have been supplying arms to the region to undertake immediate and thorough case-by-case reviews of their arms transfer procedures. In 2012, UN member states will negotiate the final text of the Arms Trade Treaty. If it is to achieve the highest possible common standards, the lessons of irresponsible arms transfers to the Middle East and North Africa must inform the Treaty's content.

This Background Paper is one of a series produced by SIPRI to inform these discussions. Arms flows to East and Southern Africa, which originate from a wide diversity of countries, are relatively small. However even small volumes of arms can play a major role in armed violence and can be an economic burden. Small arms and light weapons (SALW) are commonly used in violent conflicts in the region. The legal or illegal supply of significant quantities of SALW to and within the region is therefore a cause for concern. An increasing number of supplier countries are trying to address such concerns with more restrictive arms export policies. The existing secrecy surrounding arms procurement in East and Southern Africa hampers adequate policymaking, facilitates corruption, feeds distrust between states and can allow destabilizing accumulations of arms. It also obstructs an informed debate on an ATT and would be an obstacle to the verification of an eventual treaty.
