Book excerpt: Although Mexico began its national life in the 1821 as one of the most liberal democracies in the world, it ended the century with an authoritarian regime. Examining this defining process, distinguished historians focus on the evolution of Mexican liberalism from the perspectives of politics, the military, the Church, and the economy. Based on extensive archival research, the chapters demonstrate that--despite widely held assumptions--liberalism was not an alien ideology unsuited to Mexico's traditional, conservative, and multiethnic society. On the contrary, liberalism in New Spain arose from Hispanic culture, which drew upon a shared European tradition reaching back to ancient Greece. This volume provides the first systematic exploration of the evolution of Mexican liberal traditions in the nineteenth century. The chapters assess the changes in liberal ideology, the nature of federalism, efforts to create stability with a liberal monarchy in the 1860s, the Church's accommodation to the new liberal order, the role of the army and of the civil militias, the liberal tax system, and attempts to modernize the economy in the latter part of the century. Madero, demanding that the executive branch of government assume the judiciary’s control over their unresolved lawsuits against landowners, local bosses, and other villages. The Madero administration tried to use existing laws to settle land conflicts but always stopped short of invading judicial authority. In contrast, the two main agrarian reform programs undertaken in revolutionary Mexico—those implemented by Emiliano Zapata and Venustiano Carranza—subordinated the judiciary to the executive branch and thereby reshaped the postrevolutionary state with the support of villagers, who actively sided with one branch of government over another. In Matters of Justice Helga Baitenmann offers the first detailed account of the Zapatista and Carrancista agrarian reform programs as they were implemented in practice at the local level and then reconfigured in response to unanticipated inter- and intravillage conflicts. Ultimately, the Zapatista land reform, which sought to redistribute land throughout the country, remained an unfulfilled utopia. In contrast, Carrancista laws, intended to resolve quickly an urgent problem in a time of war, had lasting effects on the legal rights of millions of land beneficiaries and accidentally became the pillar of a program that redistributed about half the national territory.

Book excerpt: This is a history of the Enlightenment--the rights-oriented, formalist, secularizing, freedom-inspired eighteenth-century movement that defined modern Western law. But rather than members of a cosmopolitan Republic of Letters, its principal protagonists are non-literate, poor, and enslaved litigants who sued their superiors in the royal courts of Spain's American colonies. Despite growing evidence of the Hispanic world's contributions to Enlightenment science, the writing of history, and statecraft, the region is conventionally believed to have taken an alternate route to modernity. This book grapples with the contradiction between this legacy and eighteenth-century Spanish Americans' active production of concepts fundamental to modern law. The Enlightenment on Trial offers readers new insight into how Spanish imperial subjects created legal documents, fresh interpretations of the intellectual transformations and legal reform policies of the period, and comparative analysis of the volume of civil suits from six regions in Mexico, Peru and Spain. Ordinary litigants in the colonies--far more often than peninsular Spaniards--sued superiors at an accelerating pace in the second half of the eighteenth century. Three types of cases increased even faster than a stunning general rise of civil suits in the colonies: those that slaves, native peasants and women initiated against masters, native leaders and husbands. As they entered court, these litigants advanced a new law-centered culture distinct from the casuistic, justice-oriented legal culture of the early modern period. And they did so at precisely the same time that a few bright minds of Europe enshrined new ideas in print. The conclusion considers why, if this is so, the Spanish empire has remained marginal to the story of the advent of the modern West.

In this interpretation of the independence movement, Nettie Lee Benson tells the true story of Mexico's transition from colonial status to a federal state. She traces the Mexican government's beginning to events in Spain in 1808–1810, when provincial juntas, or deputations, were established to oppose Napoleon's French rule and govern the country during the Spanish monarch's imprisonment. These provincial deputations proved so popular that ultimately they became the established form of government throughout the provinces of Spain and its New World dominions. It was the provincial deputation, not the United States federal system, that provided the model for the state legislative bodies that were eventually formed after Mexico won its independence from Spain in 1821. This finding—the result of years of painstaking archival research—strongly confirms the independence of Mexico's political development from U.S. influence. Its importance to a study of Mexican history cannot be overstated.
