Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1967, Meagher’s masterful dissection of the Warren Report, based on the Warren Commission’s own evidence, has stood the test of time. In some cases, declassifications of government records have corroborated the author’s suspicions and analyses, such as her amazing assertion that Oswald had never actually been charged with Kennedy’s murder, despite sworn testimony to the contrary. Meagher’s book raises serious questions not only about Oswald’s guilt in the JFK assassination and related crimes, such as the Tippit murder and the Walker shooting, but also about the methods and honesty of the Warren Commission, the FBI, and various Dallas police and other officials. When the Church Committee first began to re-examine the Warren Commission and its relationship with intelligence agencies in 1975, investigators were shocked by what they discovered. In Accessories After the Fact, Sylvia Meagher delivers a blistering blow to the credibility of the Warren Report, and decades after its original publication researchers and readers are still discovering what made her work so important.

Book excerpt: Anchored by the normative framework, this book aims to clarify the basis for individual criminal liability for persons who finance entities that perpetrate core crimes. The objective of this monograph is to clarify the rules to enable international courts and tribunals to identify the extent to which individual criminal liability attaches to the financing of core crimes, as well as the legal basis for such liability. By clarifying the criminal liability of individual who finance entities that perpetrate core crimes, this book also seeks to clarify the mental elements of the mode of liability of aiding and abetting. This is achieved through a thorough analysis of the applicable rules in the international arena, as well as through the comparative analysis.

Book excerpt: Presently, many of the greatest debates and controversies in international criminal law concern modes of liability for international crimes. The state of the law is unclear, to the detriment of accountability for major crimes and of the uniformity of international criminal law. The present book aims at clarifying the state of the law and provides a thorough analysis of the jurisprudence of international courts and tribunals, as well as of the debates and the questions these debates have left open. Renowned international criminal law scholars analyze, in discrete chapters, the modes of liability one by one; for each mode they identify the main trends in the jurisprudence and the main points of controversy. An introduction addresses the cross-cutting issues, and a conclusion anticipates possible evolutions that we may see in the future. The research on which this book is based was undertaken with the Geneva Academy.

Available in PDF, EPUB and Kindle. Book excerpt: Accessory liability in the private law is of great importance. Claimants often bring claims against third parties who participate in wrongs. For example, the 'direct wrongdoer' may be insolvent, so a claimant might prefer a remedy against an accessory in order to obtain satisfactory redress. However, the law in this area has not received the attention it deserves. The criminal law recognises that any person who 'aids, abets, counsels or procures' any offence can be punished as an accessory, but the private law is more fragmented. One reason for this is a tendency to compartmentalise the law of obligations into discrete subjects, such as contract, trusts, tort and intellectual property. This book suggests that by looking across such boundaries in the private law, the nature and principles of accessory liability can be better understood and doctrinal confusion regarding the elements of liability, defences and remedies resolved. Available in PDF, EPUB and Kindle. Book excerpt: This book is centered around the major issues relating to criminal law in Thailand and aims to offer a detailed and systematic overview of the Thai criminal justice system. It is designed as a traditional textbook of criminal law which provides a succinct focused coverage of all the relevant aspects of laws, judgments, and legal reforms in a concise and readable form. Although all topics have been previously treated in the Thai language, this is the first and most comprehensive work in the English language about Thai criminal law. The book covers not only the legal system, starting from the Penal Code of 1908 and emphasizing the substantial changes that have been introduced in the past decades, but also the deep influence of doctrine and case law. It is built up in several layers, starting from the general rule, to gradually examine the more specific ones. The book begins with the elementary legal concepts to be learned by the reader, by defining the fundamental principles underlying the Thai criminal system and outlining its objectives. It then extensively describes the main offences under the Thai Penal Code and classifies those breaches of law which are crimes from those which are merely illegal without being criminal.

Available in PDF, EPUB and Kindle. Book excerpt: In Justice in Extreme Cases, Darryl Robinson argues that the encounter between criminal law theory and international criminal law (ICL) can be illuminating in two directions: criminal law theory can challenge and improve ICL, and conversely, ICL's novel puzzles can challenge and improve mainstream criminal law theory. Robinson recommends a 'coherentist' method for discussions of principles, justice and justification. Coherentism recognizes that prevailing understandings are fallible, contingent human constructs. This book will be a valuable resource to scholars and jurists in ICL, as well as scholars of criminal law theory and legal philosophy.
