At the same time the growth in cyber-bullying, especially among girls, appears to be a related global phenomenon.While the gender gap in delinquency is narrowing in Australia, United States, Canada and the United Kingdom, boys continue to dominate the youth who commit crime and have a virtual monopoly over sexually violent crimes. Indigenous youth continue to be vastly over-represented in the juvenile justice system in every Australian jurisdiction. The Indigenisation of delinquency is a persistent problem in other countries such as Canada and New Zealand.Young people who gather in public places are susceptible to being perceived as somehow threatening or riotous, attracting more than their share of public order policing. Professional football has been marred by repeated scandals involving sexual assault, violence and drunkenness. Given the cultural significance of footballers as role models to thousands, if not millions, of young men around the world, it is vitally important to address this problem. Offending Youth explores these key contemporary patterns of delinquency, the response to these by the juvenile justice agencies and moreover what can be done to address these problems.The book also analyses the major policy and legislative changes from the nineteenth to twenty first centuries, chiefly the shift the penal welfarism to diversion and restorative justice. Using original cases studied by Carrington twenty years ago, Offending Youth illustrates how penal welfarism criminalised young people from socially marginal backgrounds, especially Aboriginal children, children from single parent families, family-less children, state wards and young people living in poverty or in housing commission estates. A number of inquiries in Australia and the United Kingdom have since established that children committed to these institutions, supposedly for their own good, experienced systemic physical, sexual and psychological abuse during their institutionalisation. This report presents the findings of subject area "C", 'Diversion programs'. It examined the impact of four programs designed to divert Indigenous people from entering the justice system. The four programs sit at different points along a continuum, ranging from prevention (addressing known risk factors for offending behaviour), early intervention (with identified at-risk young people), diversion (diverting from court process - usually for first or second time offenders), and tertiary intervention (treatment to prevent recidivism). The programs evaluated were: Aboriginal Power Cup, a sports-based prevention program in South Australia; Tiwi Islands Youth Development and Diversion Unit, an early intervention and diversion program that engages Tiwi youth who are at-risk of entering the criminal justice system in prevention activities; Woorabinda Early Intervention Panel Coordination Service, an assessment and referral program for early intervention and diversion, in Queensland; and Aggression Replacement Training, a group cognitive-behavioural program for youth assessed as at risk of offending or re-offending, also in Queensland.

Book excerpt: The over-representation of Aboriginal people in the Criminal Justice System (CJS) is a considerable problem that has been present in Canada for many years and is extreme with Aboriginal youth populations. One theory of over-representation is the presence of systemic discrimination in judicial decision making. The present study,which utilizes data from the Vancouver Serious and Violent Young Offenders Study(Corrado, Cohen,Glackman, and Odgers),in press) funded by the Social Science and Humanities research Council of Canada, looks at gaining an understanding of the sentencing decisions of open or closed custody and how the offence committed and risk factors of reoffending may be affecting these decisions. This study focused on 441 young offenders currently residing in two open and two closed custody facilities in the Greater Vancouver Region, British Columbia. examined sentencing decisions of open or closed custody and how race, offence variables and risk factors of reoffending may have affected these decisions. The results of this study found that systemic discrimination was not evident in sentencing decisions as race, i.e., Aboriginal and non-Aboriginal, was not significant predictor of the type of sentence youth received. Also, many of the variables that were included in the analysis were not found to be significant predictors of the sentencing decision. Therefore, as the results indicated, there were other variables considered for sentencing decisions that were not presently measured. Future research should focus on understanding what these variables may be. The results also indicated that the overrepresentation of Aboriginal youth in the CJS was not a direct result of systemic discrimination during sentencing. Therefore, it is important to examine other areas of the CJS, such as police procedures, to see if systemic discrimination is present and to explore how this may affect the presence of Aboriginal people in the justice system.
