Available in PDF, EPUB and Kindle. Book excerpt: The aim of this project was to establish the particular needs of Aboriginal people in relation to death and inheritance, with particular focus on NSW. It required both legal and empirical research. Because of the diversity of nations and cultures within Aboriginal communities a range of communities were consulted from metropolitan, suburban, coastal and rural areas in NSW. The findings included the very low rate of will-making (approximately 2%) amongst Aboriginal people in Australia compared with non-Indigenous people, and a range of problems caused by intestacy regimes in particular in relation to burial disputes and miss-matched kinship. Several issues emerged: the most significant was concern about disputes about disposal of bodies, which every community consulted had been affected by. Other concerns included problems with funeral insurance, planning for end of life, recognition of the mismatched kinship assumed by the common law compared with Aboriginal people, disputes over property, where to keep a will safely, and protection of customary law. Misconceptions which might contribute to the low rate of will-making included the idea that one must own significant property before one can make a will. Participants were often not aware of what a will could do, and were very interested in the role of executor as the person with control of the body. Hostility to the legal system lessened once the idea that a will has in it what the testator wishes; and in most cases participants were extremely interested in making a will as soon as this was made clear. The findings showed that it may be more important for Aboriginal people to make a will than for non-Indigenous people, and that resistance to will-making may reduce as Aboriginal people become aware of wills and lawyers drafting wills become aware of how to make culturally appropriate wills. To this end the project was completed by the production of The Aboriginal Wills Handbook: a practical guide to making culturally appropriate wills for Aboriginal people by Prue Vines. This is accessible at the website of the NSW Trustee & Guardian and is aimed at both Aboriginal people and their lawyers.

Book Synopsis The Aboriginal Story of Burke and Wills by : Ian Clark
Download or read book The Aboriginal Story of Burke and Wills written by Ian Clark and published by CSIRO PUBLISHING. This book was released on 2013-07-22 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Aboriginal Story of Burke and Wills is the first major study of Aboriginal associations with the Burke and Wills expedition of 1860–61. A main theme of the book is the contrast between the skills, perceptions and knowledge of the Indigenous people and those of the new arrivals, and the extent to which this affected the outcome of the expedition. The book offers a reinterpretation of the literature surrounding Burke and Wills, using official correspondence, expedition journals and diaries, visual art, and archaeological and linguistic research – and then complements this with references to Aboriginal oral histories and social memory. It highlights the interaction of expedition members with Aboriginal people and their subsequent contribution to Aboriginal studies. The book also considers contemporary and multi-disciplinary critiques that the expedition members were, on the whole, deficient in bush craft, especially in light of the expedition’s failure to use Aboriginal guides in any systematic way. Generously illustrated with historical photographs and line drawings, The Aboriginal Story of Burke and Wills is an important resource for Indigenous people, Burke and Wills history enthusiasts and the wider community. This book is the outcome of an Australian Research Council project.

Available in PDF, EPUB and Kindle. Book excerpt: Combining The Worst-Case Scenario Survival Handbook and Into Thin Air, award-winning documentarian Mick Conefrey's The Adventurer's Handbook draws lessons from the glory days of exploration. What makes a good explorer? Adaptability, ambition, stamina, self-confidence, curiosity, optimism, authority—and fundraising ability. Though few of us will ever have to face a charging elephant, or survive solely on penguin stew, when it comes to project management, crisis aversion, or any number of everyday problems, there is much we can learn from the larger-than-life tales of the world's most famous adventurers. Here, award-winning documentarian Mick Conefrey pulls practical advice from their original diaries and logs, like how to survive an anaconda attack (wait until it has swallowed your legs, then reach down and cut its head off), and how to keep morale up (according to Ernest Shackleton, "A good laugh doesn't require any additional weight"). In addition to the wonderful characters and stories, this book offers many lessons on how to set sail without a clear path home. Answers to some important questions, courtesy of The Adventurer's Handbook: * How many corpses are believed to be on Mt. Everest? Answer: 120 * How is polar bear meat best prepared? Answer: Raw and frozen. * What do you do if attacked by a charging lion? Answer: Stand very still and stare it down. * What should you wear when crossing a desert? Answer: Lots of layers—fabric absorbs sweat and prolongs its cooling action.

Book Synopsis Routledge Handbook of Sport History by : Murray G. Phillips
Download or read book Routledge Handbook of Sport History written by Murray G. Phillips and published by Routledge. This book was released on 2021-09-19 with total page 430 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Routledge Handbook of Sport History is a new and innovative survey of the discipline of sport history. Global in scope, it examines the key contemporary issues in sports historiography, sheds light on previously ignored topics, and sets an intellectual agenda for the future development of the discipline. The book explores both traditional and non-traditional methodologies in sport history, and traces the interface between sport history and other fields of research, such as literature, material culture and the digital humanities. It considers the importance of key issues such as gender, race, sexuality and politics to our understanding of sport history, and focuses on innovative ways that the scholarship around these issues is challenging accepted discourses. This is the first handbook to include a full section on Indigenous sport history, a topic that has often been ignored in sport history surveys despite its powerful upstream influence on contemporary sport. The book also reflects carefully on the central importance of sport history journals in shaping the development of the discipline. This book is an essential reference for any student, researcher or scholar with an interest in sport history or the relationship between sport and society. It will also be fascinating reading for any historians looking for fresh perspectives on contemporary historiography or social and cultural history.
Book Synopsis Making Wills for Aboriginal People in NSW. by : Prue E. Vines
Download or read book Making Wills for Aboriginal People in NSW. written by Prue E. Vines and published by . This book was released on 2012 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Aboriginal people in NSW have even more need to make wills than non-Aboriginal people. A burgeoning middle class continues to have traditional family and customary law obligations, while taking on mainstream property and obligations. The standard intestacy regime is inappropriate including because it uses an inappropriate idea of family and the high rate of burial disputes involving Aboriginal people means the role of executor is even more important than usual. A will can also be used to protect certain aspects of customary law. The article considers the issues arising in drafting the most culturally appropriate and effective wills.
Book Synopsis Aboriginal Peoples and the Law by : Jim Reynolds
Download or read book Aboriginal Peoples and the Law written by Jim Reynolds and published by Purich Books. This book was released on 2018-05-15 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can Canada claim to be a just society for Indigenous peoples? To answer this question, and as part of the process of reconciliation, the Truth and Reconciliation Commission urged a better understanding of Aboriginal law for all Canadians. Aboriginal Peoples and the Law responds to that call, introducing readers with or without a legal background to modern Aboriginal law and outlining significant cases and decisions in straightforward, non-technical language. Jim Reynolds provides the historical context needed to understand relations between Indigenous peoples and settlers and explains key topics such as sovereignty, fiduciary duties, the honour of the Crown, Aboriginal rights and title, treaties, the duty to consult, Indigenous laws, and international law. This critical analysis of the current state of the law makes the case that rather than leaving the judiciary to sort out what are essentially political issues, Canadian politicians need to take responsibility for this crucial aspect of building a just society.
