Book excerpt: Agreements between the mining industry and Indigenous people are not creating sustainable economic futures for Indigenous people, and this demands consideration of alternate forms of economic engagement in order to realise such futures. Within the context of three mining agreements in north Australia this study considers Indigenous livelihood aspirations and their intersection with sustainable development agendas. The three agreements are the Yandi Land Use Agreement in the Central Pilbara in Western Australia, the Ranger Uranium Mine Agreement in the Kakadu region of the Northern Territory, and the Gulf Communities Agreement in relation to the Century zinc mine in the southern Gulf of Carpentaria in Queensland. Recent shifts in Indigenous policy in Australia seek to de-emphasise the cultural behaviour or imperatives of Indigenous people in undertaking economic action, in favour of a mainstream conventional approach to economic development. Concepts of value, identity, and community are key elements in the tension between culture and economics that exists in the Indigenous policy environment. Whilst significant diversity exists within the Indigenous polity, Indigenous aspirations for the future typically emphasise a desire for alternate forms of economic engagement that combine elements of the mainstream economy with the maintenance and enhancement of Indigenous institutions and livelihood activities. Such aspirations reflect ongoing and dynamic responses to modernity, and typically concern the interrelated issues of access to and management of country, the maintenance of Indigenous institutions associated with family and kin, access to resources such as cash and vehicles, the establishment of robust representative organisations, and are integrally linked to the derivation of both symbolic and economic value of livelihood pursuits.

It is inhabited by indigenous peoples, including the Bawm, Sak, Chakma, Khumi Khyang, Marma, Mru, Lushai, Uchay (also called Mrung, Brong, Hill Tripura), Pankho, Tanchangya and Tripura (Tipra), numbering over half a million. Originally inhabited exclusively by indigenous peoples, the Hill Tracts has been impacted by national projects and programs with dire consequences. This book describes the struggle of the indigenous peoples of the Chittagong Hill Tracts region to regain control over their ancestral land and resource rights. From sovereign nations to the limited autonomy of today, the report details the legal basis of the land rights of the indigenous peoples and the different tools employed by successive administrations to exploit their resources and divest them of their ancestral lands and territories. The book argues that development programs need to be implemented in a culturally appropriate manner to be truly sustainable, and with the consent and participation of the peoples concerned. Otherwise, they only serve to push an already vulnerable people into greater impoverishment and hardship. The devastation wrought by large-scale dams and forestry policies cloaked as development programs is succinctly described in this report, as is the population transfer and militarization. The interaction of all these factors in the process of assimilation and integration is the background for this book, analyzed within the perspective of indigenous and national law, and complemented by international legal approaches. Book excerpt: Aboriginal title represents one of the most remarkable and controversial legal developments in the common law world of the late-twentieth century. Overnight it changed the legal position of indigenous peoples. The common law doctrine gave sudden substance to the tribes' claims to justiciable property rights over their traditional lands, catapulting these up the national agenda and jolting them out of a previous culture of governmental inattention. In a series of breakthrough cases national courts adopted the argument developed first in western Canada, and then New Zealand and Australia by a handful of influential scholars. By the beginning of the millennium the doctrine had spread to Malaysia, Belize, southern Africa and had a profound impact upon the rapid development of international law of indigenous peoples' rights. This book is a history of this doctrine and the explosion of intellectual activity arising from this inrush of legalism into the tribes' relations with the Anglo settler state. The author is one of the key scholars involved from the doctrine's appearance in the early 1980s as an exhortation to the courts, and a figure who has both witnessed and contributed to its acceptance and subsequent pattern of development. He looks critically at the early conceptualisation of the doctrine, its doctrinal elaboration in Canada and Australia - the busiest jurisdictions - through a proprietary paradigm located primarily (and constrictively) inside adjudicative processes. He also considers the issues of inter-disciplinary thought and practice arising from national legal systems' recognition of aboriginal land rights, including the emergent and associated themes of self-determination that surfaced more overtly during the 1990s and after. The doctrine made modern legal history, and it is still making it.
