Viene introdotto il principio della responsabilizzazione del titolare e vengono introdotti nuovi strumenti di valutazione dei rischi del trattamento, con l’obiettivo di mettere tempestivamente sotto controllo e mitigare i rischi stessi. Ben più impegnative sono invece le disposizioni afferenti alle modalità di offerta di informativa, raccolta di consenso, trattamento dei dati raccolti, eventuale trasferimento in paesi terzi e, infine, di cancellazione dei dati, al termine del loro periodo utile di utilizzo. Anche il profilo delle sanzioni viene rafforzato, per indurre i titolari del trattamento a rispettare puntualmente le nuove disposizioni.

Ecco perché questo manuale, pur mantenendo il coordinamento logico con le precedenti edizioni, è stato appositamente redatto per questa figura professionale e praticamente scritto ex novo. After a three year long and troubled legislative process, on May 4th 2016 the new European regulation on personal data protection 2016/679 was issued in the Official Journal of the European Union. This regulation represents a major innovation of previous provisions, providing two years to fulfil the enforcement of the new rules. In the new regulation both data controller and data processor’s role are further defined; furthermore a new professional profile is created, that is to say the data protection officer. New tools for risk assessment of data processing are introduced, and the following processes are far more demanding: provisions on information supply, collection of consent, processing of collected data, possible transfer of data to third countries, right to data erasure after the purposes of collection are fulfilled. The person tasked with processing has a key role in the everyday implementation of the new provisions. This is the reason why the present handbook, though maintaining a logical link with the previous editions, has been expressly written to describe this role.
