A partir dessa premissa, deve-se desconstruir a ideia de "devolução" de filhos adotivos. Filhos não são objetos ou coisas que possam ser devolvidos. Crianças e adolescentes adotados já viveram a ruptura com a família natural e após terem sido inseridas em outras famílias – que, em tese, passaram por um procedimento prévio de preparação e pelo procedimento judicial de adoção – são obrigadas a viver uma nova quebra da relação de parentalidade. Os efeitos para elas podem ser devastadores. Como o Direito brasileiro lida com essas situações? Essa obra visa discutir essa questão, trabalhando somente o reabandono após a constituição legal da nova parentalidade, isto é, após a adoção ter sido deferida judicialmente e não a desistência de guarda para fins de adoção, embora sejam situações, do ponto de vista psicológico, bem semelhantes. Nela a adoção é trabalhada sob o prisma da Doutrina da Proteção Integral, que ilumina todo o Direito da Criança e do Adolescente e traz novas reflexões para o Direito de Família. A responsabilidade civil é analisada como possível resposta a essa situação, sendo também examinado como os tribunais brasileiros tratam a responsabilização dos pais pelo abandono dos filhos adotivos.
