Available in PDF, EPUB and Kindle. Book excerpt: This book considers the phenomenon of soft law employed by domestic public authorities. Lawyers have long understood that public authorities are able to issue certain communications in a way that causes them to be treated like law, even though these are neither legislation nor subordinate legislation. Importantly for soft law as a regulatory tool, people tend to treat soft law as binding even though public authorities know that it is not. It follows that soft law's 'binding' effects do not apply equally between the public authority and those to whom it is directed. Consequently, soft law is both highly effective as a means of regulation, and inherently risky for those who are regulated by it. Rather than considering soft law as a form of regulation, this book examines the possible remedies when a public authority breaches its own soft law upon which people have relied, thereby suffering loss. It considers judicial review remedies, modes of compensation which are not based upon a finding of invalidity, namely tort and equity, and 'soft' challenges outside the scope of the courts, such as through the Ombudsman or by seeking an ex gratia payment.

Available in PDF, EPUB and Kindle. Book excerpt: Air power for warfighting is a story that's been told many times. Air power for peacekeeping and UN enforcement is a story that desperately needs to be told. For the first-time, this volume covers the fascinating range of aerial peace functions. In rich detail it describes: aircraft transporting vital supplies to UN peacekeepers and massive amounts of humanitarian aid to war-affected populations; aircraft serving as the 'eyes in sky' to keep watch for the world organization; and combat aircraft enforcing the peace. Rich poignant case studies illuminate the past and present use of UN air power, pointing the way for the future. This book impressively fills the large gap in the current literature on peace operations, on the United Nations and on air power generally.

Book excerpt: Stephen Judd, Anne Robinson and Felicity Errington delve into the 'who' and the 'why' central to the purpose of a charity. This book analyses the historical and social context of Australian charities and considers the relationship between charities and Australian society. Organisation leaders, managers and those interested in the way charities can impact their communities will find Driven by Purpose a refreshing and practical approach to this important topic. And while the book draws on Australian experience, the principles and approaches described are applicable across the globe, not only for charities or not-for-profit organisations, but for individuals interested in living life on purpose. In his foreword to the book, former CEO of World Vision Australia, Tim Costello AO, says: 'Those who lead not-for-profit organisations, and those who guide and advise them, will benefit enormously from the practical leadership advice that Anne and Stephen present – advice based on extensive experience.' Driven by purpose was awarded second place in the Australian Christian Book of the Year award 2013.

Available in PDF, EPUB and Kindle. Book excerpt: This book analyses water allocation law and policy in New Zealand and offers a comparative analysis with Australia. In New Zealand, it is generally accepted that water allocation law has failed to be adequately addressed and New Zealand is now faced with the problem of over-allocation in many catchments. In comparison, Australia has extensive experience in reforming its water law and policy over the last 20 years. This book provides a comparative and critical analysis of the lessons that New Zealand can learn from the Australian experience and offers guidance for the improvement of water allocation outcomes in New Zealand. Starting with the background of water allocation law and policy in New Zealand, the book traces the evolution of legal policies, including the 1967 Water and Soil Conservation Act and the 1991 Resource Management Act, and examines the role they have played in current water allocation issues. The book situates these findings within global challenges, such as the impact of climate change, and the global scarcity of and increasing demand for freshwater resources. This book will be of great interest to students and scholars researching water law and policy, natural resource management and environmental law more broadly. It will also be of use to policy makers and professionals involved in developing and implementing water allocation laws and policies.
