Book excerpt: Excerpt from A Treatise on the Law of Homicide: Including a Complete History of the Proceedings in Finding and Trying an Indictment Therefor; Together With a Chapter on Defences to Homicide It has been the object of the author to give the busy practitioner a clear and concise statement of the law of homicide as it exists in this country, together with a history of a homicide case, in the order of proceeding, from the arrest of the accused, or the finding of the indictment. The method of treatment has been to give a concise statement of the law, with illustrations from the more important cases, and citing copiously authorities from the various states, England, and Canada. The purpose being to make this treatise a convenient manual wherein the busy lawyer will be able to find a discussion of at least the most of the questions likely to be raised in the course of the trial of a homicide case, a special effort has been put forth to make an exhaustive collection of the authorities, with the date of each decision affixed thereto. That there should be errors of omission and commission is to be expected, but great pains have been taken to guard against both, and it is hoped that they may be found to have been reduced to the minimum. In the interest of those who may have occasion to use this treatise the author has put in a reference to the various concurrent series of selected reports and reporters, wherein the cases cited are to be found re-reported, and one or more of which series of reporters or selected reports is kept up in almost every private library in the country.
