Book excerpt: Excerpt from A Treatise on the Law of Dower The facilities possessed by the legal profession for the study of the "Law of Dower" are not at present so perfect as to require for any honest attempt towards their improvement much in the way either of explanation or apology. That a suitable book of reference on the subject is required is a thing generally admitted. Expression has been given to this felt want in the Canada Law Journal, to an article of the sort in which Journal, the author must ascribe his first impulse towards the preparation of this volume. Thus far, the principal works in this department of legal lore, which have issued respectively from the Canadian, English or American press, are those of Draper, Park and Scribner. The first of these - the only production of the kind up to the present time of Canadian origin - is long since out of date; the other two are, neither of them, without grave defects; the former, partly on account of the mass of ancient law which it contains, and the latter, from the very considerable extent to which it is occupied with the conflicting decisions of the courts belonging severally to the various States of the Union. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Dower: Particularly With a View to the Modern Practice of Conveyancing IN treating of Dower, it has been customary to consider it as founded on the three successive circumstances of Ma1r1age, Seisin, and Death Of the Husband. The concurrence of the two former is properly the ground -work of the title Of dower; the latter 18 its consummation. This chronological arrangement having at least the convenience of Obviousness, has been here followed. The subject of Marriage, so far as it is connected with the law of Dower, is Open to considerations which call for some degree of attention and discrimination on the part of the student, and may even exercise the acuteness of the experienced lawyer. The obvious business Of the pre sent treatise is rather to point out the principles and distinctions which are to be borne in mind in applying the numerous cases on marriage to questions of Dower, than to enter upon any substantive discussion of the cases themselves. This book was released on 2018-08-26 with total page 730 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Husband and Wife The ground-work of the present volume on the law of Husband and Wife will be found in a treatise of some three hundred pages which the author's earlier work on the Domestic Relations contains. But when that treatise was written, the Married Women's Acts in England and America were a sort of first experiment or agitation; and since the second edition of the Domestic Relations not less than three thousand points have been decided, all tending to establish a mod ern jurisprudence concerning married women's rights, which decisions the author has examined while pre paring the present work, in addition to earlier author ities and various local codes. He has consequently expanded his subject, re-arranged his plan, and revised and re-written every topic, and the present work will be found essentially a new one, so far as relates espe cially to Promises to Marry, the Wife's Separate Pr0p erty under Equity and Recent Statutes, Transactions between Husband and Wife, Various Matters of Prac tice, and Separation and Divorce. A summary of the late Married Women's Acts in England and the United States will be found in the Appendix. No one can gain an intelligent comprehension of the rights and disabilities of the marriage union, as they exist to-day, without examining in order, (1) the old common-law or coverture doctrine; (2) the modifica tion of that doctrine by equity and recent legislation; (3) the latest local statute (judicially construed or not) which bears upon the particular point. To facilitate such an examination in due historical sequence is the main object of; the present work. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
