Book excerpt: "This highly successful book, now available in an updated second edition, has been thoroughly revised to reflect the many recent developments in media law. In addition to explaining the details and repercussions of recent groundbreaking Supreme Court decisions, the new edition also explores legal issues relating to technological changes in the journalism industry. Dean Jobb, an experienced journalist, author, journalism professor, and recognized authority on media law, provides a unique perspective that is designed to make journalists more aware of their rights and the legal limits on their craft. He examines the day-to-day issues faced by reporters and editors, and offers practical advice on how to overcome various obstacles. Using real-life examples and discussions of both criminal and civil law cases, the text explains the rationale behind the laws that affect the media, how those laws are interpreted, and what they mean for journalists. Jobb provides journalists with what they need to know to get the story -- without getting sued."--Publisher.

Book excerpt: "Media Law" is written for anyone whose day-to-day livelihood depends on, or is affected by, the publication, broadcast, or transmission of information and opinion in what is known as the mass media. For the practising lawyer, the book will serve as an indispensable desk reference; for the working journalist, it is a lexicon of conduct. Students of law or journalism will find the book an accessible and authoritative text--one that they will refer to often during their academic careers and throughout their professional lives. The central concept around which the book is organized is freedom of expression. In "Media Law," Professor Martin brings together elements from a number of different areas of the law, including criminal law, constitutional law, and the law of torts, in a lively treatment of the legal framework within which journalists work.

Available in PDF, EPUB and Kindle. Book excerpt: Judges on the Supreme Court of Canada are guided by reason and principle - or so most Canadians think. In The Most Dangerous Branch Robert Martin argues that the court has changed from acting on principles to acting on values, allowing it to impose its own personal preferences. As judges are not elected, Martin argues, they should not be permitted to set the social agenda, amend legislation, amend the constitution, or attack democracy and democratic institutions. The Most Dangerous Branch shows that the Supreme Court has done exactly this in dealing with abortion, assisted suicide, homosexuality, and Quebec secession through decisions that were guided not by reasoned understanding of the principles of law but by the values of judges - values they, as unelected representatives of the Canadian state, had no right to impose. Martin shows that Supreme Court judges have adopted an orthodoxy of moral relativism and identity politics that he likens to a secular state religion. This orthodoxy denies the possibility of objectivity about human endeavour and regards social reality as "constructed." While purporting to be concerned with the plight of the oppressed, it is actually based on profound condescension. Martin believes that the "theocracy" which dominates the Supreme Court of Canada is subverting democracy and the rule of law. In The Most Dangerous Branch he calls on Canadians to take back their country.

Book excerpt: Canada is at a critical juncture in the evolution of its communications policy. Will our information and communications technologies continue in a market-oriented, neoliberal direction, or will they preserve and strengthen broader democratic values? Media Divides offers a comprehensive, up-to-date audit of communications law and policy. Using the concept of communications rights as a framework for analysis, leading scholars not only reveal the nation’s democratic deficits in five key domains – media, access, the Internet, privacy, and copyright – they also formulate recommendations, including the establishment of a Canadian right to communicate, for the future.

Book excerpt: Journalism: A Guide to the Reference Literature is a critically annotated bibliographic guide to print and electronic sources in print and broadcast journalism. The first edition was published in 1990; the second in 1997. It has been described as one of the critical reference sources in journalism today, and it is a key bibliographic guide to the literature. Choice magazine called it a benchmark publication for which there are no comparable sources. The format is similar to the second edition. What makes this edition significantly different is the separation of Commercial Databases and Internet Resources. Commercial Databases includes standard fee-based resources. The new chapter on Internet sources features Web-based resources not included in the commercial databases chapter as well as portals, other online files, listservs, newsgroups, and Web logs/blogs. All chapters have been revised, and there are significant revisions in Directories, Yearbooks, and Collections; Miscellaneous Sources; Core Periodicals; Societies and Associations; and Research Centers and Archives. The second edition has 789 entries. The third edition contains almost 1,000 entries. James Carey of Columbia University, who provided the foreword for the first two editions, has updated his foreword for this edition.

Book excerpt: "This practice-oriented sourcebook, authored by a seasoned lawyer with the Ontario Ministry of the Attorney General and a Master of the Ontario Superior Court of Justice, contains a comprehensive digest of Canadian evidence law. The book covers the law of evidence as applied in both civil and criminal proceedings, and captures general evidentiary principles contained in thousands of selected excerpts from case law and statutes, supplemented with authoritative commentary. By providing the key passages of actual cases and statutes (as opposed to a discussion of theory), this book serves as a practical research tool for students, litigators and adjudicators alike, well suited to the preparation of an opinion, argument or factum."--pub. desc.
