This book was released on 2018-06-28 with total page 1264 pages. Available in PDF, EPUB and Kindle. Book excerpt: European law, including both civil law and common law, has gone through several major phases of expansion in the world. European legal history thus also is a history of legal transplants and cultural borrowings, which national legal histories as products of nineteenth-century historicism have until recently largely left unconsidered. The Handbook of European Legal History supplies its readers with an overview of the different phases of European legal history in the light of today's state-of-the-art research, by offering cutting-edge views on research questions currently emerging in international discussions. The Handbook takes a broad approach to its subject matter both nationally and systemically. Unlike traditional European legal histories, which tend to concentrate on "heartlands" of Europe (notably Italy and Germany), the Europe of the Handbook is more versatile and nuanced, taking into consideration the legal developments in Europe's geographical "fringes" such as Scandinavia and Eastern Europe. The Handbook covers all major time periods, from the ancient Greek law to the twenty-first century. Contributors include acknowledged leaders in the field as well as rising talents, representing a wide range of legal systems, methodologies, areas of expertise and research agendas.

Book Synopsis Human Rights and their Limits by : Wiktor Osiatyński
Download or read book Human Rights and their Limits written by Wiktor Osiatyński and published by Cambridge University Press. This book was released on 2009-09-14 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: Human Rights and their Limits shows that the concept of human rights has developed in waves: each call for rights served the purpose of social groups that tried to stop further proliferation of rights once their own goals were reached. While defending the universality of human rights as norms of behavior, Osiatyński admits that the philosophy on human rights does not need to be universal. Instead he suggests that the enjoyment of social rights should be contingent upon the recipient's contribution to society. He calls for a 'soft universalism' that will not impose rights on others but will share the experience of freedom and help the victims of violations. Although a state of unlimited democracy threatens rights, the excess of rights can limit resources indispensable for democracy. This book argues that, although rights are a prerequisite of freedom, they should be balanced with other values that are indispensable for social harmony and personal happiness.

Book Synopsis Frontiers of Possession by : Tamar Herzog
Download or read book Frontiers of Possession written by Tamar Herzog and published by Harvard University Press. This book was released on 2015-01-06 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: A “lucid” analysis of the territorial formation of Spain and Portugal in both Europe and the Americas (Publishers Weekly). Frontiers of Possession asks how territorial borders were established in Europe and the Americas during the early modern period and challenges the standard view that national boundaries are largely determined by military conflicts and treaties. Focusing on Spanish and Portuguese claims in the New and Old Worlds, Tamar Herzog reconstructs the different ways land rights were negotiated and enforced, sometimes violently, among people who remembered old possessions or envisioned new ones: farmers and nobles, clergymen and missionaries, settlers and indigenous peoples. Questioning the habitual narrative that sees the Americas as a logical extension of the Old World, Herzog portrays Spain and Portugal on both sides of the Atlantic as one unified imperial space. She begins in the Americas, where Iberian conquerors had to decide who could settle the land, who could harvest fruit and cut timber, and who had river rights for travel and trade. The presence of indigenous peoples as enemies to vanquish or allies to befriend, along with the vastness of the land, complicated the picture, as did the promise of unlimited wealth. In Europe, meanwhile, the formation and re-formation of boundaries could last centuries, as ancient entitlements clashed with evolving economic conditions and changing political views and juridical doctrines regarding how land could be acquired and maintained. Herzog demonstrates that the same fundamental questions had to be addressed in Europe and in the Americas. Territorial control was always subject to negotiation, as neighbors and outsiders, in their quotidian interactions, carved out and defended new frontiers of possession. Praise for Frontiers of Possession “Herzog succeeds in her aim of moving beyond the usually separate histories of Spain and Portugal—and of Europe and the Americas—to complicate the accepted understanding of national and imperial boundaries as immutable facts rather than as ongoing sites of contestation.” —William O’Connor, The Daily Beast “This book is about as thorough a research work as this reviewer has ever encountered . . . This is a truly innovative and well-documented interpretation of this topic.” —D. L. Tengwall, Choice “The best account we now have of the long legal and political rivalry between the world’s first modern imperial powers.” —Anthony Pagden, author of The Enlightenment and Why It Still Matters

Book Synopsis A Short History of Legal Validity and Invalidity by : Maris Köpcke Tinturé
Download or read book A Short History of Legal Validity and Invalidity written by Maris Köpcke Tinturé and published by . This book was released on 2019 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The twin ideas of legal validity and invalidity are ubiquitous in contemporary private and public law. But their roots lie buried deep in European legal culture. This book for the first time traces and reveals these roots. In the course of a 2000-year journey through landmark texts of the Western tradition, from Roman law to modern codification and constitutionalism, the book shows that, contrary to what is often assumed, validity and invalidity originated in the domain of private transactions and only gradually came to be deployed in the domain of official power and law-making. This went hand in hand with legal thought's acknowledgement that law-making itself can be (in)valid, because legally limited, most recently by a body of constitutionally enshrined human rights. Understanding why, not only when, the technique of validity appeared, teaches valuable lessons about the kinds of social and political transformation that this technique can help realise - particularly in our age of emerging legal orders, shifting forms of governance, and fresh challenges to the regulation of exchanges in a digitally scripted world. This accessibly written work will appeal to anyone concerned with validity or invalidity in legal scholarship and practice, whether in public or private law. Dr. Maris Köpcke is a Research Fellow at the Faculty of Law, University of Oxford, and a Lecturer at the Faculty of Law, University of Barcelona. She holds a doctorate from Oxford, which won the European Award for Legal Theory 2011. She is the author of Legal Validity: The Fabric of Justice (2019). The book features over a dozen original drawings by the author's mother, Trini Tinturé.
