Nothing in the way of annotation has been attempted, beyond an occasional refer ence to similar cases, as it is thought that the text of the treatise supplies all that is needed in that direction. To make a selec tion of cases from the great number upon the subject is a difficult task and one in reference to which opinions will necessarily difier. The attempt here has been to select such as contained clear state ments of the principles or furnished striking illustrations of them, and were not too much involved with other matters or too long for reproduction. Boms cases which might otherwise have appeared have been omitted because the substance of them has been sufii oiently stated in the text or notes of the treatise. In many cases matters irrelevant to this subject have been omitted. Cases on the law of master and servant have also been omitted, as they suficiently appear in other available collections. Many of the cases given are too recent to constitute what may be termed lead ing oases, nor has there been any attempt to include all that might properly be so designated. As the volume is intended primarily for the use of students, for whom the making of their own abstracts is a most valuable exercise, the cases are printed with out head notes. It is believed, however, that they will be thereby rendered no less useful to others who may desire to consult them, as a full index furnishes a ready guide to their contents. When the writer took charge of the Commercial Law classes in Northwestern University, some years ago, he doubted whether he could profitably use cases as material for assigned lessons, and he therefore relied upon mimeographed notes in the form of a text, using cases only in brief paraphrase as illustrations, and these notes were afterwards put in type and published in the form of small hand books. But it was noticed that when the writer dwelt in his lectures on the facts Of actual cases and stated the court's decision and read from the Opinion, the stu dent seemed deeply interested, and retained the matter better in his memory than other parts of the work. From this experience, the writer became convinced of the value of the use of cases, in his classes, and he has used them in mimeograph form in connec tion with text for some time with considerable success. Book excerpt: Excerpt from A Compendium of Commission Cases: Being a Collection of Cases on the Law Relating to Auctioneers' and Estate Agents' Commission In the preface to the second edition of this work readers were reminded that m'a'i prim and county court cases are not regarded as authorities in courts of law. The object of the Compendium, it was added, was to furnish a guide to auctioneers and estate agents, to give them an opportunity of huding a case which might be useful and instructive as an illustration of the law, though it could not claim the dignity of a precedent. The book, in fine, attempts to teach laymen by ex ample. It could only be of casual use to lawyers. It is somewhat strange, in view of the intimation above mentioned, that several correspondents should have been at the pains to point out to the author that a large proportion of the cases given were not such as could be quoted to a judge or judges. But it is sub mitted that for members of the profession for which they are intended they have their proper use. As a matter of fact, though one critic writes that he looks upon it as furnishing entertaining reading only, there are really no disputes as to commission of which illustrations do not appear in the following pages, and illustrations furnished by firms of the highest status, who, one may be quite sure, had the best possible advice before going to law.
