Nesse passo, a responsabilidade civil do Estado será abordada em linhas gerais, enfocando a sua evolução no tempo e no espaço, suas teorias desde a fase da irresponsabilidade até as fases civilista e publicista, bem como sua atual situação no direito brasileiro, com causas excludentes e atenuantes da responsabilidade. Serão analisados os elementos indicados no preceptivo constitucional dano, agente, prestadora de serviço público, terceiro, nexo causal e condutas comissiva e omissiva, ressaltando-se a divergência quanto ao tratamento dado à conduta omissiva, em razão da responsabilidade subjetiva do Estado. A atividade judiciária, como serviço público que é, será analisada sob o prisma de sua prestação de forma defeituosa ou danosa, não só em face do erro judiciário, mas também quanto à demora na sua prestação e às falhas do serviço judiciário.
