Book excerpt: Every week we read in newspapers and news websites of cases where disappointed beneficiaries are in dispute with others, often members of their own families, about an estate that they expected to benefit from. These challenges often include claims that the person who does receive the benefit from the estate 'unduly influenced' the deceased or that they poured poison about the disappointed beneficiary into the ear of the deceased - which is what is referred to as fraudulent calumny. A Practical Guide to Challenging a Will Due to Undue Influence or Fraudulent Calumny explains what 'undue influence' and what 'fraudulent calumny' are and sets out the framework for challenges to wills where there is such a claim. It also guides the reader through some of the practical issues and difficulties that any disappointed beneficiary may face when making such challenges. These claims are difficult to pursue as they are treated by the courts as being similar to a fraud claim and the guide will be an essential tool for anyone contemplating making or defending such a challenge to a will (whether a lawyer, other professional person, or a beneficiary). ABOUT THE AUTHOR Evan Price is a barrister with over 20 years' experience of disputes involving property, wills, trusts and estates. He practices from Ten Old Square in Lincoln's Inn and is a member of the STEP (the Society of Trusts and Estates Practitioners). He is regularly instructed to assist clients to resolve matters involving broad and knotty issues that require urgent assistance.

Book excerpt: Legal practitioners who prepare wills now take care to be satisfied that the will instructions represent the independent wishes of their clients. A forthcoming change in British Columbia law in section 52 of the Wills, Estates and Succession Act requires some heightened awareness of the possibility of undue influence on the part of wills practitioners. Once the section is in force, the onus of proof in cases where undue influence is alleged will shift to the defender of a will in certain circumstances. This change heightens the need for practitioners to be able to recognize sings ("red flags") pointing to the possibility that a client's independent wishes are being overborne by coercive pressures and to take reasonable steps to prevent, to the extent possible, later challenges on the ground of undue influence and to record those steps. A practitioner should anticipate being called as a witness to rebut the new presumption of undue influence. This guide is intended for the use of legal practitioners who prepare wills. It was developed by an interdisciplinary committee with the support of the notary foundation and the lawyers insurance fund. For background the guide surveys the present state of the law relating to undue influence and explains the evidentiary change that section 52 will bring about. The main purposes of the guide, however, are to assist legal practitioners in recognizing ad dealing with situations of potential undue influence, and to set out some guidelines ("recommended practices") that should help to avert undue-influence challenges. While the focus of the guide is on wills practice, much of its contents are also relevant to the preparation of contracts and other personal-planning documents, such as representation agreements and powers of attorney.

Book excerpt: The perfect gift! A specially priced, beautifully designed hardcover edition of The Joy of the Gospel with a foreword by Robert Barron and an afterword by James Martin, SJ. “The joy of the gospel fills the hearts and lives of all who encounter Jesus… In this Exhortation I wish to encourage the Christian faithful to embark upon a new chapter of evangelization marked by this joy, while pointing out new paths for the Church’s journey in years to come.” – Pope Francis This special edition of Pope Francis's popular message of hope explores themes that are important for believers in the 21st century. Examining the many obstacles to faith and what can be done to overcome those hurdles, he emphasizes the importance of service to God and all his creation. Advocating for “the homeless, the addicted, refugees, indigenous peoples, the elderly who are increasingly isolated and abandoned,” the Holy Father shows us how to respond to poverty and current economic challenges that affect us locally and globally. Ultimately, Pope Francis demonstrates how to develop a more personal relationship with Jesus Christ, “to recognize the traces of God’s Spirit in events great and small.” Profound in its insight, yet warm and accessible in its tone, The Joy of the Gospel is a call to action to live a life motivated by divine love and, in turn, to experience heaven on earth. Includes a foreword by Robert Barron, author of Catholicism: A Journey to the Heart of the Faith and James Martin, SJ, author of Jesus: A Pilgrimage

Book excerpt: “What the Communist Manifesto is to the capitalist world, Annihilation of Caste is to India.” —Anand Teltumbde, author of The Persistence of Caste The classic work of Indian Dalit politics, reframed with an extensive introduction by Arundathi Roy B.R. Ambedkar’s Annihilation of Caste is one of the most important, yet neglected, works of political writing from India. Written in 1936, it is an audacious denunciation of Hinduism and its caste system. Ambedkar – a figure like W.E.B. Du Bois – offers a scholarly critique of Hindu scriptures, scriptures that sanction a rigidly hierarchical and iniquitous social system. The world’s best-known Hindu, Mahatma Gandhi, responded publicly to the provocation. The hatchet was never buried. Arundhati Roy introduces this extensively annotated edition of Annihilation of Caste in “The Doctor and the Saint,” examining the persistence of caste in modern India, and how the conflict between Ambedkar and Gandhi continues to resonate. Roy takes us to the beginning of Gandhi’s political career in South Africa, where his views on race, caste and imperialism were shaped. She tracks Ambedkar’s emergence as a major political figure in the national movement, and shows how his scholarship and intelligence illuminated a political struggle beset by sectarianism and obscurantism. Roy breathes new life into Ambedkar’s anti-caste utopia, and says that without a Dalit revolution, India will continue to be hobbled by systemic inequality.

This book was released on 2009-04-01 with total page 436 pages. Available in PDF, EPUB and Kindle. Book excerpt: Perhaps the last great work of the Enlightenment, this landmark in intellectual history is the Marquis de Condorcet's homage to the human future emancipated from its chains and led by the progress of reason and the establishment of liberty. Writing in 1794, while in hiding, under sentence of death from the Jacobins in revolutionary France, Condorcet surveys human history and speculates upon its future. With William Godwin, he is the chief foil of Malthus's Essay on Population. Portrayed by Malthus as an elate and giddy optimist, Condorcet foresees a future of indefinite progress. Freed from ignorance and superstition, he argues that the human race stands on the threshold of epochal progress and limitless improvement. Condorcet defies modernist stereotypes of the right and the left. He is at once precursor of the free market and social democracy. This new edition of the original 1795 English translation, is the only English translation of a work of Condorcet currently in print.
