Book excerpt: This report first sets Canada's competition regime in context with an overview of the role of competition law, a comparative analysis of different competition law provisions, and a debate over the merits of framework law versus the special provisions for special industries approach. Chapter 2 reports on the state of competition in Canada and the state of enforcement. Chapter 3 discusses the role of the Competition Tribunal & its decision-making procedures. The next three chapters address the important provisions of the Competition Act covering conspiracy, anticompetitive pricing, abuse of dominance, and merger review. Each of these chapters assesses the economic content of the law, whether the relevant practices should be placed in the criminal or civil part of the Act, the substantive elements of each provision, and the Competition Bureau's administration. Chapter 8 considers a narrow but important issue dealing with the application of the refusal to deal provision in gasoline retailing. The conclusion summarizes recommendations for improvement of the Canadian competition policy framework.
