Sutter (1803-1880) could have become one of the richest men in California when gold was found on his property. Instead he lost his vast land holdings on the Sacramento and Feather Rivers and eventually left California penniless. Sutter always claimed to be the victim of charlatans, but he bore considerable responsibility for his downfall. He had amassed huge debts before the gold discovery and added even more afterward. In the rough dealings of frontier capitalism in gold rush California, Sutter was easy prey. Soon after the gold discovery, Sutter’s eldest son, John Jr., (1826-1897) arrived, but soon moved south to Mexico. Hoping to obtain compensation for the land that he and his father had lost, John, Jr., returned to California in 1855 to give his lawyer a thorough statement cataloging how both Sutters were swindled. This extensive document describes the dirty deals of the first great gold rush in the western United States. Sutter’s statement has not been available for sixty years. Editor Allan R. Ottley reproduced and annotated this statement, providing a full biographical context and offering an appendix, bibliography, and index. Albert L. Hurtado’s introduction updates the book, originally published in 1942.

Book excerpt: The Campo Indian Landfill War explores the timely and controversial topic of "environmental justice" through the story of an Indian tribe's struggle to develop its isolated and impoverished reservation by building a commercial garbage facility to serve the cities of Southern California. The environmental justice movement was born out of the conviction that the waste industry has targeted minority communities for facilities it can no longer locate in the backyards of those with greater access to political power. The Campo case is therefore an anomaly: The tribe is unified in supporting the landfill, while the project is opposed by their mostly white neighbors out of concern that it could contaminate the aquifer that is the sole source of drinking water for 400 square miles, and thereby render the entire region uninhabitable. The environmental justice community, including many Indians, charges that the waste industry is trying to exploit the poverty of the Campos and other tribes, making them offers they can't refuse for projects no one else wants, projects no one should want. The Campos admit the danger of exploitation, but contend that it is paternalistic - indeed racist - to assume that Indians are not smart enough to protect themselves in dealings with whites or wise enough to guard their reservation environment.

At the same time, options for increasing that supply look to be ever more limited. No longer can we rely on technological solutions to meet growing demand. What we need is better management of the available water supply to ensure it goes further toward meeting basic human needs. But better management requires that we both understand the history underlying our current water regulation regime and think seriously about what changes to the law could be beneficial. For Golden Rules, Mark Kanazawa draws on previously untapped historical sources to trace the emergence of the current framework for resolving water-rights issues to California in the 1850s, when Gold Rush miners flooded the newly formed state. The need to circumscribe water use on private property in support of broader societal objectives brought to light a number of fundamental issues about how water rights ought to be defined and enforced through a system of laws. Many of these issues reverberate in today’s contentious debates about the relative merits of government and market regulation. By understanding how these laws developed across California’s mining camps and common-law courts, we can also gain a better sense of the challenges associated with adopting new property-rights regimes in the twenty-first century.
