Book excerpt: In the wake of the recognition of the Whanganui River in New Zealand, the Ganges and Yamuna Rivers in India, the Yarra River in Australia and the Atrato River in Colombia as «subjects of rights», the International Observatory on Nature’s Rights has initiated a reflection on the possibility of recognizing the St. Lawrence River, the «path that walks» as it is called by the First Nations, as a «legal person». The texts in this collective work deal with the implications of attributing a legal personhood and rights to the St. Lawrence River, delve into the epistemological foundations of the paradigm of the recognition of the rights of Nature and present concrete cases of recognition of rivers as subjects of law. Written by experts from several countries where the recognition of the legal personhood of rivers has occurred to date, they take an in-depth look at the challenges and contributions of this paradigm shift in river protection. This book answers questions about the implications of such recognition and contributes to the process of building a new law that has just begun in Quebec and Canada with the adoption in February 2021 of resolutions conferring the status of «legal person» on the MagPie/ Muteshekau Shipu River located on the North Shore of Quebec and on the Nitassinan (ancestral territory) of two Innu communities, Ekuanitshit and Uashat mak Mani-utemam. Contributions : Inès Bennada, David Cordero Heredia, Teresa Vicente Giménez, Stratégies Saint-Laurent, Isabelle Delainey, Uapukun Mestokosho, Sylvain Gaudreault, Andrew Galliano, Nathalia Parra, Bianca De Marchi Moyano, Hugo Muñoz, Danaé Espinoza, Erin O’Donnell, Brettel Dawson, Shrishtee Bajpai, Rébecca Pétrin, Sokhna Sene, Victor David, Daniel Turp and Yenny Vega Cárdenas.

Book excerpt: The book Philosophy of Law presents relevant theories, puts emphasis on the analysis of the branches of law and of basic human rights, and proposes the holistic analysis of law. In the first part the author analyses the main elements of each theory (natural law, legal positivism, legal realism, legal formalism, legal liberalism, economic analysis of law, critical legal studies). The main philosophers of law or supporters of each theory are discussed. In the second part of the book human rights and jurisprudence are analysed in the context of public law, criminal law (e.g., death penalty), private law and international law. The holistic analysis of law is proposed as a theory to address modern problems, such as poverty, climate change, the pandemic, and other global issues. The book is designed primarily for law students, teachers and supervisors.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a series of "ecological law" case studies, designed to illustrate in concrete, real-world ways how ecological law would transform law in a range of diverse contexts. Ecological law is an emerging, and currently mostly theoretical, discipline grounded in the need to shift away from anthropocentric legal systems, which aim to promote economic growth using strong protections of private property regimes and state sovereignty, to ecological approaches, which emphasize ecocentrism, the primacy of ecological limits, and intragenerational, intergenerational, and interspecies fairness and justice. The ecological law case studies presented in this book apply the theoretical principles and concepts of ecological law to diverse real-world situations or activities in several countries and contexts. Taking up a range of examples from Brazil, Canada, Germany, Mexico, Nigeria, the United States, and internationally, the book demonstrates the concrete relevance of ecological law to contemporary sustainability challenges, as it reveals pathways for overcoming real-world challenges in the implementation and public acceptance of ecological law. This book will appeal to researchers, scholars, and policy makers working in the area of environmental law and governance, as well as others with relevant interests in sociolegal studies, human geography, political science, and environmental studies.

Book excerpt: "Recovering Our Ancestral Foodways is the first relational ethnography of Quechua and Måaori peoples' philosophies of well-being, traditional ecological knowledge, and contributions to sustainable food systems. Based on over ten years of fieldwork in Peru and Aotearoa New Zealand, this book explores how Quechua and Måaori peoples describe, define, and enact well-being through the lens of foodways. By analyzing how two Indigenous communities operationalize knowledge to promote sustainable food systems, physical and spiritual well-being, and community health, Mariaelena Huambachano unearths a powerful philosophy of food sovereignty called the Chakana/Maahutonga. Huambachano argues that this Indigenous food sovereignty framework offers a foundation for understanding the practices and policies needed to transform the global food system to nourish the world and preserve the Earth. One of the key features of this book, written for Indigenous communities, students, and scholars, is the development of the author's original research methodology, called the Khipu Model, which will serve as a vital resource for future research on Indigenous ways of knowing"--

Available in PDF, EPUB and Kindle. Book excerpt: This is a gospel of personal stories, science, and existential hope for the Jesus-curious and those who want to know what Green means. Modern people are like the passengers on the Titanic; the triumphs of technology have real limitations. They face the necessity to share the planet that takes them to hard politics. Economics can be integrated with ecology and the essentials of human relationships. The history of Jesus may make him an uncertain figure, but his demand to live for the best can still be felt. Whitehouse draws on paleontologist Fr. Pierre Teilhard de Chardin and existentialist Paul Tillich to claim ‘‘home for all, not just for humans’’ is a universal biological phenomenon and a truth named by Jesus. A biodiversity of illustrations entertains and reveals; trees can speak, dead birds teach, and rivers become persons. Then Jesus Green emerges, as a systems thinker, for the home. If Jesus was homeless for a cause, he found his home on the cross, now a paradoxical symbol that lifts up our place within nature. This creative, passionate account delivers the punch other Green Christian books lack. It could not have come sooner.

Book excerpt: In 2017 four rivers in Aotearoa New Zealand, India, and Colombia were given the status of legal persons, and there was a recent attempt to extend these rights to the Colorado River in the USA. Understanding the implications of creating legal rights for rivers is an urgent challenge for both water resource management and environmental law. Giving rivers legal rights means the law can see rivers as legal persons, thus creating new legal rights which can then be enforced. When rivers are legally people, does that encourage collaboration and partnership between humans and rivers, or establish rivers as another competitor for scarce resources? To assess what it means to give rivers legal rights and legal personality, this book examines the form and function of environmental water managers (EWMs). These organisations have legal personality, and have been active in water resource management for over two decades. EWMs operate by acquiring water rights from irrigators in rivers where there is insufficient water to maintain ecological health. EWMs can compete with farmers for access to water, but they can also strengthen collaboration between traditionally divergent users of the aquatic environment, such as environmentalists, recreational fishers, hunters, farmers, and hydropower. This book explores how EWMs use the opportunities created by giving nature legal rights, such as the ability to participate in markets, enter contracts, hold property, and enforce those rights in court. However, examination of the EWMs unearths a crucial and unexpected paradox: giving legal rights to nature may increase its legal power, but in doing so it can weaken community support for protecting the environment in the first place. The book develops a new conceptual framework to identify the multiple constructions of the environment in law, and how these constructions can interact to generate these unexpected outcomes. It explores EWMs in the USA and Australia as examples, and assesses the implications of creating legal rights for rivers for water governance. Lessons from the EWMs, as well as early lessons from the new ‘river persons,’ show how to use the law to improve river protection and how to begin to mitigate the problems of the paradox.
