Available in PDF, EPUB and Kindle. Book excerpt: Takes as its starting point the observation that a social clause should be concerned with achieving international labour rights. Analyses the conception of international labour rights involving not only law but also other disciplines such as history, morality and economics. Shows that the discussion on the social clause is emblematic of the way the WTO and the international trade system should deal with human rights in general. It requires an approach grounded in international law in the broadest sense, covering general international law, international human rights law, international trade law, international labour law and legal theory.

Available in PDF, EPUB and Kindle. Book excerpt: The emergence of global assembly plants is closely linked to the creation of a global female industrial labor force. Women and Work in Mexico's Maquiladoras examines this larger process in Mexico, where--despite a century of industrialization and a tradition of well-paid, highly organized, male workers--the maquiladora factories have turned to predominantly female labor. Exploring this dramatic shift, this book convincingly demonstrates how gender restructuring in workplaces and households has become a crucial element in the reorientation of Mexican development. The author compares Mexico's new industrial system with its historical antecedent and documents federal policy changes that have resulted in distinct patterns of gender, unionization, household form, and social welfare. Rich in ethnographic detail, the book uses the voices of workers themselves to provide an intimate look at how daily lives have been transformed--in ways that could not have been foreseen--by the national and international processes shaping the country's industrial transition.

Available in PDF, EPUB and Kindle. Book excerpt: Prior to the millennium, economists and policy makers argued that free trade between the United States and Mexico would benefit both Americans and Mexicans. They believed that NAFTA would be a "win-win" proposition that would offer U.S. companies new markets for their products and Mexicans the hope of living in a more developed country with the modern conveniences of wealthier nations. Blending rigorous economic and statistical analysis with concern for the people affected, Mexican Women in American Factories offers the first assessment of whether NAFTA has fulfilled these expectations by examining its socioeconomic impact on workers in a Mexican border town. Carolyn Tuttle led a group that interviewed 620 women maquila workers in Nogales, Sonora, Mexico. The responses from this representative sample refute many of the hopeful predictions made by scholars before NAFTA and reveal instead that little has improved for maquila workers. The women's stories make it plain that free trade has created more low-paying jobs in sweatshops where workers are exploited. Families of maquila workers live in one- or two-room houses with no running water, no drainage, and no heat. The multinational companies who operate the maquilas consistently break Mexican labor laws by requiring women to work more than nine hours a day, six days a week, without medical benefits, while the minimum wage they pay workers is insufficient to feed their families. These findings will make a crucial contribution to debates over free trade, CAFTA-DR, and the impact of globalization.

They often also challenge outsiders' understandings of basic human rights, both directly and indirectly.

Available in PDF, EPUB and Kindle. Book excerpt: Assessing the effectiveness of the North American Agreement on Labour Cooperation (NAALC), this book examines the operation of the core institutions (the Secretariat and National Administrative Offices) over the past seven years. It discusses the main functions of these institutions in hearing public submissions on violations of labour laws and in conducting research and cooperative activities. Based on interview research, the analysis reviews the strengths and weaknesses of the accord to assess its contribution to a common labour relations regime in North America and its impact in creating new transnational communities of actors in government and civil society in the three countries. The NAALC is also compared with the social dimension of the European Union system, and a final assessment is made as to whether the NAALC institutions live up to the promises of their founders and whether these can be a model for labour relations in any future Free Trade Area of the Americas (FTAA) agreement.

Available in PDF, EPUB and Kindle. Book excerpt: Orthodox views of globalization assume that it has the same features and impact everywhere, i.e. the feminization of poverty, labour and even peace. As these ideas circulate in official documents and scientific writings, they settle practically as truths. This challenging and unique book is amongst the first to deconstruct these orthodoxies, using a multi-layered gender analysis where globalization is not treated as a linear and top-down process with a known outcome and a pre-conceived definition of gender. Instead, the authors scrutinize the dynamics of each context on its own merits, including the agency of women and men, resulting in unexpected and groundbreaking insights into the variety of differences apparent, even in sometimes seemingly similar global processes. Through this gender lens, different and new meanings of gender appear, rooted in multiple modernities. The book will be a seminal contribution to debates in the fields of international labour, sexuality, identity, feminism, peace studies and migration.

Available in PDF, EPUB and Kindle. Book excerpt: International trade agreements have often been criticized for limited attention to the rights of workers. The North American Agreement on Labor Cooperation (NAALC), a side agreement to the North American Free Trade Agreement (NAFTA), stands out for linking labor rights provisions to a U.S. trade agreement. Kevin J. Middlebrook provides a comprehensive and systematic examination of the NAALC, assessing its efficacy in protecting workers’ rights over the entire period it was in effect and demonstrating its broader significance for the role of trade and labor standards in U.S. foreign policy. Placing the NAALC in comparative context, Middlebrook considers various ways of promoting workers’ rights and how other U.S. international trade agreements have influenced labor rights abroad. He investigates the origins of the agreement; the political controversies among Canada, Mexico, and the United States over its scope; how the agreement operated in practice; and its longer-term policy legacies. Middlebrook emphasizes the tension between state sovereignty and the international promotion of labor rights in the negotiation and implementation of trade agreements, as well as how labor movements in one partner country can galvanize action in others. Drawing on interviews with high-level officials involved in the trade negotiations and previously unexamined primary sources, The International Defense of Workers is a groundbreaking analysis of the effects of U.S. trade agreements on labor rights.
