Gresham of Indiana stands as an enigmatic character in the politics of the Gilded Age, one who never seemed comfortable in the offices he sought. This first scholarly biography not only follows the turns of his career but seeks also to find the roots of his disaffection. Entering politics as a Whig, Gresham shortly turned to help organize the new Republican Party and was a contender for its presidential nomination in the 1880s. But he became popular with labor and with the Populists and closed his political career by serving as secretary of state under Grover Cleveland. In reviewing Gresham's conduct of foreign affairs, Charles W. Calhoun disputes the widely held view that he was an economic expansionist who paved the way for imperialism. Gresham, instead, is seen here as a traditionalist who tried to steer the country away from entanglements abroad. It is this traditionalism that Calhoun finds to be the clue to Gresham's career. Troubled with self-doubt, Gresham, like the Cato of old, sought strength in a return to the republican virtues of the Revolutionary generation. Based on a thorough use of the available resources, this will stand as the definitive biography of an important figure in American political and diplomatic history, and in its portrayal of a man out of step with his times it sheds a different light on the politics of the Gilded Age.

However, it wasn’t until 2002 that it led to extensive research on the subject, centered upon newspaper reports on the man begun during the Civil War and continued throughout—and even after—his life. And while I rejected Virgil Carrington Jones’s observation on Mosby, contained in the preface of this work, I did not contemplate writing this book until an even more disparaging observation came to my attention during my research. The comment was contained in an article in the Ponchatoula Times of May 26, 1963, as part of a six-article series written by Bernard Vincent McMahon, entitled The Gray Ghost of the Confederacy. Mr. McMahon, in turn, based his comment upon General Omar Bradley’s judgment of what might have been the postwar life of General George Patton: “Now substitute Mosby for General Patton in the book ‘A General’s Life,’ by Omar Bradley . . . ‘I believe it was better for General Patton [Mosby] and his professional reputation that he died when he did . . . He would have gone into retirement hungering for the old limelight, beyond doubt indiscreetly sounding off on any subject anytime, any place. In time he would have become a boring parody of himself—a decrepit, bitter, pitiful figure, unwittingly debasing the legend’” (emphasis mine). McMahon, however, only proffered in his writings the widely accepted view of John Mosby held by many, if not most. However, like General Ulysses S. Grant, I have come to know Colonel Mosby rather more intimately through the testimony of countless witnesses over a span of 150 years, and I believe that it is time for those who deeply respect John Mosby the soldier to now also respect John Mosby the man. A century ago, the book of John Singleton Mosby’s life closed. It is my hope that this book will validate the claim he made during that life that he would be vindicated by time. V. P. Hughes

Waite, 1874–1888, Paul Kens provides a history of the Court during a time that began in the shadow of the Civil War and ended with America on the verge of establishing itself as an industrial world power. Morrison R. Waite (1816–1888) led the Court through a period that experienced great racial violence and sectional strife. At the same time, a commercial revolution produced powerful new corporate businesses and, in turn, dissatisfaction among agrarian and labor interests. The nation was also consolidating the territory west of the Mississippi River, an expansion often marred with bloodshed and turmoil. It was an era that strained America's thinking about the purpose, nature, and structure of government and ultimately about the meaning of the constitution. Some of the landmark events faced by this Court centered on issues of civil rights. These ranged from the Colfax massacre and treatment of blacks in the South to the rights of women, conflicts with Mormons over polygamy and religious freedom, and the mistreatment of Chinese immigrants in the West. Economic concerns also dominated the decisions of the Court. Westward expansion brought conflicts over the distribution of public domain lands. The building and financing of the transcontinental railroad and the web of railroads throughout the nation brought great wealth to some, but that success was accompanied by the Panic of 1873, the first nationwide labor strike, and the Granger movement. Changes in business practices and concerns over concentrated wealth fueled debates over the limits of government regulation of business enterprise and the constitutional status of corporations. In addition to the more dramatic topics of civil rights and economic regulation, this study also covers such important issues of the day as bankruptcy, criminal law, interstate commerce, labor strife, bonds and railroad financing, and land disputes. Challenging the conventional portrayal of the Waite Court as being merely transitional, Kens observes that the majority of these justices viewed themselves as guardians of tradition. Even while facing legal disputes that grew from the drastic changes in post-Civil War America's social, political, and economic order, the Waite Court tended to look backward for its cues. Its rulings on issues of liberty and equality, federalism and the powers of government, and popular sovereignty and the rights of the community were driven by constitutional traditions established prior to the Civil War. This is an important distinction because the conventional portrayal of this Court as transitional leaves the impression that later changes in legal doctrine were virtually inevitable, especially with respect to the subjects of civil rights and economic regulation. By demonstrating that there was nothing inevitable about the way constitutional doctrine has evolved, Kens provides an original and insightful interpretation that enhances our understanding of American constitutional traditions as well as the development of constitutional doctrine in the late nineteenth century.
