In their quest to secure women’s protection from domestic violence and rape, American feminists have become soldiers in the war on crime by emphasizing white female victimhood, expanding the power of police and prosecutors, touting the problem-solving power of incarceration, and diverting resources toward law enforcement and away from marginalized communities. Deploying vivid cases and unflinching analysis, The Feminist War on Crime documents the failure of the state to combat sexual and domestic violence through law and punishment. Zero-tolerance anti-violence law and policy tend to make women less safe and more fragile. Mandatory arrests, no-drop prosecutions, forced separation, and incarceration embroil poor women of color in a criminal justice system that is historically hostile to them. This carceral approach exacerbates social inequalities by diverting more power and resources toward a fundamentally flawed criminal justice system, further harming victims, perpetrators, and communities alike. In order to reverse this troubling course, Gruber contends that we must abandon the conventional feminist wisdom, fight violence against women without reinforcing the American prison state, and use criminalization as a technique of last—not first—resort.

Book excerpt: The issue of third parties in the sex industry – individuals who are neither the client nor the service provider – has become especially urgent in our current socio-political context. Surprisingly, in spite of an emergence of critical scholarship on the sex industry, as well as recommendations by key governmental committees, little attention has been extended to examining the role of individuals labelled pimps, procurers, and traffickers. Addressing the function of third parties on the street and indoors, Getting Past 'the Pimp' incorporates solid empirical evidence including documentary analysis, 75 interviews with third parties, and 52 interviews with sex workers to unpack the roles and relationships of third parties in three sectors of the sex industry‒ incall/outcall, stripping, and street-based prostitution. Contrary to prevailing stereotypes that portray third parties as inherently abusive and controlling, these workers fulfill important roles and provide vital services as associates, fee-for-service hires, and agency owners or managers responsible for scheduling and arranging transportation and security. The sex industry, like mainstream businesses, rarely depend exclusively on client and worker to operate efficiently, and safely.

Book excerpt: Over the past two decades, human rights as legal doctrine and practice has shifted its engagement with criminal law from a near exclusive condemnation of it as a source of harm toward increasingly invoking it as a necessary remedy for abuses. These shifts are most visible in the context of sexuality, reproduction, and gender. Criminal law appears in modern states as a tool for societies to define forbidden acts (crimes) and prescribe punishments. It authorizes the state to use force as an aspect of expressing and establishing norms—societal expectations for acceptable behavior which when breached permit individuals to be excluded and stigmatized as unfit for inclusion. But the core principles of human rights oppose exclusion and stigma and embrace the equality and dignity of all. Therefore there is an insuperable tension when human rights actors invoke criminal law to protect and vindicate human rights violations. Beyond Virtue and Vice examines the ways in which recourse to the criminal law features in work by human rights advocates regarding sexuality, gender, and reproduction and presents a framework for considering if, when, and under what conditions, recourse to criminal law is compatible with human rights. Book excerpt: The popular 1998 reformasi movement that brought down President Suharto’s regime demanded an end to illegal practices by state officials, from human rights abuse to nepotistic investments. Yet today, such practices have proven more resistant to reform than people had hoped. Many have said corruption in Indonesia is "entrenched". We argue it is precisely this entrenched character that requires attention. What is state illegality entrenched in and how does it become entrenched? This involves studying actual cases. Our observations led us to rethink fundamental ideas about the nature of the state in Indonesia, especially regarding its socially embedded character. We conclude that illegal practices by state officials are not just aberrations to the state, they are the state. Almost invariably, illegality occurs as part of collective, patterned, organized and collaborative acts, linked to the competition for political power and access to state resources. While obviously excluding many without connections, corrupt behaviour also plays integrative and stabilizing functions. Especially at the lower end of the social ladder, it gets a lot of things done and is often considered legitimate. This book may be read as a defence of area studies approaches. Without the insights that grew from applying our area studies skills, we would still be constrained by highly stylised notions of the state, which bear little resemblance to the state’s actual workings. The struggle against corruption is a long-term political process. Instead of trying to depoliticize it, we believe the key to progress is greater popular participation. With contributions from Simon Butt, Robert Cribb, Howard Dick, Michele Ford, Jun Honna, Tim Lindsey, Lenore Lyons, John McCarthy, Ross McLeod, Marcus Mietzner, Jeremy Mulholland, Gerben Nooteboom, J Danang Widoyoko and Ian Wilson. In the Middle East, Dubai has been accused of being a hotbed of trafficking. Pardis Mahdavi, however, draws a more complicated and more personal picture of this city filled with migrants. Not all migrant workers are trapped, tricked, and abused. Like anyone else, they make choices to better their lives, though the risk of ending up in bad situations is high. Legislators hoping to combat human trafficking focus heavily on women and sex work, but there is real potential for abuse of both male and female migrants in a variety of areas of employment—whether on the street, in a field, at a restaurant, or at someone's house. Gridlock explores how migrants' actual experiences in Dubai contrast with the typical discussions—and global moral panic—about human trafficking. Mahdavi powerfully contrasts migrants' own stories with interviews with U.S. policy makers, revealing the gaping disconnect between policies on human trafficking and the realities of forced labor and migration in the Persian Gulf. To work toward solving this global problem, we need to be honest about what trafficking is—and is not—and to finally get past the stereotypes about trafficked persons so we can really understand the challenges migrant workers are living through every day.
