Available in PDF, EPUB and Kindle. Book excerpt: The chapters in this volume arise from a conference held at the University of Aberdeen concerning the law of causation in the UK, Commonwealth countries, France and the USA. The distinguished group of international experts who have contributed to this book examine the ways in which legal doctrine in causation is developing, and how British law should seek to influence and be influenced by developments in other countries. As such, the book will serve as a focal point for the study of this important area of law. The book is organised around three themes - the black letter law, scientific evidence, and legal theory. In black letter law scholarship, major arguments have emerged about how legal doctrine will develop in cases involving indeterminate defendants and evidential gaps in causation. Various chapters examine the ways in which legal doctrine should develop over the next few years, in particular in England, Scotland, Canada and the USA, including the problem of causation in asbestos cases. In the area of scientific evidence, its role in the assessment of causation in civil litigation has never been greater. The extent to which such evidence can be admitted and used in causation disputes is controversial. This section of the book is therefore devoted to exploring the role of statistical evidence in resolving causation problems, including recent trends in litigation in the UK, USA, Australia and in France and the question of liability for future harm. In the legal theory area, the so-called NESS (necessary element in a sufficient set) test of causation is discussed and defended. The importance of tort law responding to developing science and observations from the perspective of precaution and indeterminate causation are also explored. The book will be of interest to legal academics, policy makers in the field, specialist legal practitioners, those in the pharmaceutical and bioscience sectors, physicians and scientists.

Available in PDF, EPUB and Kindle. Book excerpt: This technical reference work contains a large selection of proposed standard terms and definitions and model data structures, continuing the effort to develop a uniform national terminology for collecting and exchanging justice information and statistics. It incorporates material from and supersedes the first edition. It is primarily intended for the use of justice data collectors, processors, analysts, and interpreters, particularly those who are concerned with the communication of justice information between the States and at the national level. The recommended terminology is intended to promote the unambiguous description and communication of basic facts concerning criminal and juvenile justice processes, agencies, alleged and adjudicated offenders, and offenses. Model data structures describe standardizable units and events in selected subject areas and explicate category and term relationships. Each entry in the dictionary provides either recommended data system usages, or a description of actual usages in the justice community, or both. A discussion of the role of terminology in data system development and statistics and of problems in the development and adoption of an unambiguous and consistent technical vocabulary is included.

Available in PDF, EPUB and Kindle. Book excerpt: Philosophy has a strong presence in evidence law and the nature of evidence is a highly debated topic in both general and social epistemology; legal theorists working in the evidence law area draw on different underlying philosophical theories of knowledge, inference and probability. Core evidentiary concepts and principles, such as the presumption of innocence, standards of proof, and others, reply on moral and political philosophy for their understanding and interpretation. Written by leading scholars across the globe, this volume brings together philosophical debates on the nature and function of evidence, proof, and law of evidence. It presents a cross-disciplinary overview of central issues in the theory and methodology of legal evidence and covers a wide range of contemporary debates on topics such as truth, proof, economics, gender, and race. The volume covers different theoretical approaches to legal evidence, including the Bayesian approach, scenario theory and inference to the best explanation. Divided in to five parts, Philosophical Foundations of Evidence Law, covers different theoretical approaches to legal evidence, including the Bayesian approach, scenario theory and inference to the best explanation.

Book excerpt: This text presents the fundamentals of criminal investigation and provides a sound method for reconstructing a past event (i.e., a crime) based on three major sources of information - people, physical evidence and records. More than a simplistic introductory text, yet written in an easy-to-read, user-friendly format, it offers a broad approach to criminal investigation. Dozens of photographs, graphics, table, charts and diagrams supplement the text. A glossary elaborates on terms found in the text, gathered into one handy reference.
