Book excerpt: [Truncated abstract] Unconventional gas reserves are typically characterised by relatively low permeability, making these reserves more challenging technically and commercially to exploit than conventional gas reserves. The production of shale gas, an unconventional gas, is expanding worldwide. Most activity is occurring in the United States, while the industry is gaining momentum in other countries (for instance, Canada) or poised to begin (for instance, Australia and the United Kingdom). The rapid and increased interest in shale gas, along with the special characteristics of shale gas production, poses a number of challenges for industry regulators. These characteristics include the techniques of vertical drilling and hydraulic fracturing. The challenges associated with shale gas production raise a number of risks, particularly to the environment. Compared to other countries, the United States' regulatory regime is complex. The complexity is due to having to 'catch-up' to the rapid increase in shale gas activity and the interaction and tension between federal and state governments. In contrast, Western Australia s response has been to review the State's regulatory regime for conventional gas and account for unconventional gas production where it was considered necessary. While Western Australia's approach is not optimal, it is coherent and anticipatory. There have been two dominant regulatory responses by jurisdictions to address the challenges associated with shale gas production. The first is to adopt a 'business as usual approach', which involves applying existing regulation for conventional gas to shale gas production. The second response is to adjust the regulation for conventional gas in an attempt to account for shale gas production. Both responses are rejected by the thesis an unacceptable level of risk will result if either is used. Rather, a response in the form of fresh regulation is needed. To address the challenges and risks of shale gas production, the thesis proposes a best practice framework for the regulation of shale gas production. The 11th Circuit decision in Legal Environmental Assistance Foundation v. U.S. EPA prompted federal agency study, which resulted in Congress expressly excluding "the underground injection of fluids or propping agents (other than diesel fuels) pursuant to hydraulic fracturing operations related to oil, gas, or geothermal production activities" from the definition of "underground injection." Thus, in keeping with traditional regulation of on-shore oil and gas development and groundwater, states have been left to their own devices in addressing any potential underground migration of fluids and gas as a result of hydraulic fracturing activities.Left without a federal floor of minimal regulation in permitting shale gas extraction, states have routinely modified their statutes and rules to address increasing public concern and to reflect enhanced understanding of well construction and the hydraulic fracturing process. Yet, most states have not fully utilized their statutory authority to address the environmental risk assessment that would take place if the exemption of hydraulic fracturing activities from the federal definition of "underground injection" were not present. Rather than using their statutory authority to evaluate potential environmental impacts from shale gas extraction proposals, most states permitting of oil and gas development have stuck to a traditional role: require minimum well construction standards, setbacks, and a process for groundwater supply replacement. This approach differs dramatically from the predictive model-based approach of permitting underground injection control wells.

Risks and Risk Governance in Shale Gas Development is the summary of two workshops convened in May and August 2013 by the National Research Council's Board on Environmental Change and Society to consider and assess claims about the levels and types of risk posed by shale gas development and about the adequacy of existing governance procedures. Participants from engineering, natural, and social scientific communities examined the range of risks and of social and decision-making issues in risk characterization and governance related to gas shale development. Book excerpt: Shale gas development has become big business in the United States during the past decade, introducing drilling to parts of the country that have not seen it in decades and provoking an accelerating shift in the country's energy profile. State governments, which have historically regulated the oil and gas industry and continue to do so today, were in many cases caught by surprise by the speed and the scale of the shale gas boom and are still trying to update and adapt their regulatory practices to respond to the impacts that shale gas development is causing in communities in their states. In some instances, these impacts have included groundwater and surface water contamination, air pollution, exploded homes, and damage to wetlands and other habitats, among other impacts. Shale gas development has also created jobs, brought economic development to distressed communities, lowered fuel costs, and has begun to supplant coal in the nation's electricity supply. The thesis seeks to understand whether primary regulatory authority over shale gas development should rest with the states or with the federal government. In answering this question, the author applies theory from the field of regulatory federalism to the practice of shale gas development to ascertain whether the federal government or state governments are best suited to regulate shale gas development. Grounding the analysis in both regulations as-written and as-applied in a number of states that have active shale gas industries, the author uses four key criteria to gauge whether regulatory authority should rest with the central government or with the states. These four criteria are: the geographic distribution of costs and benefits associated with shale gas development; regulatory capacity at the federal level and at the state level; which level can better foster innovation, flexibility, and adaptability; and which level can better provide efficiency, certainty, and stability. The analysis finds that, in most cases, states are better situated than the federal government to regulate shale gas development on the basis of each of the four criteria. The author also subjects current regulatory practice to a two-part test to determine whether regulatory failure is currently occurring that would compel the federal government to assume regulatory authority. The results from this test are negative. The author concludes that primary regulatory authority over shale gas development should remain with state governments. Finally, the author provides four policy recommendations, two each to state governments and to the federal government, to improve regulatory practice and outcomes in the future.

Book excerpt: The United States is expected to become the world's largest oil producer by 2020, overtaking Saudi Arabia, and the world's top natural gas producer by 2015, surpassing Russia. In the past decade, energy companies have learned to tap previously inaccessible oil and gas in shale with “hydraulic fracturing” (“fracturing” or “fracking”), pumping fluid at high pressure to crack the shale and release gas and oil trapped inside. This “shale revolution” has created millions of jobs, enhanced our energy independence, and reduced U.S. greenhouse gas emissions by substituting natural gas for coal. Even so, fracturing is controversial. It may undercut the renewable energy industry, exacerbate air pollution and congestion, and use significant amounts of water. The most unique risk, which is the focus of this Article, is the potential contamination of groundwater. The fluid used in fracturing contains toxic chemicals. There is little evidence so far that subterranean fracturing can directly contaminate groundwater, and this risk may never materialize. The layer of shale that is fractured is usually thousands of feet below the water table, with a buffer of dense rock or clay in between. But there are other ways in which fracturing might contaminate groundwater, including surface spills of fracturing fluid, improper handling of waste, and the migration of natural gas into water wells. Some of these risks are familiar from decades of conventional oil and gas production, while others are new. In response, this Article proposes a strategy for regulating water contamination from fracturing. For issues that are already well understood, we would rely on best practices regulations. For issues that are unique to fracturing and are not yet well understood, we would rely on liability rules - and, specifically, a hybrid of strict liability and a regulatory compliance defense - to motivate industry to take precautions, develop risk-reducing innovations, and cooperate in the development of best practices regulations. To facilitate more accurate determinations of causation, we recommend information-forcing rules (e.g., requiring energy companies to test water quality before they begin fracturing). We also suggest other design features for the liability system, such as one-way fee shifting and provisions to ensure that defendants will not be judgment proof. To ensure that the regulatory regime draws on existing regulatory expertise and is both dynamic and tailored to local conditions, we recommend keeping the regulatory center of gravity in the states, instead of fashioning a new federal regime.

Book excerpt: In light of an increasing intent by the UK Government to authorise hydraulic fracturing (also commonly known as 'fracking'), this paper examines the experience of the U.S. in regulating a practice which presents considerable risk to the environment. The impact of shale gas development on water resources in particular has shaped the greatest regulatory response in U.S. states and is therefore the focus of this contribution. With the development cycle posing impacts on water use, groundwater and surface water contamination, this paper aims to assess how effectively the law in the U.S. is mitigating these risks both at federal and state level. From an assessment of U.S. regulation, the paper attempts to highlight areas from which the UK could learn and adjust its own existing legal framework in order to better protect against the presented water risks posed by a UK shale gas industry. Whilst the UK has existing general legislation in place, it has yet to reach production levels as experienced in the U.S. and this paper examines how the U.S. has been forced to adapt water law and policy during active shale gas development. The paper first explains and questions the U.S. decision to exempt fracking from the Safe Drinking Water Act, a uniform federal regulation. It argues that the rationale for the exemption is unsatisfactory and submits that a similar reactive policy towards water law must be avoided by UK Governments. As a result of the exemption, this paper then assesses the efforts made by regulators of the two leading shale gas producing states; namely Pennsylvania and Texas, to protect water resources. It first highlights how both states have controlled the use of water before fracking takes place by comparing common law doctrines and public body governance. Second, it assesses how both states have been forced to adapt existing well construction requirements to protect groundwater during fracking. The analysis of state regulation concludes by highlighting the problems of current federal regulation over the treatment of untreated wastewaters, and how Pennsylvania has been forced to amend its law in response to water contamination. The final section offers a preliminary overview of the current UK legal framework applying to shale gas and the risks to water resources. It offers an initial assessment as to whether the UK should consider adapting its water law in light of the U.S. experience. This assessment concludes that whilst the existing UK legislation is to some extent more advanced than its American counterpart, its effectiveness ultimately remains untested and a revisit of the existing regulation is recommended.

Book excerpt: The United States is in the midst of a boom in natural gas and oil production, much of which has occurred in shale formations around the country. As shale development has expanded -- largely as a result of new horizontal drilling and “slickwater” hydraulic fracturing (fracking, fracing, or hydofracking) techniques -- questions have arisen regarding the environmental risks of drilling and fracturing in shales and how laws, policies, and regulations address these risks. To understand whether and how regulation addresses risks, one must know both the content of regulations and how they are applied through inspections of well sites, notations of violations, and/or enforcement. An accompanying paper by this author, entitled “Regulation of Shale Gas Development, Including Hydraulic Fracturing” addresses the content of federal, regional, state, and local regulations that apply to shale gas development; this paper explores, in a preliminary fashion, how these regulations are applied. It briefly surveys complaints about shale gas and tight sands development (both of which typically require fracturing) lodged by citizens with state agencies, states' notation of environmental violations at shale gas and tight sands wells both in response to these complaints and as a result of independently-instigated site visits or self-reported violations, and states' capacity to inspect sites and enforce violations noted. The objective of this “on-the-ground” review of shale gas development regulatory activities is to offer a preliminary picture of the environmental effects of shale gas development and how states address them through citations of violations and/or initiation of enforcement action. Regulations have little effect if they are rarely applied to regulated actors or only sporadically enforced. Looking to both the content of regulations, violations of the regulations, and enforcement therefore provides a more complete regulatory picture. The Energy Institute at the University of Texas funded the research for this paper.
