Book excerpt: Although there has been a lot written about how counter-terrorism laws impact on human rights and civil liberties, most of this work has focussed on the most obvious or egregious kinds of human rights abrogation, such as extended detention, torture, and extraordinary rendition. Far less has been written about the complex ways in which Western governments have placed new and far-reaching limitations on freedom of speech in this context since 9/11. This book compares three liberal democracies - the United States, the United Kingdom and Australia, in particular showing the commonalities and similarities in what has occurred in each country, and the changes in the appropriate parameters of freedom of speech in the counter-terrorism context since 9/11, achieved both in policy change and the justification for that change. In all three countries much speech has been criminalized in ways that were considered anachronistic, or inappropriate, in comparable policy areas prior to 9/11. This is particularly interesting because other works have suggested that the United States' unique protection of freedom of speech in the First Amendment has prevented speech being limited in that country in ways that have been pursued in others. This book shows that this kind of argument misses the detail of the policy change that has occurred, and privileges a textual reading over a more comprehensive policy-based understanding of the changes that have occurred. The author argues that we are now living a new-normal for freedom of speech, within which restrictions on speech that once would have been considered aberrant, overreaching, and impermissible are now considered ordinary, necessary, and justified as long as they occur in the counter-terrorism context. This change is persistent, and it has far reaching implications for the future of this foundational freedom.

Book excerpt: Incisive, authoritative and thoughtful, this important and timely collection of papers exploring the unresolved issues left by the recent global financial turmoil, will undoubtedly shape the policy responses to come. Interdisciplinary in approach and wide-ranging in jurisdictional scope, it draws together influential commentators, practitioners and regulators, to create a new milestone in the search for the fundamentals of a more stable global financial system.? - Eva Lomnicka, King?s College London, UK ?This book contains a large number of chapters, nearly 30 in all, by acknowledged experts on various aspects of the recent financial crisis. Whichever aspect of this crisis that may interest you, such as bank taxes, deposit insurance, TBTF and how to respond, cross-border issues, and many, many others, you will find chapters that are both authoritative and stimulating in this collection. The editors are to be congratulated not only in their selection of authors but also in the speed with which they have taken them from conference presentation to book chapter.? - Charles Goodhart, London School of Economics, UK Managing Risk in the Financial System makes important and timely contributions to our knowledge and understanding of banking law, financial institution restructuring and related considerations, through the production of an innovative, international and interdisciplinary set of contributions which link law and policy issues surrounding systemic risk and crisis management. The recent financial crisis has exposed both the banking industry and financial system safety net players in many countries to a considerable level of distress as well as economic and reputational damage. These circumstances have heightened the need for policymakers to consider remedial measures under a broad umbrella that encompass inter alia prompt corrective actions, early closure of distressed entities, deposit insurance, bail-outs, state-aid, bank resolution and restructuring techniques. These essays provide an important contribution to research in this area, at a crucial time in the debate around the future financial industry. Contributors

Available in PDF, EPUB and Kindle. Book excerpt: This book provides new insights into police cooperation from a comparative socio-legal perspective. It presents a broad analysis of comparable police cooperation strategies in two systems: the EU and Australia. The evolution of regulatory trends and cooperation models is analysed for both systems and possible transferable strategies identified. Drawing on interviews with practitioners in the EU and Australia this book highlights a number of areas where the EU can be compared to a federal system and addresses the advantages and disadvantages of being a Union or a federation of states with a view to police cooperation practice. Particular topics addressed are the evolution of legal frameworks regulating police cooperation, informal cooperation strategies, Joint Investigation Teams, Europol and regional cooperation. These instruments foster police cooperation, but could be improved with a view to cooperation practice by learning from regulatory techniques and practitioner experiences of the respective other system.

Book excerpt: The Prèm Treaty is an initiative by seven Member States to enhance cooperation in combating terrorism and serious cross-border crime. There is a move to incorporate it into EU law. As it can only be adopted unanimously, the Government is in a strong negotiating position and has already obtained agreement to delete a provision on "hot pursuit". The Committee recommend that they should also seek agreement on the estimated cost of incorporating the provisions. The Prèm Treaty is mainly concerned with the exchange of data, which raises questions of data protection. It is an opportunity to link the fight against crime with agreement on a Data Protection Framework Decision. This report looks at both the Prèm initiative and other related proposal that are genuine EU initiatives.

Book excerpt: This book examines the nature of protest and the way in which the police and state respond to the activities associated with this term. Protest is explored within the context of the perceived decline in public engagement with recent general election contests. It is often thought that protest is regarded as an alternative to, or as a replacement for, formal political engagement with electoral politics, and this book provides a thoughtful assessment of the place of protest in the contemporary conduct of political affairs. Analysing key forms of protest such as: demonstrations, direct action, protest conducted within the workplace, riots and terrorism, this study also illustrates each of these activities with a wide range of examples of events that have taken place within the UK since 1945. It will be of keen interest to students of criminology, criminal justice studies, police studies and politics.

This book was released on 2008-03-05 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental taxes as a proportion of all taxation peaked at 9.7 per cent in 1999 and have declined ever since, falling to 7.3 per cent in 2006. This report sets out a number of conclusions and recommendations covering different areas of environmental policy. (1) Aviation: the reform of Air Passenger Duty into a levy per flight rather than per passenger is welcome, but tax on aviation must be significantly increased so as to stabilise demand and resulting emissions. (2) Motoring: road transport emissions in England increased by 12 per cent between 1997 and 2006, and are forecast to increase, so it is important for the Budget to put in place rises in fuel duty. (3) Carbon capture and storage: the Treasury must provide more assistance for the development of this technology in the UK. (4) Shadow price of carbon: this should be increased to discourage the approval of carbon-intensive policies and projects, and so improve the prospects of achieving the reduction in global emission targets. (5) Environmental transformation fund: the Pre-Budget report (Cm. 7227, ISBN 9780101722728) announced funding for such a fund, with £370 million to be spent over three years, but only £170 million was new money. (6) Emissions trading: it must be clear when reported emissions figures incorporate the purchase of carbon credits, otherwise they will give a false picture of the decarbonisation progress within the UK. (7) Public service agreements: the new PSA is too diffuse, with no clear departmental targets for reducing emissions; the Government should consider setting emissions reduction targets for specific sectors of the economy. The Treasury has not responded on the scale or with the urgency recommended by the Stern Review (ISBN 9780102944204) and the 2008 Pre-Budget report needs to establish a coherent set of measures to help deliver the UK's 2020 domestic and EU targets on emissions and renewable energy.

Book excerpt: One of the most dynamic areas of EU law since the great changes brought to the EU constitutional order by the Amsterdam Treaty in 1999 has been cooperation in the fields of policing and criminal justice. Both fields have already been the subject of substantial legislative effort in the EU and an increasing amount of judicial activity in the European Court of Justice. In 2007 - after the Constitutional Treaty of 2004 failed - the new Reform Treaty planned very substantive changes to these policies. Bringing together a wide-ranging set of topics and contributors, this book enables readers to understand these changes by examining three key questions: how did we get to the Reform Treaty; what have been - and still are - the key struggles in competence; and how do the changes fit into the transformation of police and judicial cooperation in criminal matters in the EU?

This book was released on 2009 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government has missed a big opportunity to kick start a green-industrial revolution with its £3bn fiscal stimulus. Germany, the US, Japan and China have invested billions in their low-carbon industries. But only one sixth of the UK's Government's fiscal stimulus package was devoted to green industry. Many of the policies needed to cut carbon emissions will provide good opportunities to increase employment and could give the UK a competitive advantage in the coming decades. The UK has the potential to take a leading global role in a number of low carbon sectors. Creating a strong home market in off-shore wind could ensure UK companies are well placed to exploit export opportunities to other EU countries - or promising markets such as the US and China. Increasing the speed and scale of the programme to insulate UK homes could also sustain employment and kick start a market estimated to be worth between £3.5 - 6.5 billion a year. Business needs confidence that financial incentives and regulation designed to promote low carbon industries will be maintained. Although it is recognised that the UK government has made significant investment for delivery of its Low Carbon Industrial Strategy and its Low Carbon Transition Plan it is not sufficient to meet emissions targets or to provide the economic advantage needed. It is felt that the Low Carbon Industrial Strategy does not effectively address a transition across the whole economy. The Committee on Climate Change has identified key sectors in which energy savings must be made and the Government's strategy on green jobs must be directly linked to these sectoral targets and green industries developed to achieve these. The Committee also feels that, in particular, a 'quick win' street-by-street programme of energy saving measures for households that will boost employment and keep UK building firms in business should be developed as a priority. The market-based, demand-led approach to skills has not worked because employers are unable to effectively articulate their needs. The Government's new skills strategy must prioritise the skills needed to drive the economy through the low-carbon transition. A body to lead the green skills agenda must be found and low-carbon skills need to be integrated through the whole skills delivery system to encourage behavioural change across the entire economy

Available in PDF, EPUB and Kindle. Book excerpt: On 20 September 2001, in an address to a Joint Session of Congress and the American people, President George W Bush declared a 'war on terror'. The concept of the 'war on terror' has proven to be both an attractive and a potent rhetorical device. It has been adopted and elaborated upon by political leaders around the world, particularly in the context of military action in Afghanistan and Iraq. But use of the rhetoric has not been confined to the military context. The 'war on terror' is a domestic one, also, and the phrase has been used to account for broad criminal legislation, sweeping agency powers and potential human rights abuses throughout much of the world. This collection seeks both to draw on and to engage critically with the metaphor of war in the context of terrorism. It brings together a group of experts from Australia, Canada, the United Kingdom, France and Germany who write about terrorism from a variety of disciplinary perspectives including international law and international relations, public and constitutional law, criminal law and criminology, legal theory, and psychology and law.
