Die Arbeit ging nicht so von statten, wie ich wunschte, und wird kaum in der von mir geplanten Weise zur schliesslichen Durchfuhrung gelangen konnen. Wohl aber kann ich in verschiedenen Bruchstucken Auszuge mitteilen, die aus der fruheren Literatur gemacht wurden und die als Quellenwerke zur Rechtsgeschichte Afrikas dienen mogen. Naturlich sind sie mit der Vorsicht aufzunehmen, die bei allen fruheren Berichten von Nichtethnologen notwendig ist, allein die Berichte der einzelnen stehen unter so starker Kontrolle durch die Mitteilung anderer und durch dasjenige, was wir heute wissen, dass sich die Schlacken ziemlich leicht ausscheiden lassen. Jedenfalls werden die Berichte dazu beitragen, die Forschungen uber die seelischen Erscheinungen dieser Volker zu erweitern und zu vertiefen. Dazu kommt noch das weitere. Wenn wir Mitteilungen aus alter Zeit lesen, so gibt uns dies zugleich einen Anhaltspunkt, die mehrhundertjahrige Geschichte des Rechtes der Volker zu erforschen und zu zeigen, da Bauch hier Entwicklung und Leben ist, wenn sich auch, wie bei allen Volkern mit mangelhafter Individualisierung, der Fortschritt nur in langsamem Zeitmasse vollzieht. Did weakness compel them to prohibit their agents from entering these properties, as historians have traditionally believed? By placing restraints on themselves and their agents, kings demonstrated their authority, affirmed their status, and manipulated the boundaries of sacred space.Rosenwein transforms our understanding of an institution central to the political and social dynamics of medieval Europe.
