Volumes I and II contain entries pertaining to the Jewish people in relationship to God. Volume III explains how the Jewish people can restore and maintain their society in accordance with the Torah as it is explained by the rabbis. In Volumes IV and V of this study, we take up the life of the Jewish household in their encounter with God. The Encyclopaedic account therefore moves from regulating relationships between Israel and God to establishing stable and equitable relationships among Israelites and finally to actually living the Halakhah."

These category-formations everywhere pursue a cogent analytical program, addressing diverse subjects, treated systematically, a single set of questions of definition and analysis. Is Scripture the origin of the Halakhic system, which defines the norms of Judaism? At stake is not the starting point of discrete bits of legal data. At issue is the origin of the comprehensive structure comprised by the Halakhic category-formations, by these topics and no others. Scripture forms the natural starting point for any inquiry into the origins of Judaism. So it is quite natural to treat Scripture as the base-line and the Halakhic category-formations as the variable when seeking the origin of the system. But what happens when, as in this project, we treat the system as the base-line and Scripture as the variable? Then we see that the Halakhic system viewed as a coherent statement does not originate in Scripture. Important parts of that statement do, important parts do not. But the system viewed whole does not.

First, what is the relationship of the Mishnah to Scripture, or “oral torah” to “written torah,” for understanding the religion of Judaism? These questions are posed with regard to a Judaism that existed from just prior to the destruction of the Temple in 70 C.E. until around 200 C.E. and assumes as well the groundwork of Neusner’s earlier volume The Mishnah: Social Perspectives. In the present volume, Neusner condenses years of research on these questions and offers a clear and thorough analysis through a single lens. He looks closely at how the Halakhah of the Mishnah relates to the events prior to the Mishnah’s writing (e.g., the destruction of the Temple, ca. 70 C.E., and the Bar Kokhba War, ca. 135 C.E.), through the reconstruction following Bar Kokhba until the close of the Mishnah (ca. 200 C.E.). Then an examination is made of how the stages in the unfolding of the Halakhah of the Mishnah relate to the principal events of the times, which delineate those stages. According to eminent religion scholar Jacob Neusner, the key to understanding the Mishnah is to read it as philosophy, in accord with the generally accepted understanding of philosophy in its time and place. In 'Judaism as Philosophy', Neusner studies a large sample of evidence, meticulously translated and carefully explained, and identifies the philosophical side of the Mishnah's system, method, and message alike. The philosophical tradition in which the Mishnah takes its place, Neusner explains, utilizes the Aristotelian method of hierarchical classification to demonstrate the proposition (important to Middle Platonism and profoundly expressed by Plotinus) that many things really form a single thing: many species, a single genus; many genera, an encompassing, well-crafted and cogent whole. Through the systematic and orderly hierarchical classification of the things of nature, the framers of the Mishnah illustrate the ultimate unity of all being emanating from the One on high. Arguing that the document's writers chose a legal form for a philosophical proposition, this book completely changes a centuries-old way of reading the Mishnah. Judaism emerges as a sustained demonstration of the unity of all being under one God.
