Book excerpt: In the past decade, few subjects at the intersection of medicine and sports have generated as much public interest as sports-related concussions - especially among youth. Despite growing awareness of sports-related concussions and campaigns to educate athletes, coaches, physicians, and parents of young athletes about concussion recognition and management, confusion and controversy persist in many areas. Currently, diagnosis is based primarily on the symptoms reported by the individual rather than on objective diagnostic markers, and there is little empirical evidence for the optimal degree and duration of physical rest needed to promote recovery or the best timing and approach for returning to full physical activity. Sports-Related Concussions in Youth: Improving the Science, Changing the Culture reviews the science of sports-related concussions in youth from elementary school through young adulthood, as well as in military personnel and their dependents. This report recommends actions that can be taken by a range of audiences - including research funding agencies, legislatures, state and school superintendents and athletic directors, military organizations, and equipment manufacturers, as well as youth who participate in sports and their parents - to improve what is known about concussions and to reduce their occurrence. Sports-Related Concussions in Youth finds that while some studies provide useful information, much remains unknown about the extent of concussions in youth; how to diagnose, manage, and prevent concussions; and the short- and long-term consequences of concussions as well as repetitive head impacts that do not result in concussion symptoms. The culture of sports negatively influences athletes' self-reporting of concussion symptoms and their adherence to return-to-play guidance. Athletes, their teammates, and, in some cases, coaches and parents may not fully appreciate the health threats posed by concussions. Similarly, military recruits are immersed in a culture that includes devotion to duty and service before self, and the critical nature of concussions may often go unheeded. According to Sports-Related Concussions in Youth, if the youth sports community can adopt the belief that concussions are serious injuries and emphasize care for players with concussions until they are fully recovered, then the culture in which these athletes perform and compete will become much safer. Improving understanding of the extent, causes, effects, and prevention of sports-related concussions is vitally important for the health and well-being of youth athletes. The findings and recommendations in this report set a direction for research to reach this goal.

In this Essay -- prepared as part of the Duquesne University School of Law Symposium Athletes, Veterans, and Neuroscience: A Symposium on Traumatic Brain Injury and Law -- I address the question: Are state youth sports concussion statutes working? The Article reviews what we currently know about the implementation of state youth sports concussion laws. I offer five conclusions about the current state of concussion laws. First, there is generally widespread acceptance and appreciation of the concussion laws. Second, in general it appears that most high schools have implemented a concussion protocol (roughly) consistent with state law. Third, stakeholders may be resistant to legislatively-mandated concussion protocols when following those protocols is perceived to interfere with an athletic goal, or a doctor-patient relationship. Fourth, it appears that state concussion laws have contributed to better recognition and reporting of concussions. Fifth, across multiple states, there is a need for more dissemination of concussion education. But there remain large gaps in knowledge about effectiveness. Moreover, we know virtually nothing systematic about the implementation of the law in non-school youth leagues, and the scientific knowledge base on elementary age athletes remains limited. I argue that the primary policy challenge going forward is, amidst this lack of knowledge, to facilitate accurate communication of risks and benefits to allow for informed athlete and parent decision-making.

Book excerpt: "Sport-related concussions (SRC) occur at alarming rates among high school athletes (ages 13-18), which made the Center for Disease Control and Prevention and other agencies classify it as an "epidemic". If improperly managed, physical, mental, and emotional consequences can occur for SRC patients. Due to these consequences all 50 states in the US have passed legislation requiring medical release from a practitioner before a student-athlete can return to athletics following an SRC, yet there is no universally accepted consensus on how to medically manage this common injury. A 22-item, validated survey was distributed to Michigan practitioners who sign off on SRC. The purpose of this study was to compare the management of SRC between urban and rural practitioners in the following critical areas: 1) practitioner demographics in urban and rural settings, 2) return-to-learn and return-to-play protocols used by practitioners, 3) sport-related concussion diagnostic tools used by practitioners, 4) the working relationship between practitioners and athletic trainers in the secondary school setting, and 5) practitioner's knowledge of the Michigan Sports Concussion Law. A total of 20 participants were included in this research (8 urban, 12 rural). One significant finding of this study was that rural practitioners rely very heavily on the results and recommendations of the ImPACT Application, p = 0.040, compared to their urban counterparts. The information collected in this study can be used to recognize the strengths and weaknesses of current protocols and aid in reforming the current policy surrounding sport-related concussions in the state of Michigan."--Abstract.

Book excerpt: Education Commission of the States (ECS) reviewed legislation in the 50 states to see how state leaders are responding to concerns about concussions in youth sports. This report reviews state responses to concussion concerns, and provides examples of provisions put in place by California, Connecticut, and Texas. Three emerging innovations are suggested for consideration in policy or guidelines (steps that go beyond symptom-driven diagnosis, which has proven to be an inexact science) that can shape the future of state legislation regarding concussions in youth sports: (1) baseline testing--a preseason exam conducted by a trained health care professional assessing an athlete's balance, brain function, and signs of concussion symptoms; (2) blood test--a test measuring the brain protein S100B that leaks into the blood stream following a brain injury; and (3) an iPad app for use during a game following an athlete taking a hard hit--the iPad's gyroscope and accelerometer detect balance problems. This report also discusses current work being done to address the prevention of concussions, as well as the need for future research and continued work in terms of policy implementation and education regarding concussions.

Book excerpt: PurposeIn 2010, Massachusetts enacted legislation with regulations for the identification, treatment, and return-to-activity targeting public and private middle and high school student athletes with mTBI or other brain injury. School Nurses (SNs), Licensed Athletic Trainers (ATs) and Athletic Directors (ADs) play pivotal roles responding to students with head injury and managing their recovery. To assess implementation of the law, the Massachusetts Department of Public Health (MDPH) has conducted focus groups and surveys with these stakeholders.MethodsFocus groups with ADs were conducted in March of 2018. Based on the results of these groups, a survey instrument was developed with participation from investigators at the Boston Medical Center Injury Prevention Center, brain injury researchers at the Boston University School of Medicine, ADs, and injury prevention experts at the MA Department of Public Health. In November 2018, the link to the electronic survey was sent to all AD members of the MA Interscholastic Athletic Association, the MA ADs professional organization. ResultsWhile the survey is currently in the field (November 2018), 125/377 responses have been received to date. Preliminary analyses indicate that: the mean rating on a 0-10 scale on importance of the law for student safety was 9.15 (with 10 being u201cvery importantu201d); the mean rating on a 0-10 scale of the lawu2019s impact on workload was 1.4 (with 0 being u201cnot at allu201d); 86% of respondents reported that their school had a concussion management team consisting of the ADs, ATs, SNs, and guidance counselors (GCs); 75% of ADs reported that they were informed u201calwaysu201d (26%) or u201doftenu201d (49%) when a student athlete experienced a mTBI in a venue other than extracurricular sports; 97% endorsed that u201callu201d or u201cmostu201d of SNs were u201dvery knowledgeableu201d about the law and regulations; 33% endorsed that u201callu201d or u201cmostu201d of teachers were u201dvery knowledgeableu201d about the law and regulations; 60% endorsed that u201callu201d or u201cmostu201d of GCs were u201dvery knowledgeableu201d about the law and regulations; 80% endorsed that u201callu201d or u201cmostu201d of the studentsu2019 physicians were u201dvery knowledgeableu201d about the law and regulations; and 62% endorsed that u201callu201d or u201cmostu201d of studentsu2019 parents were u201dvery knowledgeableu201d about the law and regulations; 67% endorsed that student athletes with concussion u201coftenu201d (6%) or u201csometimesu201d (61%) misrepresent their mTBI symptoms to accelerate return-to-play; and, 69% perceived that student athletes with concussion u201coftenu201d (13%) or u201csometimesu201d (56%) misrepresent their mTBI symptoms to avoid academics. ConclusionsADs perceive the sports concussion legislation as very important to student safety and positively assess implementation of the law and associated regulations. More effort is needed to increase understanding of the law among some stakeholders, including teachers, parents, and physicians.
