The oath requires the President to preserve, protect, and defend the Union by any means and then transmit it unimpaired to his successor. Pauley examines the potential political and legal ramifications of such an oath and its role as a source of presidential power. Beginning with a survey of the history of oaths from the classical world to the modern era, Pauley analyzes the President's oath within the context of American political and constitutional development. Those with scholarly interests in government, politics, or law will find this work enlightening.

Book excerpt: Growing up fundamentalist and female-and maturing into a feminist By the age of twelve, Susan Campbell had been flirting with Jesus for some time, and in her mind, Jesus had been flirting back. Why wouldn't he? She went to his house three times a week, sat in his living room, listened to his stories, loudly and lustily sang songs to him. So, one Sunday morning, she walked to the front of her fundamentalist Christian church to profess her love for Jesus and to be baptized. But from the moment her robe floated to the surface of the baptistery water, she began to question her fundamentalist Christian faith. If baptism requires complete immersion underwater, what does it mean, she wondered, if a piece of fabric attached to a would-be Christian floats to the top? Does the baptism still count? In this lovingly told tale, Susan Campbell takes us into the world of fundamentalism-a world where the details really, really matter. And she shows us what happened when she finally came to admit that in her faith, women would never be allowed a seat at the throne.

Depending on how a document is written, a notarization serves to affirm the identity of a signer and the fact that they personally executed their signature. A notarization, or notarial act, officially documents the identity of a party to a document or transaction and the occasion of the signing that others can rely upon, usually at face value. A notary's authentication is intended to be reliable, to avoid the inconvenience of having to locate a signer to have them personally verify their signature, as well as to document the execution of a document perhaps long after the lifetime of the signer and the notary. An oath is a sworn statement. In most cases a person will swear that a written statement, oral statement, or testimony they are about to give is true. A notary can document that the notary administered an oath to an individual.

It begins with a careful characterisation of atheism and agnosticism, distinguishing them from many other things with which they are often conflated. After a brief discussion of the theoretical framework within which atheism and agnosticism are properly evaluated, it then turns to the sketching of cases for atheism and agnosticism. In both cases, the aim is not conviction, but rather advancement of understanding: the point of the cases is to make it intelligible why some take themselves to have compelling reason to adopt atheism or agnosticism.

Book excerpt: "A cleareyed, accessible, and informative primer: vital reading for all Americans." —Kirkus Reviews, starred review Can the president launch a nuclear attack without congressional approval? Is it ever a crime to criticize the president? Can states legally resist a president’s executive order? In today’s fraught political climate, it often seems as if we must become constitutional law scholars just to understand the news from Washington, let alone make a responsible decision at the polls. The Oath and the Office is the book we need, right now and into the future, whether we are voting for or running to become president of the United States. Constitutional law scholar and political science professor Corey Brettschneider guides us through the Constitution and explains the powers—and limits—that it places on the presidency. From the document itself and from American history’s most famous court cases, we learn why certain powers were granted to the presidency, how the Bill of Rights limits those powers, and what “we the people” can do to influence the nation’s highest public office—including, if need be, removing the person in it. In these brief yet deeply researched chapters, we meet founding fathers such as James Madison and Alexander Hamilton, as well as key figures from historic cases such as Brown v. Board of Education and Korematsu v. United States. Brettschneider breathes new life into the articles and amendments that we once read about in high school civics class, but that have real impact on our lives today. The Oath and the Office offers a compact, comprehensive tour of the Constitution, and empowers all readers, voters, and future presidents with the knowledge and confidence to read and understand one of our nation’s most important founding documents.

Available in PDF, EPUB and Kindle. Book excerpt: For over twenty years the abortion debate has raged, with each side entrenched in unyielding positions. This book breaks the impasse by using pro-life premises to reach pro-choice conclusions. While it is commonly assumed that state protection of the fetus as a form of human life undermines women's reproductive rights, McDonagh instead illuminates how it is exactly such state protection of the fetus that strengthens, rather than weakens, not only women's right to an abortion, but even more significantly, women's ability to call on the state for abortion funding. McDonagh's approach, by bridging the divide between pro-life and pro-choice advocates, revolutionizes the abortion debate in a way that opens up a whole new avenue for resolving the abortion conflict and advancing women's rights. McDonagh reframes the abortion debate by locating the missing piece of the puzzle: the fetus as the cause of pregnancy. After exposing the myths on this subject, her exacting analysis presents the scientific and legal evidence that the ultimate source of pregnancy is the fetus. The central issue then becomes what the fetus, as an active agent, does to a woman's body during pregnancy, whether that pregnancy is wanted or not. McDonagh graphically describes the massive changes produced by the fetus when it takes over a woman's body. As such, pregnancy is best depicted not as a condition that women have a right to choose but rather as a condition to which they must have a right to consent. Abortion, therefore, does not rest on the intensely debated principle, stated in Roe, that women have a right to be free from state interference when choosing privately what to do with their own bodies. Instead, as McDonagh's book explains, abortion rights flow inevitably from women's more established right to consent to what another agent does to their body. Specifically, women have a right to resist an unwanted intrusion by a fetus as well as to receive help from the state to stop such an intrusion. Moving abortion rights from choice to consent has broad legal and cultural ramifications tapping into the very cornerstone of the American political system: consent. McDonagh unravels the consequences of extending to pregnant women the same guarantees of bodily integrity and liberty possessed by others in our society. Specifically, she shows why a woman who does not consent to be made pregnant by a fetus, not only has a right to terminate pregnancy, but why the state violates constitutional due process and equal protection guarantees when it fails to provide her with the same protections against nonconsensual intrusions by a fetus as it provides against nonconsensual intrusions by other parties. This book pivotally strengthens, therefore, not only women's right to abortion but also abortion funding. By providing new grounds both for the public funding of abortion and for the removal of government restrictions on abortions, it lays the foundation for enhancing women's rights through major policy changes in legislatures and courts.
