Book excerpt: The 2005 Texas Workers' Compensation Manual includes: The Law as written and or modified by the Legislature. The rules promulgated by the Commission for enforcement of the Law. Our editors? notes which explain the statute and rules in everyday language and organizes the statute and rules in a more logical manner. The manual is not in loose-leaf form, but rather a bound book so that you never need worry if updates are filed and in the correct place. Court case summaries, which identify and highlight significant Supreme Court decisions and Appellate Court decisions concerning workers? compensation law. Appeal Panel decisions which are the actual rulings on claims before the commission and which help guide your handling of similar cases. Appendix ? many helpful tables and charts, and a unique time saving subject index for cross referencing statutes and rules."...This Edition may well be one of our most important since the groundbreaking 1990 Edition. It likely will become essential and a useful tool for years in order to access the provisions and amendments to the law as we now understand it from 1990-2004, as it will take years to work through the current law. As you know, any case is governed by the law in effect at the date of the accident..."- from the Editor's Page, 2005 Texas Workers' Compensation Manual.

Available in PDF, EPUB and Kindle. Book excerpt: For human resource professionals, labor law specialists, and others involved in the practice of labor-management relations, Lencsis provides a concise, easily-accessed description of the workers compensation system in the United States, its governing laws and also its insurance aspects. Covering all major facets of workers compensation legislation and the insurance and risk management techniques used to comply with them, his book will have equal benefits for the staffs of insurance companies and brokerages, compensation and claims professionals, and for workers compensation executives in governmental agencies. Lencsis explains that workers compensation laws were enacted on the federal and state levels in the early part of the century and have endured in the same basic form to the present. They represent a radical departure from common law concepts of negligence and damages in that they provide for statutory medical and wage-loss benefits regardless of who is at fault. Lencsis explores how insurance mechanisms in the public and private sectors are used to fund benefits and to make their delivery as secure and certain as possible. He also notes that workers compensation insurance is a major part of the property-casualty insurance business, and as such has recently become one of its most profitable areas. Lencsis' book helps readers to understand these concepts and to work with them in the day-to-day conduct of their business.

Book excerpt: Written in layman's terms, not legalese or insurance-speak, this book is designed to help you understand how the Workers' Comp system works and to provide a basic understanding of injury prevention, types of injuries, and cost containment strategies. Although Workers' Comp regulations, procedures, and forms vary from state-to-state, the principles behind the system and the basics of compliance are almost identical. By focusing on these core principles, the author has prepared a guide to the topic which can be used by readers in any state in the nation.

Book excerpt: Workers' compensation insurance presents a set of institutional charac teristics that are unique. For every other form of insurance, both the insurer and the coverage provided under the policy are completely controlled either by the federal or a state government, or by an arrangement between the insured and a property-casualty insurer. Unemployment insurance, Social Security, and bank-deposit insurance are examples for which a legis lative body sets the benefits. and a government agency prescribes the in surance premium. By contrast, the coverage and premiums for automobile, homeowners, and fire insurance are individual contractual arrangements between a policyholder and one of the more than 1800 U. S. property casualty insurance companies. Workers' compensation insurance, however, is a hybrid in which state legislatures stipulate the terms of coverage, while regulated competition is the major determinant of prices. State legislatures enact statutes that prescribe the replacement rate and duration of indemnity benefits, as well as full reimbursement of medical expenses. And although the manual rates for workers' compensation insurance continue to be administered by a prior approval process in most states, the competitive-market price for coverage is achieved through a variety of price-modification plans (Appel and Borba, 1988).
