Book Synopsis The Theory and Practice of Command and Control in Environmental Policy by : Peter Berck
Download or read book The Theory and Practice of Command and Control in Environmental Policy written by Peter Berck and published by Routledge. This book was released on 2018-01-12 with total page 419 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2003. Economists have had increasing success in arguing the merits of market-based approaches to environmental problems. By making polluting expensive, market-based approaches provide polluters with incentives to clean up, rather than mandates to stop polluting. These approaches include pollution taxes, transferable emissions permits and subsidies for pollution abatement. The purpose of this volume is to explore the situations where Command and Control (CAC) may not be all bad, and in fact might even have some advantages over market-based instruments (MBI).

This book was released on 1999-05-17 with total page 229 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book reviews the performance and effectiveness of the Community Development Quotas (CDQ) programs that were formed as a result of the Sustainable Fisheries Act of 1996. The CDQ program is a method of allocating access to fisheries to eligible communities with the intent of promoting local social and economic conditions through participation in fishing-related activities. The book looks at those Alaskan fisheries that have experience with CDQs, such as halibut, pollock, sablefish, and crab, and comments on the extent to which the programs have met their objectives--helping communities develop ongoing commercial fishing and processing activities, creating employment opportunities, and providing capital for investment in fishing, processing, and support projects such as infrastructure. It also considers how CDQ-type programs might apply in the Western Pacific.

Book Synopsis Anti-Discrimination Law in Civil Law Jurisdictions by : Barbara Havelková
Download or read book Anti-Discrimination Law in Civil Law Jurisdictions written by Barbara Havelková and published by Oxford University Press. This book was released on 2019-12-12 with total page 414 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays explores the evolution of anti-discrimination law in European civil law jurisdictions. Historically, scholarship in this area has focused on the common law, which has also taken the lead in developing the theory and practice of anti-discrimination law. This volume breaks new ground by offering a sustained, critical, legal and socio-legal, comparative look at how anti-discrimination is faring in European civil law environments. While it is true that anti-discrimination law is seen as a foreign transplant in some regions, it does not fare poorly across the board. As shown by the case studies herein, the success of anti-discrimination law is found to vary according to its national context, the actors involved, and the evolution of the particular concept or ground of discrimination in question.
Book Synopsis Environmental Policy for Business by : Martin Perry
Download or read book Environmental Policy for Business written by Martin Perry and published by Business Expert Press. This book was released on 2015-06-30 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the context of the worldwide concern with the sustainability of current forms of development, business managers are being required to engage with environmental policy more creatively than in the past. At the broadest level, business managers are being advised to embrace regulation as a source of competitive advantage rather than viewing it simply as a compliance cost and administrative burden. Irrespective of whether managers accept that “going beyond compliance” is a stimulus for innovation, business managers frequently face a policy environment in which choices need to be made over how policy agendas should be responded to. Contemporary policy approaches may mandate demonstration of best practice, without de ning what constitutes best practice or use policy approaches that give the option of “paying for pollution” or investing in clean technology. Frequently, the argument is made that there are reputational gains to being a first mover and putting the organization ahead of regulation, but the implication can be considerable upfront investment for uncertain returns. Against this context, this book provides a guide to the new world of environmental regulation for managers within business and students with a particular interest in understanding how environmental regulation works.

Download or read book Eurolegalism written by R. Daniel Kelemen and published by Harvard University Press. This book was released on 2011-04-01 with total page 379 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite western Europe's traditional disdain for the United States' "adversarial legalism," the European Union is shifting toward a very similar approach to the law, according to Daniel Kelemen. Coining the term "eurolegalism" to describe the hybrid that is now developing in Europe, he shows how the political and organizational realities of the EU make this shift inevitable. The model of regulatory law that had long predominated in western Europe was more informal and cooperative than its American counterpart. It relied less on lawyers, courts, and private enforcement, and more on opaque networks of bureaucrats and other interests that developed and implemented regulatory policies in concert. European regulators chose flexible, informal means of achieving their objectives, and counted on the courts to challenge their decisions only rarely. Regulation through litigation-central to the U.S. model-was largely absent in Europe. But that changed with the advent of the European Union. Kelemen argues that the EU's fragmented institutional structure and the priority it has put on market integration have generated political incentives and functional pressures that have moved EU policymakers to enact detailed, transparent, judicially enforceable rules-often framed as "rights"-and back them with public enforcement litigation as well as enhanced opportunities for private litigation by individuals, interest groups, and firms.
