Under contemporary international humanitarian law, this right is essentially restricted to sovereign states. It has been conventionally assumed that this arrangement derives from the ideas of the late-sixteenth century jurist Alberico Gentili. Claire Vergerio argues that this story is a myth, invented in the late 1800s by a group of prominent international lawyers who crafted what would become the contemporary laws of war. These lawyers reinterpreted Gentili's writings on war after centuries of marginal interest, and this revival was deeply intertwined with a project of making the modern sovereign state the sole subject of international law. By uncovering the genesis and diffusion of this narrative, Vergerio calls for a profound reassessment of when and with what consequences war became the exclusive prerogative of sovereign states.

Using this framework, the book presents a holistic assessment of the trajectory of the international order over the last decades, the rise, decline, and demise of the LIO 2.0, and causes of the dangerous erosion of international order over the last decade.

The contributions to this book argue that the justification of war rarely happens as empty propaganda. While it is directed at mobilizing support and reducing resistance, it is not purely instrumental. Rather, the justification of force is part of an incessant struggle over what is to count as justifiable behaviour in a given historical constellation of power, interests, and norms. This way, the justification of specific wars interacts with international order as a normative frame of reference for dealing with conflict. The justification of war shapes this order, and is being shaped by it. As the justification of specific wars entails a critique of war in general, the use of force in international relations has always been accompanied by political and scholarly discourses on its appropriateness. In much of the pertinent literature the dominating focus is on theoretical or conceptual debates as a mirror of how international normative orders evolve. In contrast, the focus of the present volume is on theory and political practice as sources for the re- and de-construction of the way in which the justification of war and international order interact. With contributions from international law, history, and international relations, and from Western and non-Western perspectives, this book offers a unique collection of papers exploring the continuities and changes in war discourses as they respond to and shape normative orders from early modern times to the present.

Strategic doctrines, arms control agreements, and the foundation of international organizations such as the United Nations are designed to prevent wars between states. Since 1945, however, the incidence of interstate war has actually been declining rapidly, while the incidence of internal wars has been increasing. The author argues that in order to understand this significant change in historical patterns, we should jettison many of the analytical devices derived from international relations studies and shift attention to the problems of 'weak' states, those states unable to sustain domestic legitimacy and peace. This book surveys some of the foundations of state legitimacy and demonstrates why many weak states will be the locales of war in the future. Finally, the author asks what the United Nations can do about the problems of weak and failed states.

Why was it that the foundation and institutionalisation of secured peace and the rule of law seemed to go hand-in-hand with the proliferation of war and the violation of individual and collective rights? In order to try to better understand such profound questions, this volume explores the history and theories of political thought of international relations in the seventeenth century, a period in which many of the defining features and boundaries of modern Europe where fixed and codified. With the discovery of the New World, and the fundamental impact of the Reformation, the complexity of international relations increased considerably. Reactions to these upheavals resulted in a range of responses intended to address the contradictions and conflicts of the anarchical society of states. Alongside the emergence of "modern" international law, the equation of international relations with the state of nature, and the development of the "balance of power", diplomatic procedures and commercial customs arose which shaped the emerging (and current) international system of states. Employing a multidisciplinary approach to address these issues, this volume brings together political scientists, philosophers, historians of political thought, jurists and scholars of international relations. What emerges is a certain tension between the different strands of research which allows for a fruitful new synthesis. These disruptions range from strikes and street protests to riots and civil disobedience to revolution. In War, States, and Contention, Tarrow shows how such movements sometimes trigger, animate, and guide the course of war and how they sometimes rise during war and in war's wake to change regimes or even overthrow states. Tarrow draws on evidence from historical and contemporary cases, including revolutionary France, the United States from the Civil War to the anti–Vietnam War movement, Italy after World War I, and the United States during the decade following 9/11.In the twenty-first century, movements are becoming transnational, and globalization and internationalization are moving war beyond conflict between states. The radically new phenomenon is not that movements make war against states but that states make war against movements. Tarrow finds this an especially troublesome development in recent U.S. history. He argues that that the United States is in danger of abandoning the devotion to rights it had expanded through two centuries of struggle and that Americans are now institutionalizing as a "new normal" the abuse of rights in the name of national security. He expands this hypothesis to the global level through what he calls "the international state of emergency."

The Transformation of the International Order of Asia offers closely interwoven perspectives on international economic and political relations from the 1950s to the 1960s, with specific focus on the Colombo Plan and related aid policies of the time. The success of the laws of war depends on three related factors: compliance between warring states and between soldiers on the battlefield, and control of soldiers by their militaries. A statistical study of compliance of the laws of war during the twentieth century shows that joint ratification strengthens both compliance and reciprocity, compliance varies across issues with the scope for individual violations, and violations occur early in war. Close study of the treatment of prisoners of war during World Wars I and II demonstrates the difficulties posed by states' varied willingness to limit violence, a lack of clarity about what restraint means, and the practical problems of restraint on the battlefield.

Within this framework, Gender, War, and World Order compares gender difference on military power, balance of power, alliances, international institutions, the acceptability of war, defense spending, defense/welfare compromises, and torture. Eichenberg concludes that the centrality of military force, violence, and war is the single most important variable affecting gender difference; that the magnitude of gender difference on security issues correlates with the economic development and level of gender equality in a society; and that the country with the most consistent gender polarization across the widest range of issues is the United States.
