It resists the conventional approach to art and law as inherently dissonant – one a discipline preoccupied with rationality, certainty and objectivity; the other a creative enterprise ensconced in the imaginary and inviting multiple, unique and subjective interpretations. Book Synopsis Artists' Rights by : Molly Torsen Stech
Download or read book Artists' Rights written by Molly Torsen Stech and published by Institute of Art and Law. This book was released on 2015 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an overview of various ways in which the spheres of art and copyright law come into contact with one another. While copyright laws are domestic in nature, the arts are increasingly international in scope, inspiration, and dissemination. The book highlights some of the challenges inherent in this overlap, ranging from definitional discrepancies between disciplines to circumstances that would benefit from more legal clarity - domestic or otherwise - to provide appropriate guidance to creators and to the organizations that display, sell, or otherwise use their artworks. The book confronts the challenges that are raised today, not only by digitization, but by new media of expression. As international art fairs proliferate, and as artists of all disciplines inspire and build from each other's works and ideas, the role of copyright in an artist's life can only become more important. Artists' Rights introduces artists to legal concepts in the intellectual property space that could become important tools in managing their artworks, now and into the future. Book Synopsis International Perspectives on Disability Exceptions in Copyright Law and the Visual Arts by : Jani McCutcheon
Download or read book International Perspectives on Disability Exceptions in Copyright Law and the Visual Arts written by Jani McCutcheon and published by Routledge. This book was released on 2020-09-27 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an overview of disability exceptions to copyright infringement and the international and human rights legal framework for disability rights and exceptions. The focus is on those exceptions as they apply to visual art, while the book presents a comprehensive study of copyright’s disability exceptions per se and the international and human rights law framework in which they are situated. 3D printing now allows people with a visual impairment to experience 3D reproductions of paintings, drawings and photographs through touch. At the same time, the uncertain application of existing disability exceptions to these reproductions may generate concerns about legal risk, hampering sensory art projects and reducing inclusivity and equity in cultural engagement by people with a visual impairment. The work adopts an interdisciplinary approach, with contributions from diverse stakeholders, including persons with disabilities, cultural institutions and the 3D printing industry. The book sketches the scene relating to sensory art projects. Experts in intellectual property, human rights, disability and art law then critically analyse the current legal landscape relating to disability access to works of visual art at both international and regional levels, as well as across a broad representative sample of national jurisdictions, and identify where legal reform is required. This comparative analysis of the laws aims to better inform stakeholders of the applicable legal landscape, the legal risks and opportunities associated with sensory art and the opportunities for reform and best practice guidelines, with the overarching goal of facilitating international harmonisation of the law and enhanced inclusivity.

Download or read book Law for Artists written by Blu Tirohl and published by Routledge. This book was released on 2014-11-27 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Written especially for professional artists and those studying the visual arts, Law for Artists is an accessible guide to those aspects of law that impact on artists and their work. It encompasses a comprehensive range of creative practices including fine art, photography, the graphic and plastic arts, animation, illustration, applied and media arts, as well as fashion, textile and product design. As one of the few academics working in this field Blu Tirohl clearly explains the legal principles - such as intellectual property, censorship, freedom of expression and criminal law - that are relevant to artists working in a range of disciplines. In order to illustrate these key concepts the book includes an engaging collection of examples of artists who have come into conflict with the law, demonstrating precisely the challenges faced by creative practitioners. The author also explores how the establishment co-opts transgressive artists; bringing about a range of contradictions that create legal inconsistencies. While the focus is primarily on UK law, the reader is also given ample information to understand how European law affects them. An entire chapter is also dedicated to the comparative study of US Law through well-known cases, ensuring students have a well-rounded knowledge of the concepts that they need to consider in a professional context. The book also provides additional resources including a list of useful websites, a glossary of key terms, as well as a list of statutes and cases. Law for Artists is an invaluable resource to professional practitioners and art graduates, as well as the academics who instruct them. This insightful publication, the first of its kind, helps introduce artists to the professional practice skills needed to ensure they are well-equipped to deal with working life.
Download or read book Models of Integrity written by Joan Kee and published by University of California Press. This book was released on 2019-02-12 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Models of Integrity examines the relationship between contemporary art and the law through the lens of integrity. In the 1960s, artists began to engage conspicuously with legal ideas, rituals, and documents. The law—a primary institution subject to intense moral and political scrutiny—was a widely recognized source of authority to audiences inside the art world and out. Artists frequently engaged with the law in ways that signaled a recuperation of the integrity that they believed had been compromised by the very institutions entrusted with establishing standards of just conduct. These artists sought to convey the social purpose of an artwork without overstating its political impact and without losing sight of how aesthetic decisions compel audiences to see their everyday world differently. Addressing the role that law plays in enabling artworks to function as social and political forces, this important book fills a gap in the field of law and the humanities, and will serve as a practical “how-to” for contemporary artists.
