Book excerpt: This paperback volume (subtitled "Constitutional Rights: Civil Rights and Civil Liberties") includes chapters 10 through 19 of Fisher/Harriger, American Constitutional Law, Ninth Edition (hardback). Now in its ninth edition, American Constitutional Law is the only book that develops constitutional law in the comprehensive sense. Along with containing analyses and excerpts of court decisions, the book highlights the efforts of legislatures, executives, the states, and the general public to participate in an ongoing political dialogue rather than passively receive a series of unilateral judicial commands. It covers all new developments in case law, congressional statutes, presidential policies, and initiatives undertaken by states under their own constitutions. The book includes readings not only from cases but congressional floor debates, committee reports, committee hearings, presidential vetoes and other statements, state actions, Federalist papers, and professional journals. It also includes a chapter on equal protection that addresses immigration law and the rights of aliens.

Book excerpt: Dworkin's important book is a collection of essays which discuss almost all of the great constitutional issues of the last two decades, including abortion, euthanasia, capital punishment, homosexuality, pornography, and free speech. Dworkin offers a consistently liberal view of the Constitution and argues that fidelity to it and to law demands that judges make moral judgments. He proposes that we all interpret the abstract language of the Constitution by reference to moral principles about political decency and justice. His 'moral reading' therefore brings political morality into the heart of constitutional law. The various chapters of this book were first published separately; now drawn together they provide the reader with a rich, full-length treatment of Dworkin's general theory of law.

Available in PDF, EPUB and Kindle. Book excerpt: The fundamental fact about our Constitution is that it is old -- the oldest written constitution in the world. The fundamental challenge for interpreters of the Constitution is how to read that old document over time. In Fidelity & Constraint, legal scholar Lawrence Lessig explains that one of the most basic approaches to interpreting the constitution is the process of translation. Indeed, some of the most significant shifts in constitutional doctrine are products of the evolution of the translation process over time. In every new era, judges understand their translations as instances of "interpretive fidelity," framed within each new temporal context. Yet, as Lessig also argues, there is a repeatedly occurring countermove that upends the process of translation. Throughout American history, there has been a second fidelity in addition to interpretive fidelity: what Lessig calls "fidelity to role." In each of the cycles of translation that he describes, the role of the judge -- the ultimate translator -- has evolved too. Old ways of interpreting the text now become illegitimate because they do not match up with the judge's perceived role. And when that conflict occurs, the practice of judges within our tradition has been to follow the guidance of a fidelity to role. Ultimately, Lessig not only shows us how important the concept of translation is to constitutional interpretation, but also exposes the institutional limits on this practice. The first work of both constitutional and foundational theory by one of America's leading legal minds, Fidelity & Constraint maps strategies that both help judges understand the fundamental conflict at the heart of interpretation whenever it arises and work around the limits it inevitably creates.

Book excerpt: Excerpt from Views of American Constitutional Law: In Its Bearing Upon American Slavery The main views I have presented will assuredly be condemned, - and in that condemnation I read the sure presage of their prevalence. - They will be condemned, in this selfish and bewildered world, because they are true, and they will ultimately triumph, for the same reason. The popular suffrage may determine whether they shall be received in time to prevent the wreck of the present Federal Government: - but it can no more decide against their final reception than it can decide against the final reception of any other truths of science, physical or moral. There is immortality in Truth. But all lies are doomed. Up to the month of May, 1772, it was as currently believed in England, that the slaves held and sold there, were thus held and sold, legally, and in accordance with the British Constitution, as it is now believed that the slaves held and sold in the United States of America, are thus held and sold, legally, and in accordance with the American Constitution. But the decision of Lord Chief Justice Mansfield, in the case of James Somerset, at the date above mentioned, revolutionized the jurisprudence of the realm, overthrew ancient precedents, reversed venerated decisions - and inscribed beneath the cross of St. George, on the royal flag - "slaves can not breathe in England And what was the secret of that mighty revolution? - It was this. Available in PDF, EPUB and Kindle. Book excerpt: American Constitutional Law 11e, Volume I provides a comprehensive account of the nation's defining document, examining how its provisions were originally understood by those who drafted and ratified it, and how they have since been interpreted by the Supreme Court, Congress, the President, lower federal courts, and state judiciaries. Clear and accessible chapter introductions and a careful balance between classic and recent cases provide students with a sense of how the law has been understood and construed over the years. The 11th Edition has been fully revised to include several new cases, including Trump v. Hawaii (2018), in which Chief Justice Roberts held that Korematsu v. United States "has been overruled in the court of history"; Murphy v. National Collegiate Athletic Association (2018), in which Justice Alito’s majority opinion provides the most compelling argument to date against federal commandeering of state officials; and Sveen v. Melin (2018), a Contract Clause case that shows the Court’s continuing refusal to give a textualist reading of that provision, even in the face of Justice Gorsuch’s compelling and amusing dissent. A revamped and expanded companion website offers access to even more additional cases, an archive of primary documents, and links to online resources, making this text essential for any constitutional law course.

Available in PDF, EPUB and Kindle. Book excerpt: Constitutional politics is the continuing search for equilibrium between the grants of power and the limits placed on that power. The Essentials of the American Constitution examines the five closely integrated components which make up the fundamental law: the Compact, separation of powers, federalism, representation, and the Bill of Rights. It is the interaction between these components that gives the Constitution its dynamism. Landmark decisions handed down by the U.S. Supreme Court involve two or more of these components. This book’s unique approach shows how the components more often than not work together, one assisting another, one explaining another, or one reinforcing another. It gives a firm foundation for students wishing to take advanced courses in constitutional law or civil liberties and provides an overall view of the fundamental principle of the American Constitution.
