In Deutschland wurde dafür das Handelsgesetzbuch (HGB) eingeführt, welches Gültigkeit für alle Kaufleute besitzt. Kaufmann ist im Sinne des § 1 Abs. (Absatz) 1 HGB derjenige, der ein Handelsgewerbe betreibt. Ein Handelsgewerbe ist gemäß § 1 Abs. 2 HGB jeder Gewerbebetrieb, der nach Art oder Umfang einen in kaufmännischer Weise eingerichteten Geschäftsbetrieb erfordert.2 Die bestehenden nationalen Gesetze basieren auf dem Vorsichtsprinzip und dem Gläubigerschutz. Der Kaufmann soll sich nach dem HGB lieber ärmer als reicher rechnen, das dient der Vermeidung von ungerechtfertigter Gewinnausschüttung. In den letzten Jahren stand der deutsche Jahresabschluss zunehmend in der Kritik. Hauptproblem des Jahresabschlusses nach dem HGB besteht darin, dass für die Unternehmen die Möglichkeit besteht, stille Reserven zu bilden, welche in schlechten Zeiten aufgelöst werden können. Dadurch entsteht eine nicht der Wirklichkeit entsprechende Darstellung. Aber auch die zunehmende Globalisierung hat die Entwicklung von neuen, über die deutschen Staatsgrenzen hinaus geltenden, Regelungen gefordert. Um dem entgegenzuwirken wurden Vorschriften im Rahmen des internationalen Rechnungswesens festgelegt. Anfangs waren diese unter der Bezeichnung International Accounting Standards bekannt, heute sind das die weiter entwickelten International Financial Reporting Standards (IFRS). Das Hauptziel der IFRS ist die Wiedergabe der tatsächlichen Vermögens-, Finanz- und Ertragslage eines Unternehmens und die Erfüllung einer Informationsfunktion für die Abschlussadressaten.3 In meiner Praxisarbeit werde ich mich vorrangig mit den Grundprinzipien des HGB’s und der IFRS auseinandersetzen. Des Weiteren werde ich auf die verschiedenartigen Bilanzansätze für langfristige Fertigungsaufträge eingehen, weil in der Bauwirtschaft die Abwicklung von komplexen Bauvorhaben meist einen Zeitraum über einen oder mehrere Bilanzstichtage beansprucht.

In dieser Hausarbeit möchte ich die unterschiedlichen Möglichkeiten untersuchen, die zu einer Aufstellungspflicht eines Konzernabschlusses nach HGB und IFRS führen. In Kapitel zwei werden zuerst der Begriff und die wesentlichen Bedeutungen des Konzerns herausgearbeitet. In dem nachfolgenden Kapitel drei widme ich meine Aufmerksamkeit dem Zweck und den Grundlagen des Konzernabschlusses. In den Kapiteln vier und fünf wird einerseits ein detaillierter Vergleich zwischen den Rechnungslegungsvorschriften nach HGB und IFRS zur Aufstellungspflicht eines Konzernabschlusses dargestellt und andererseits werden auch einige Befreiungsmöglichten aufgezeigt. Der letzte Abschnitt dieser Arbeit enthält eine zusammenfassende Schlussbetrachtung.

Nach IFRS erstellte Jahresabschlüsse unterscheiden sich jedoch hinsichtlich ihrer Aussage erheblich von jenen, welche nach Vorschriften des HGB erstellt wurden, da beide Regelwerke infolge unterschiedlicher Prämissen divergierende Ziele verfolgen.

Es werden einige Abschnitte des Standards vertiefend behandelt. Abschließend wird der im Jahr 2009/2010 stattgefundenen Konsultation zum IFRS für KMUs verstärkte Aufmerksamkeit geschenkt. Die methodische Vorgehensweise beruht vor allem auf einer intensiven Literaturrecherche zu vorliegendem Thema. Es wurden Fachbücher sowie aktuelle Internetquellen zur Gestaltung der Diplomarbeit herangezogen. Die Reaktionen auf den IFRS für KMUs von den Mitgliedstaaten der EU können als positiv angesehen werden, obwohl ein weiterer Überarbeitungsbedarf festgestellt wird. Österreich hingegen sieht den neuen Standard sehr kritisch. Die überwiegende Mehrheit der österreichischen Antworten auf die Konsultation fielen negativ aus. Die Regelungen des IFRS für KMUs werden für die Anwendung in Österreich als nicht praktikabel angesehen, ein weiterer Überarbeitungsbedarf wird dringend angeraten.*****This study is about the International Financial Reporting Standard for small and medium-sized entities. At the beginning the focus is on the development of the IFRS for SMEs, in detail on the initiation of the IASC for the progression of the Standard and ensuing on its development. After that the study goes into detail about the application area, the basic principles, the valuation and the components of a financial statement according to IFRS for SMEs. Some sections of the Standard will be shown in-depth. Concluding the study is about the consultation on the IFRS for SMEs, which took place in 2009/2010. The findings result basically from primary data like books and up-to-date internet sources. There have been positive reactions from the member states of the EU on the Standard. However they locate the need to further adapt the IFRS für SMEs to the needs of small and medium-sized entities. In contrast to that, Austrias opinion on the standard is rather critical. Most of the answers on the consultation were negative. The regulations do not seem to be feasible in Austria, moreover the companies give advice on how to extensively work the Standard over.

Book excerpt: Ancient Greece first coined the concept of "democracy", yet almost every major ancient Greek thinker-from Plato and Aristotle onwards- was ambivalent towards or even hostile to democracy in any form. The explanation for this is quite simple: the elite perceived majority power as tantamount to a dictatorship of the proletariat. In ancient Greece there can be traced not only the rudiments of modern democratic society but the entire Western tradition of anti-democratic thought. In Democracy, Paul Cartledge provides a detailed history of this ancient political system. In addition, by drawing out the salient differences between ancient and modern forms of democracy he enables a richer understanding of both. Cartledge contends that there is no one "ancient Greek democracy" as pure and simple as is often believed. Democracy surveys the emergence and development of Greek politics, the invention of political theory, and-intimately connected to the latter- the birth of democracy, first at Athens in c. 500 BCE and then at its greatest flourishing in the Greek world 150 years later.
