Mit entsprechend neuer Qualitat und zunehmender Dringlichkeit stellt sich daher auch die Frage nach den Bedingungen und Moglichkeiten trans- und supranationaler demokratischer Legitimation (ebd.). In der Literatur ist die Meinungsvielfalt uber die Legitimation der EU gross, doch gibt es kaum noch Stimmen, die ein Demokratiedefizit in der EU ganzlich abstreiten (Dingwerth et al. 2011: 73). Ein schwaches Parlament, eine ubermachtige und nicht demokratisch gewahlte Kommission, das Fehlen europaweiter Parteien und einer gemeinsamen Willensbildung - sind die oft aufgefuhrten Kernpunkte, des Legitimitatsdefizit in der Europaischen Union (Frisch 2007: 711). Dabei wird die These vom Legitimitatsdefizit, oft auf aus dem Nationalstaat ubernommene Legitimationsmechanismen wie Parlamentarisierung, Kontrolle durch Wahlen oder eine gemeinsame Identitat gestutzt (ebd.). Massgeblich fur das Ausmass des Demokratiedefizits ist, ob die EU an bekannten nationalstaatlichen gepragten Kategorien gemessen wird, oder sie als vollig neue Form des politischen Gemeinwesens begriffen wird und daher eine Ubertragung ausschliesslich nationalstaatlicher Massstabe abgelehnt wird (Thalmaier 2005: 58f). Fur eine Konzeptionalisierung von Demokratie jenseits des Nationalstaates sind nach Huget (2007: 71) aber, klassische Legitimationsmechanismen nicht anwendbar. Neben den klassischen Wegen der Legitimation wie parlamentarisch und direktdemokratisch ist deshalb zusatzlich ein dritter Weg demokratischer Legitimation europaischer Politik im Gesprach (ebd.)

Vor allem im Hinblick auf die gegenwärtige Corona-Krise wird europäischer Zusammenhalt umso mehr gefragt, sodass Legitimation bei EU-Bürgern entscheidend ist. Bürger müssen sich mit der EU identifizieren können. Dazu sollen Möglichkeiten für die Beteiligung in einer mit der EU verbundenen Öffentlichkeit geschaffen werden. Allgemein gilt die EU unter einem großen Teil der Bevölkerung als Elitenprojekt. Die Effizienz europäischer Entscheidungen hängt jedoch in bedeutendem Maße von der Zustimmung ihrer Bürger in den Mitgliedsstaaten ab.
