Book excerpt: La presunción de inocencia se trata de un principio, elevado a la categoría de derecho fundamental por el artículo 24.2 de la Constitución Española, que asiste al acusado durante todo el proceso penal hasta que se dicte sentencia firme. Durante el proceso se aprecian las distintas manifestaciones de tal presunción, sobre todo en la forma en la que debe ser tratado el imputado durante todo el proceso y en lo que respecta a la actividad probatoria, a quien corresponde la carga de la prueba y como debe desarrollarse dicha actividad. La presunción de inocencia actúa como límite en la distribución de la carga de la prueba y tiene una gran relevancia en relación con la imparcialidad judicial y el principio acusatorio que inspira nuestro proceso penal. Se realiza una distinción de la misma con el principio in dubio pro reo, principios que, a menudo, se confunden y vemos como esta presunción está en relación con todo lo relativo a la prueba, incluidos los casos de insuficiencia probatoria y las soluciones existentes y las reglas jurisprudenciales para la valoración de la prueba entre las que destaca la prueba indiciaria.
