Book Synopsis Interpreting the Free Exercise of Religion by : Bette Novit Evans
Download or read book Interpreting the Free Exercise of Religion written by Bette Novit Evans and published by Univ of North Carolina Press. This book was released on 2000-11-09 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: A generation ago, all of the big questions concerning religious freedom in America seemed to have been resolved. At the very least, the lines of division between proponents of a wall of separation between church and state and advocates of religious accommodation seemed clearly drawn. Since then, increasing religious diversity and changing functions of government have raised new questions about what it means to allow the free exercise of religion. In this book, Bette Novit Evans explores the contemporary understandings of this First Amendment guarantee in all of its complexity and ambiguity. Evans situates constitutional arguments about free exercise within the context of theological and sociological insights about American religious experience. She surveys and evaluates several of the most well considered approaches to religious freedom and applies them to contemporary legal controversies, examining problems in defining religion and claims concerning the autonomy of religious institutions. Her conclusions about religious liberty are embedded in an appreciation of American pluralism: the guarantee of religious freedom, she argues, can be understood as an instrument for fostering alternative sources of meaning within a pluralistic political community.

Download or read book Diversity and Equality written by Avigail Eisenberg and published by UBC Press. This book was released on 2011-11-01 with total page 225 pages. Available in PDF, EPUB and Kindle. Book excerpt: The tension between diversity and equality is central to debates about multiculturalism, self-determination, identity, and pluralism. How, for example, can the claims of ethnic and religious groups be respected when they conflict with individual rights and liberal equality? Diversity and Equality critically examines the challenge of protecting rights in diverse societies such as Canada. It develops new approaches in philosophy, law, politics, and anthropology to address the goals and problems associated with cultural, religious, and national minority rights. The contributors to this volume explore the conflicts between group demands for cultural autonomy and individual assertions of basic interests. At stake in these debates about rights and autonomy in multicultural and multinational democracies is the very meaning of freedom.

Book Synopsis The Lustre of Our Country by : John T. Noonan Jr.
Download or read book The Lustre of Our Country written by John T. Noonan Jr. and published by Univ of California Press. This book was released on 1998-06-26 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: A New York Times Notable Book This remarkable work offers a fresh approach to a freedom that is often taken for granted in the United States, yet is one of the strongest and proudest elements of American culture: religious freedom. In this compellingly written, distinctively personal book, Judge John T. Noonan asserts that freedom of religion, as James Madison conceived it, is an American invention previously unknown to any nation on earth. The Lustre of Our Country demonstrates how the idea of religious liberty is central to the American experience and to American influence around the world. Noonan's original book is a history of the idea of religious liberty and its relationship with the law. He begins with an intellectual autobiography, describing his own religious and legal training. After setting the stage with autobiography, Noonan turns to history, with each chapter written in a new voice. One chapter takes the form of a catechism (questions and answers), presenting the history of the idea of religious freedom in Christianity and the American colonies. Another chapter on James Madison argues that Madison's support of religious freedom was not purely secular but rather the outcome of his own religious beliefs. A fictional sister of Alexis de Toqueville writes, contrary to her brother's work, that the U.S. government is very closely tied to religion. Other chapters offer straightforward considerations of constitutional law. Throughout the book, Noonan shows how the free exercise of religion led to profound changes in American law—he discusses abolition, temperance, and civil rights—and how the legal notion of religious liberty influenced revolutionary France, Japan, and Russia, as well as the Catholic Church during Vatican II. The Lustre of Our Country is a celebration of religious freedom—a personal and profound statement on what the author considers America's greatest moral contribution to the world.
