L 911-4 du Code de l'éducation issu de l'ordonnaoce n° 2000-549 du 15 juin 2000. La victime qui doit diriger son action exclusivement contre l'Etat devra prouver la faute de l'instituteur (défaut de surveillance) auprès des tribunaux de l'ordre judiciaire pour espérer obtenir réparation. La responsabilité de l'Etat se substituant à celle de l'instituteur publique et privé qu'il s'agisse d'une faute personnelle ou de service de l'instituteur. Au Koweït la victime a le choix d'assigner à la fois l'Etat et l'instituteur (dont la faute est présumée) même s'il est public. Dans les deux pays, l'Etat peut dans certains cas exercer un recours contre son instituteur. Cette action se prescrit par trois ans à compter de la réalisation du dommage selon le droit français et à compter de la connaissance par la victime du dommage selon le droit koweïtien.

Its subject, reflected in the title "Sciences and Empires", is not a currently-accepted sub-discipline of the history of science; rather, it refers to a set of questions which found autonomy only recently.
