Simply defined, it means deliberately taking the law into one's own hands. The history of the United States is filled with many examples of "establishment violence." This form of violence was evident when ranchers lynched the cattle rustler and when the early Ku Klux Klan terrorized African Americans back into their "proper position." It is also apparent when urban community groups execute drug pushers and when political parties resort to breaking and entering, electronic surveillance, sabotage, and seduction. Establishment violence is a global phenomenon and not restricted to the United States. In Brazil the Esquadāro da Morte (Death Squad) executes individuals suspected of being habitual criminals. The Protestant B Specials in Northern Ireland abused Catholics. Strong anti-Chinese feelings spawned vigilante groups in Southeast Asia. Other vigilante bands have included the Society of Muslim Brothers in Egypt, the White Hand of Guatemala, the Jewish Defense League, and the Nazi Brown Shirts. Every society that is holding together contains groups that value their place in the system (even if it is modest) and prefer things as they are. If they believe that criminals are escaping punishment because of corruption or leniency, or that people who seek a change in social status and approved values a regaining power, or that the legitimate authorities are unable or unwilling to preserve the present order, they frequently take violent action to defend their position. These are the vigilantes, and this book considers their brand of "establishment violence" in the widest sense. This is puzzling given the country's celebrated transition to democracy and massive reform of the state's legal institutions. Where most studies explain vigilantism as a response to state or civic failure, in Contradictions of Democracy, Nicholas Rush Smith illustrates that vigilantism is actually a response to the processes of democratic state formation. In the context of densely networked neighborhoods, vigilante citizens often interpret the technical success of legal institutions-for instance, the arrest and subsequent release of suspects on bail-as failure and work to correct such perceived failures on their own. Smith also shows that vigilantism provides a new lens through which to understand democratic state formation. Among young men of color in some parts of South Africa, fear of extra-judicial police violence is common. Amid such fear, instead of the state seeming protective, it can appear as something akin to a massive vigilante organization. Under what conditions does lynching – lethal, extralegal group violence to punish offenses to the community – become an acceptable practice? We argue lynching emerges when neither the state nor its challengers have a monopoly over legitimate authority. When authority is contested or ambiguous, mass punishment for transgressions can emerge that is public, brutal, and requires broad participation. Using new cross-national data, we demonstrate lynching is a persistent problem in dozens of countries over the last four decades. Drawing on original survey and interview data from Haiti and South Africa, we show how lynching emerges and becomes accepted. Specifically, support for lynching most likely occurs in one of three conditions: when states fail to provide governance, when non-state actors provide social services, or when neighbors must rely on self-help.

Book excerpt: This paper examines (1) the particular characteristics of the actions that vigilantes take and (2) shifting public definitions of the term vigilante and what those definitions reveal about public anxieties. The project identifies and compares cultural frameworks for understanding the meanings of "vigilante" as they have evolved between the years of 1996 and 2007 in news print media. The findings challenge the notion that the use or threatened use of force may only be physical violence. The increase in reported incidents of vigilantism that have performative aspects to them suggests that "force" is not merely physical, but spectacle becomes a significant form of force when combined with technology platforms. This expanded definition of force allows instances of behavior involving evolving technologies to be classified as vigilantism that would otherwise be excluded. I draw from legal consciousness and discourse analysis literature to explore conflicting narratives of justice, particularly in regards to the relationship between local and global discourses of justice. The findings suggest that performative acts of vigilantism bring attention to local issues and concerns that some individuals are concerned have been pushed aside in the shift to an emphasis on global awareness.

The emergence of civilian vigilante groups, such as the Minutemen, at the border is the most recent social phenomenon to contribute new controversy to the discussion. The Law Into Their Own Hands looks at the contemporary nativist, anti-immigrant movement in the United States today. Doty examines the social and political contexts that have enabled these civilian groups to flourish and gain legitimacy amongst policy makers and the public. The sentiments underlying the vigilante movement both draw upon and are channeled through a diverse range of organizations whose messages are often reinforced by the media. Taking action when they believe official policy is lacking, groups ranging from elements of the religious right to anti-immigrant groups to white supremacists have created a social movement. Doty seeks to alert us to the consequences related to this growing movement and to the restructuring of our society. She maintains that with immigrants being considered as enemies and denied basic human rights, it is irresponsible of both citizens and policy makers to treat this complicated issue as a simple black or white reality. In this solid and theoretically grounded look at contemporary, post-9/11 border vigilantism, the author observes the dangerous and unproductive manner in which private citizens seek to draw firm and uncompromising lines between who is worthy of inclusion in our society and who is not.

Self-justice and legal self-help groups have been gaining importance throughout Africa. The question of who is entitled to formulate 'legal principles', enact 'justice', police 'morality' and sanction 'wrongdoings' has increasingly become a subject of controversy and conflict. These conflicts focus on the strained relationship between state sovereignty and citizens' self-determination. More particularly, they concern the conditions, modes and means of thelegitimate execution of power, and in this volume are seen as a diagnostics as to how social actors in Africa debate and practise socio-political order. State agencies try to bring vigilante groups under control by channelling their activities, repressing them, or using them for their own interests. Vigilante groups usually must struggle for recognition and acceptance in local socio-political spheres.
