Book excerpt: The procurement of goods and services by EU governments and other national entities offering public services is regulated by rules which are laid down in a series of EU Directives and interpretative guidelines. The procurement of similar goods and services by the Commission and other Community institutions is subject to a different set of rules. This book examines those different rules. The procurement of goods and services by Community institutions and agencies is subject to the general principles of EU law including transparency, non-discrimination, proportionality, and equal treatment. There are, in addition, two basic Regulations which cover the Community's financial order: the Financial Regulation and the Implementing Regulation, both of which have specific provisions on public contracts. The procurement rules set down for Community institutions are often more detailed than those set out in the public procurement Directives. This is because the Directives set out objectives to be achieved by Member State governments. The Directives implicitly rely, for their implementation, to a large degree, on pre-established Member State rules. With Community procurement, on the other hand, it has been necessary to regulate, for all the detailed rules and procedures as the Community institutions, when acting on their own behalf, cannot rely on pre-existing national rules. For ease of reference, this book is divided into chapters which look at different aspects of the EU institution procurement procedures, as well as the remedies and penalties which might be applicable when breaches occur. Each of these chapters is designed to be read as a stand alone examination. Each chapter sets out the basic rules set out in the Financial Regulation and refer to the relevant articles in the Implementing Regulation. The text of the Implementing Regulation is set out in an annex. In addition, reference is made to the rules set out in the Practical Guide to Contract Procedures for EC External Actions in case of external procurement. These basic rules are then subject to comments including reference to the general principles of law applicable and any relevant cases before the European Courts in Luxembourg. That being said, this book is intended for the layman.

Book excerpt: "Failure to comply with public procurement rules has been a perennial and significant source of error in EU cohesion expenditure. Serious errors resulted in a lack, or complete absence, of fair competition and/or in the award of contracts to those who were not the best bidders. The Court of Auditors found that the Commission and Member States have started to address the problem, but there is still a long way to go and efforts need to be intensified." -- Page 4 of cover.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents in a concise and accessible way why the EU institutional system exists in its present form, how the EU fits into the world as a system of governance, and who is involved in EU policy processes. It outlines the historical context which has shaped the EU system, gives a summary of the system's basic principles and structures, and describes its actors, procedures and instruments. The main theme is to show that EU decision-making is not just a matter of action at some higher and separate level, of ‘them and us’, but rather that it involves different forms of cooperation between European, national and regional authorities, as well as interaction between public and private actors. Numerous short case studies illustrate how people’s day-to-day activities are affected by EU decisions, and how individuals’ concerns are represented in the decision-making process. The book provides insights and examples which will be very helpful for all students of European integration. It will also be a valuable resource for European citizens wishing to understand the basic realities and rationales, as well as some of the dilemmas, behind EU policy-making.

Book excerpt: The EU has been the region of the world where the most climate policies have been implemented, and where practical policy experimentation in the field of the environment and climate change has been taking place at a rapid pace over the last twenty-five years. This has led to considerable success in reducing pollution, decoupling emissions from economic growth and fostering global technological leadership. The objective of the book is to explain the EU's climate policies in an accessible way, to demonstrate the step-by-step approach that has been used to develop these policies, and the ways in which they have been tested and further improved in the light of experience. The book shows that there is no single policy instrument that can bring down greenhouse gas emissions, but the challenge has been to put a jigsaw of policy instruments together that is coherent, delivers emissions reductions, and is cost-effective. The book differs from existing books by the fact it covers the EU's emissions trading system, the energy sector and other economic sectors, including their development in the context of international climate policy. Set against the backdrop of the 2015 UN Climate Change conference in Paris, this accessible book will be of great relevance to students, scholars and policy makers alike.

Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of the PhD project I started four years ago at Europa-Kolleg Hamburg. I had the great opportunity to work on it for one year at the European University Institute in Florence and to finalise the oeuvre during my stay with the European Commission's Institute for Prospective Technological Studies in Seville. The subject matter of the book is intellectual property rights, patents in particular, and their process of harmonisation in Europe. At the beginning of the work, the intention was not to focus immediately on one narrow field in the huge realm of intellectual property rights but rather to open my mind in order to capture a broad variety of new ideas and concepts in the book. The work at three different institutes in three different European countries over the period of four years naturally exposed the work to diverging ideas and the exchange of views with many people. This is one reason for the wide spread of topics ordered around the given leitmotif, such as epistemological foundations, political background information,. the protection of biotechnological inventions and the building up process of intellectual property right systems in the countries of Central and Eastern Europe. In chapter two I take up Polanyi's differentiation of codifiable and tacit knowledge. Applying these concepts to my own work I realise that this book is only the visible and codified part of knowledge I was able to capture.

Book excerpt: Twenty years following the introduction of the euro as single European currency, it remains unclear whether Article 128 of the TFEU enshrines an autonomous concept of legal tender with regard to the euro or whether the provision merely refers to pre-existing concepts of legal tender in the national laws of member states. This work collects all contributions to the 2018 conference “The Euro as Legal Tender” held in Frankfurt-am-Main.
