La brecha salarial o el techo de cristal son construcciones propias del ámbito laboral (profesional, si se quiere) y que han obtenido carta de naturaleza en el lenguaje y las relaciones sociales comunes. Esa confluencia paradójica (por un lado, ha transcurrido ya un tiempo razonable para decantar el alcance de los preceptos; por otro, la materia está de máxima actualidad) genera una excelente oportunidad para abordar un examen como el que propone la presente monografía. No se pretende aquí abordar una hermenéutica lineal, un comentario sistemático y detallado de cada uno de los apartados de la LOI. El objetivo perseguido es distinto, más pragmático y apegado a la práctica jurídica. Atenta a la doctrina de los tribunales en el orden social, sin que falten algunas referencias en el campo contencioso-administrativo o a otros órdenes, esta monografía persigue una aportación al valor inmediato del texto, a su incidencia en el caso individualizado y concreto. From affirmative action to protection against sexual harassment, from indigenous peoples’ rights to gay marriage, the struggle to eliminate subordination or exclusion and to achieve substantive equality has been waged through courts and legislation. At the same time, critiques of legalism have generally come to be regarded by liberal and left reformers as politically irrelevant at best, politically disunifying and disorienting at worst. This conjunction of a turn toward left legalism with a turn away from critique has hardened an intellectually defensive, brittle, and unreflective left sensibility at a moment when precisely the opposite is needed. Certainly, the left can engage strategically with the law, but if it does not also track the effects of this engagement—effects that often exceed or even redound against its explicit aims—it will unwittingly foster political institutions and doctrines strikingly at odds with its own values. Brown and Halley have assembled essays from diverse contributors—law professors, philosophers, political theorists, and literary critics—united chiefly by their willingness to think critically from the left about left legal projects. They are frequently considered as having fled from generalized violence rather than from persecution. This book determines the international meaning of the refugee definition in Article 1A(2) of the Convention as regards refugee protection claims related to situations of armed conflict in the country of origin. Although the human rights based interpretation of the refugee definition is widely accepted, the interpretation and application of the Convention as regards claims to refugee status that relate to armed conflict is often marred with difficulties. Moreover, contexts of armed conflict pose the question of whether and to what extent the refugee definition should be interpreted in light of international humanitarian law. This book identifies the potential and limits of this interpretative approach. Starting from the history of international refugee law, the book situates the 1951 Convention within the international legal framework for the protection of the individual in armed conflict.
