Available in PDF, EPUB and Kindle. Book excerpt: U.S. policy towards Burma has undergone a discernible shift in its approach since a quasi-civilian government was established in March 2011. While the overall objectives of U.S. policy towards the country remain in place-the establishment of civilian democratic government based on the rule of law and the protection of basic human rights-the Obama Administration has moved from a more reactive, "action-for-action" strategy and a skeptical and cautious attitude towards the newly created Union Government and Union Parliament to a more proactive mode. The new approach is designed to foster further reforms based on some form of partnership with the Union Government, headed by President Thein Sein. During the last two years, the Obama Administration has conducted much of its policy towards Burma using existing constitutional and legal authority, while regularly consulting with Congress about the actions taken. The 112th Congress passed five laws containing provisions related to U.S. policy in Burma. Three laws-P.L. 112-33, P.L. 112-36, and P.L. 112-163-extended the general import ban contained in Section 3 of the Burmese Freedom and Democracy Act of 2003 (2003 BFDA, P.L. 108-61) which is subject to annual renewal. P.L. 112-74 placed restrictions on the use in Burma of appropriated funds for certain Defense and State Department programs. P.L. 112-192 granted the Secretary of the Treasury the option of instructing the U.S. Executive Director at any international financial institution to "vote in favor of the provision of assistance for Burma by the institution, notwithstanding any other provision of law" if the President has determined that to do so is in the national interest of the United States. The 113th Congress will have the opportunity to decide what role it will play in the future course of U.S. policy in Burma.

Book excerpt: A genuine democracy movement lives in Burma, but it continues to be brutally suppressed by the ruling military government. In 1990, the National League for Democracy (NLD)-led by Aung San Suu Kyi-won 82 percent of the seats in a multiparty parliamentary election. The regime ignored the elections and the democratically elected representatives never took office. Aung San Suu Kyi, who was imprisoned after violent government-orchestrated attacks on democracy supporters on May 30, 2003, has spent more than half of the past fourteen years under house arrest. Burma remains one of the most tightly controlled dictatorships in the world. Recognizing that democracy and the NLD cannot survive in Burma without the help of the United Sates and the international community, the Council-sponsored Independent Task Force on Burma sounds a clarion call for change. In response to the governments recent crackdown on the democratic opposition, the Task Force urges the United Nations to call for the immediate release of Aung San Suu Kyi and all political prisoners, and to impose sanctions on Burma, including bans both on new investment in Burma and on the importation of goods produced in Burma. The Task Force report also offers specific recommendations for U.S. policy in four areas: humanitarian assistance; promoting democracy, human rights and the rule of law; narcotics control policy; and refugees, migrants, and internally displaced persons. Led by Mathea Falco, president of Drug Strategies and former assistant secretary of state for international narcotics matters, this bipartisan Task Force comprises members with a wide range of experience in international business, law, government, media, academia, publichealth, and human rights advocacy, among other areas. Its recommendations are intended to inform U.S. government action as well as to increase U.S. cooperation with other countries, especially in Asia, to bring about a long overdue political, economic, and social transformation of Burma.

Book excerpt: Major changes in Burma's political situation since 2016 have raised questions concerning the appropriateness of U.S. policy toward Burma (Myanmar) in general, and the current restrictions on relations with Burma in particular. Various developments in Burma between 2010 and 2016 led the Obama Administration and others to perceive positive developments toward the restoration of a democratically elected civilian government in that nation after nearly five decades of military rule. Based on that perception, the Obama Administration waived most of the sanctions on Burma, particularly after Aung San Suu Kyi and the National League for Democracy won the 2015 parliamentary elections and a new NLD-controlled Union Parliament took office in April 2016. Certain events since 2016, however, have led some to call for the reinstatement of some of the waived sanctions and/or the imposition of new restrictions on relations with Burma.

Book excerpt: An accurate and objective assessment of the status of human rights, civil unrest, and political reform in Burma is critical to congressional oversight of the Obama Administrations conduct of U.S. policy towards the country, as well as any congressional examination of U.S. policy towards Burma. The Obama Administration and many other observers have focused their analysis on the apparent progress that has been made since Burmas military junta transferred power to a new, quasi-civilian government in 2011. These analyses highlight the countrys political reforms and human rights improvements, while acknowledging that the situation remains fragile and reversible. This book examines the current situation in Burma from the implicit perspective shaped by U.S. laws setting policy toward Burma, and discusses the challenges of responding to reforms in a nation in political transition which has gone only part way to dealing with human rights abuses.

This book was released on 2012-09-06 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: This afternoon the East Asia and Pacific Affairs Subcommittee will examine U.S. policy toward Burma, with particular reference to the recent political reforms in that country, the impact of U.S. policy, including sanctions, on Burma's political transformation, and the prospect for further reforms.Regionally, Burma's reforms, again at this point, place it beyond many of its own neighbors. One of the comments that I heard several times during my recent visit through Japan, Thailand, and into Burma was that Burma, if it can sustain even the changes that have been made over the last year, now places about halfway up inside the ASEAN nations in terms of its political process. They have been releasing political prisoners. They have been opening up their media. They are holding popular elections. There are concerns about policies in other countries, most notably at this time Vietnam and China.
