The Missile Technology Control Regime (MTCR) was created in 1987 to help control the spread of delivery system technology by means of parallel export restrictions among signatory member nations. However, many nations have declined to join the original group of seven signatories; the absence of China, the Soviet Union, and Israel substantially weakens the restraint of technology transfer. Other treaties and organizations overlap and supersede MTCR, resulting in conflict between members and other nations. In this already difficult context, formulation of coherent U.S. policy on export control is further hindered by domestic conflicts among government agencies. The State, Defense, and Commerce departments often disagree over definitions of civilian vs. military applications of technology, as well as over the diplomatic implications of sale or embargo of technology. MTCR is not effective because participation and compliance are voluntary, and there is not adequate common understanding of what constitutes delivery system technology.

Book excerpt: Concerned about missile proliferation, the United States and several major trading partners in 1987 created an international voluntary agreement, the Missile Technology Control Regime, to control the spread of missiles and their related technologies. Congress passed the National Defense Authorization Act for Fiscal Year 1991 to fulfill the U.S. government's Missile Technology Control Regime commitments. This act amended two governing U.S. export control statutes: the Export Administration Act of 1979, as amended, which regulates the export of dual-use items (those having both military and civilian applications), and the Aims Export Control Act, as amended, which regulates the export of military items. The Department of Commerce licenses most dual-use items, while the Department of State licenses military items. Congress is currently considering the passage of a new Export Administration Act because the current statute is set to expire in August 2001.2 Given the current interest in export controls and in missile technology proliferation, you asked us to determine whether regulations for controlling the export of Missile Technology Control Regime items (1) are consistent with U.S. law and (2) provide a consistent U.S. policy on the control of missile technology.

Under the amended statutes, the Departments of Commerce and State share primary responsibility for controlling exports of Regime items. The Commerce Department is required to control Regime items that are dual-use (those having both military and civilian uses) on its export control list the Commerce Control List. All other Regime items are to be controlled by the State Department on its export control list the U.S. Munitions List.

Book excerpt: Congress has been concerned about whether U.S. firms, in exporting satellites, provided expertise to China for use in its ballistic missile and space programs and whether the Administration's policies might facilitate transfers of military-related technology to China. This CRS Report discusses security concerns, policy changes, congressional action, and a chronology of major developments since 1988. Some critics opposed satellite exports to China, while others were concerned that the Clinton Administration relaxed export controls and monitoring of commercial satellites in moving the licensing authority from the State Department to Commerce in 1996. A range of concerns were prompted by New York Times reports in April 1998 that the Justice Department began a criminal investigation into whether Loral Space and Communications Ltd. and Hughes Electronics Corp. violated export control laws. The firms allegedly shared their findings with China on the cause of a rocket's explosion while launching a U.S.-origin satellite in February 1996. The companies are said to have provided expertise that China could use to improve the accuracy and reliability of its future ballistic missiles, including their guidance systems. At least three classified studies reportedly found that U.S. national security was harmed. In the fall of 1998, Congress passed the FY1999 National Defense Authorization Act that transferred licensing authority over satellites back to the State Department (effective March 15, 1999). On October 5, 1999, the President signed into law the FY2000 National Defense Authorization Act (P.L. 106-65) in which Congress addressed export controls relating to missile technology, satellites, and other issues.
