So-called ‘honour killings’ have become an issue of concern for the international community. In Turkey, in particular, the practice still exists despite the adoption of the relevant human rights instruments. The book argues that the improvement of the status of women in Turkey in accordance with gender equality as well as the application of the principle of state due diligence, both requirements of the Istanbul Convention and international human rights law, are fundamental means towards eradicating the killing of women in the name of ‘honour’. Using feminist approaches, in particular the intersectionality approach, the study looks at the application of such standards as well as the current obstacles. Through such a lens, the study discusses the strengths and weaknesses of the Turkish Constitution, Turkish Civil Code, Turkish Penal Code and Law to Protect Family and Prevent Violence Against Women and questions the judicial approach to the implementation of the women’s right to life. It identifies the lacunae in the Turkish legislation that allow inadequate legal protection for women and the inconsistency of the judicial approach to the definition of the so-called honour killings in the judgements. The study then recommends some concrete amendments to the relevant legal provisions in order to better reflect the international framework and the feminist approaches. The book will be a valuable resource for academics, researchers and policy-makers in the areas of international human rights law and feminist legal theory.

Only a small percentage dare to challenge their mistreatment in court. Facing domestic police and judges who often refuse to recognize discrimination, a small minority of activists have exhausted their domestic appeals and then turned to their last hope: the European Court of Human Rights (ECtHR). The ECtHR, located in Strasbourg, France, is widely regarded as the most effective international human rights court in existence. Russian citizens whose rights have been violated at home have brought tens of thousands of cases to the ECtHR over the past two decades. But only one of these cases resulted in a finding of gender discrimination by the ECtHR-and that case was brought by a man. By comparison, the Court has found gender discrimination more frequently in decisions on Turkish cases. Courting Gender Justice explores the obstacles that confront citizens, activists, and lawyers who try to bring gender discrimination cases to court. This encompasses suspicious deaths in prisons, those who took their own lives, and those who lost their lives while trying to flee Turkey across the Meric and Aegean, encountering denial to return to their home countries. The numerous state-sanctioned human rights abuses in Turkey are too extensive to enumerate. AST engages in a range of activities, from organizing conferences and panels to writing reports submitted to relevant organizations and committees. Collaborating with other organizations is crucial for sharing causes, learning from others' stories, and amplifying our own narratives. In response to the pandemic and global crises, AST has adapted its strategies, incorporating virtual protests, panels, and written works, including reports and books. Survivor interviews are shared through books, providing a platform for the voices of those persecuted. AST encourages people to write letters to decision-makers and focuses on youth empowerment, recognizing the significant role young advocates play. Yet, the stereotypical gender roles inextricably linked with this neo-Ottoman imaginary remain largely unacknowledged, dissimulated in the construction of the desire of an idealised past. Our adaption of a cultural studies perspective in this volume puts special emphasis on agency, gender, and authority.
