Book excerpt: The Sherman Anti-Trust Act of 1890 was the first piece of government regulation aimed at curtailing the large trusts following the rapid consolidation of the domestic economic market. While advocates for the bill praised the federal government for its creation, the Sherman Anti-Trust Act lay dormant for a number of years following its passage into the American legal code. The Sherman Act's use against trusts, which began in 1904 against Northern Securities, was met with great controversy amongst legal professionals and the wider public. In the following years -and over the course seventy or so subsequent dissolution cases, the Sherman Anti-Trust Act was questioned not only for its efficacy but for its selective use. Exploration of the selective use of the Sherman Anti-Trust Act is the focus of this thesis. To represent selective use, two cases are examined. The first is the dissolution case against the American Tobacco Company, the prominent tobacco manufacturer during the period between 1900-1910. This trust was dissolved into a dozen new companies, generating numerous controversies along the way. The second case for dissolution was against the International Harvester Company. International Harvester was the dominant agricultural equipment company during the period between 1902-1922. The dissolution case against International Harvester was postponed for several years under then President Theodore Roosevelt; later during dissolution the company was granted special rights and permissions. The findings of this thesis is that the debate around the selective use of the Sherman Act depended on the ethics of the company. Mere bigness was a fleeting reason to be dissolved, and instead the public and those in the federal government argued over the selective use of the Sherman Act.
