Book excerpt: Through its detention observation, UNAMA found a compelling pattern and practice of systematic torture and ill-treatment at a number of NDS and ANP detention facilities. In many other facilities, UNAMA identified practices and documented allegations of abuse that raise serious concerns about the possible use of torture and ill-treatment. These allegations require further investigation and prompt action by all concerned. Use of interrogation methods, including suspension, beatings, electric shock, stress positions, and threatened sexual assault is unacceptable by any standard of international human rights law, Afghan law and professional standards for security forces. In particular, the abuses found against children in custody are a clear indication that NDS and ANP should undertake urgent reforms to ensure proper oversight and accountability within their ranks. To improve their human rights records and meet their human rights obligations, the NDS and the ANP should undertake serious systemic reform and cease any use of torture and ill-treatment. Internal education is needed to ensure that all NDS and ANP officials understand what constitutes torture, know that using such methods is illegal under the Constitution, criminal laws and international law and that any official using or condoning such practices will be prosecuted and disciplined. International support and assistance could play a key role. Decisions to provide donor support should be based on NDS and ANP taking concerted action to cease torture and abusive interrogation practices accompanied by appropriate safeguards. The provision of training in non-coercive interviewing techniques, modern prison management and administration and a basic understanding of national legal norms and international standards relating to prohibitions of torture and respect for legal safeguards and due process rights are essential to assisting NDS and ANP to move forward with institutional reform and modernization. In the context of transition of lead security responsibility from international military forces to ANSF, the imperative to ensure that NDS or ANP do not abuse detainees or provoke local grievance through mistreatment or arbitrary detention is particularly important.

The joint report by the UN Assistance Mission in Afghanistan (UNAMA) and the UN Human Rights Office, issued on the first anniversary of Afghanistan’s accession to the Convention Against Torture’s Optional Protocol, finds that nearly a third of conflict-related detainees interviewed provided credible and reliable accounts of having been subject to torture or ill-treatment. The report is based on interviews with 618 detainees held in 77 facilities in 28 provinces across the country between 1 January 2017 and 31 December 2018.

The report calls on the Afghan government to fully investigate allegations of abuse, hold those responsible accountable, and ensure that AIHRC monitors have full, unfettered access to all detention facilities. The report also recommends that the ISAF and the United States ensure no detainees are transferred to Afghan detention facilities where they face a real risk of torture and that all U.S. forces in Afghanistan are subject to ISAF detainee transfer policies and monitoring.

Book excerpt: Throughout Afghanistan, Afghans are arbitrarily detained by police, prosecutors, judges, and detention center officials with alarming regularity. It is systemic and occurs in a variety of forms. Arbitrary detention violates the Constitution of Afghanistan, and the international human rights standards to which Afghanistan has committed. In particular, it violates the right of all Afghans to liberty and to due process of law and erodes their dignity. Another consequence of arbitrary detention is overcrowding in Afghanistan's detention centers. Also, arbitrary detention often places detainees' families under unnecessary socio-economic hardship because income and social standing is lost. Widespread arbitrary detention erodes public confidence in the judicial system and in the government as well. To reverse this pattern, the Government of Afghanistan (GoA) committed to develop and implement corrective measures both in the Afghanistan Compact and the Afghanistan National Development Strategy (ANDS), as well as in the National Justice Progamme. In order to assist the GoA in its efforts, the United Nations Assistance Mission in Afghanistan (UNAMA), with the cooperation of the Afghanistan Independent Human Rights Commission (AIHRC), monitored detainees in Ministry of Interior (MoI) [police] and Ministry of Justice (MoJ) detention facilities throughout Afghanistan from November 2006-July 2008. This report draws upon this field monitoring to discuss the patterns and causes of arbitrary detention and to make recommendations on measures to effectively combat it. This report does not cover conflict-related detentions, including those by the National Directorate for Security (NDS) or international military forces (IMF). First, monitoring found that Afghans are often detained without a legal basis, including for so-called 'moral crimes', breaches of contractual obligations, for family disputes, or to pressure a relative or associate into confession. Second, there are indications that Afghans have been detained in order to deny them fundamental rights, particularly that of freedom of expression and many of the fundamental rights of women. Third, Afghans are detained without enjoying essential procedural protections, rendering many detentions arbitrary.
