Book excerpt: The US Department of Energy's Transportation Management Division (TMD) is considering the need for additional environmental analysis of radioactive material transportation to meet the National Environmental Policy Act (NEPA) requirements and support needed for preparation of NEPA documentation. This overview was prepared to provide background material on institutional requirements and support needed preparation of NEPA documentation. The Transportation Institutional Program can and should be responsive to the public interest and regulatory requirements through the NEPA process. Public involvement, particularly through the NEPA scoping process, is a key means of identifying transportation issues that must be addressed. The TMD Institutional Program is responsible for establishing and maintaining relationships with the public to resolve these issues. The NEPA process calls for various forms of public involvement at different points. Continuing safe technical performance and the ability to demonstrate fast, open, and competent response to problems will be vitally important to program credibility. Public confidence is also created by drawing them into the program and offering them a sense of meaningful participation in the decisions about transportation that most closely impact their lives. 4 refs.

Book excerpt: Environmental Policy and NEPA is a concise study of environmental policy-where we have come from, what we are facing and where we can go in the future. An outgrowth of initiatives taken by the Council of Environmental Quality (CEQ), and edited by the current Associate Director, this publication studies the effectiveness and efficiency of the implementation of the National Environmental Policy Act (NEPA). Divided into three main sections, part one covers the historical background and trends of NEPA. Part two addresses current substantive and conceptual issues associated with the environmental impact assessment (EIA) process. Part three discusses future opportunities including impact on humans, effective public participation in the EIA process and the need for sustainability. This excellent reference brings together 28 contributing authors who combine their expertise to address a multitude of topics. Environmental Policy and NEPA is mandatory reading for the professional, researcher, government policymaker, activist, student or anyone looking for a complete presentation of the EIA process.

Book excerpt: Broad discretion is granted at all levels throughout federal land management agencies regarding compliance with the National Environ. Policy Act (NEPA). The authors explored the diversity of procedures employed in NEPA processes across four agencies, the Forest Service, the Nat. Park Service, the Bureau of Land Management, and the U.S. Army Corps of Eng. There is a lack of consistency not only between, but also within, agencies with regard to how NEPA is implemented. This report focuses on how successful NEPA processes are defined within each agency and what strategies are the most or least beneficial to positive NEPA outcomes. Also identifies unresolved questions about NEPA processes and presents a research strategy for addressing them.

Book excerpt: This report analyzes approaches taken by state departments of transportation (DOTs), their local partners, and other project sponsors to satisfy National Environmental Policy Act (NEPA) requirements for transportation projects involving more than one mode. Specific objectives of the research were to: 1) characterize the challenges inherent in satisfying the NEPA requirements of multiple U.S. DOT agencies; 2) identify strategies and tactics that state and local transportation agencies have used to overcome these challenges; and 3) suggest new and innovative strategies that can be applied by state and local transportation agencies in future multimodal NEPA processes. Twelve case studies illustrate successful practices and provide examples of institutional arrangements used to comply with NEPA requirements for two or more U.S. DOT agencies. The case studies demonstrated that there is no single best way to approach the NEPA process for multimodal situations. Success may depend more on the willingness and motivation of the agencies to work together, to find common ground, and to work around differing processes, and less upon a specific organizational structure. An effective interagency approach depends on how well the project sponsor and other agencies are able to work together and bridge their procedural differences.

Book excerpt: A tool for predicting environmental impacts, the National Environmental Policy Act (NEPA) can also be used to predict the impacts of natural disasters and potential terrorist attacks. This book demonstrates how to use NEPA as a framework to support decision-making. It includes examples that demonstrate how NEPA can be efficiently integrated with other processes such as ISO 14001, P2, and Adaptive Management. It provides proven tools, techniques, and approaches for streamlining NEPA and environmental planning strategies that reduce the potential for controversy and criticism. It is the first text that covers recent changes to NEPA and the new CEQ guidance expected to be issued.

Book excerpt: This guide was written as a quick primer for transportation professionals and analysts who assess the impacts of proposed transportation actions on communities. It outlines the community impact assessment process, highlights critical areas that must be examined, identifies basic tools and information sources, and stimulates the thought-process related to individual projects. In the past, the consequences of transportation investments on communities have often been ignored or introduced near the end of a planning process, reducing them to reactive considerations at best. The goals of this primer are to increase awareness of the effects of transportation actions on the human environment and emphasize that community impacts deserve serious attention in project planning and development-attention comparable to that given the natural environment. Finally, this guide is intended to provide some tips for facilitating public involvement in the decision making process.

Book excerpt: Meeting the nation's mobility needs requires constructing, improving, and repairing roads and bridges. However, these actions can have serious environmental impacts, such as harming water quality and wildlife and their habitats. The federal government's policy is to carry out federally funded highway projects in an environmentally responsible manner, as directed by the National Environmental Policy Act of 1969 (NEPA) and other environmental and natural resource protection laws. The environmental review of projects, as required by the act, involves identifying and assessing environmental impacts; evaluating alternatives; seeking input, and in some cases approvals, from federal and state agencies responsible for natural resources, environmental protection, and historic preservation (referred to hereafter as resource agencies); and obtaining approval from the Federal Highway Administration (FHWA). These reviews provide important environmental protections, yet it is generally agreed that it often takes too long to complete the most complex highway projects and the environmental review is the most time-consuming aspect. In 2005, the Safe, Accountable, Flexible, and Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) made a number of changes to the planning and environmental review processes required of state and local transportation agencies. These changes were intended to facilitate more efficient reviews of transportation projects, allowing them to be completed more quickly without diminishing environmental protections. For example, since SAFETEA-LU was enacted, federal law has required that state departments of transportation and metropolitan planning organizations (MPO) consult with federal and state resource agencies, among other things, in developing their long-range transportation plans. The law also requires that agencies charged with gaining environmental approval (such as FHWA and the state departments of transportation that sponsor the projects--called lead agencies) of the most complex highway projects--those requiring environmental impact statements (EIS)--invite resource agencies that have an interest in the project to participate in defining the purpose and need for the project, the alternatives to be considered, and the methodology for conducting the environmental review. The law also imposes a limit of 180 days for the filing of a lawsuit challenging final federal agency decisions, including environmental decisions, on a highway project. These activities were not required before SAFETEA-LU was enacted. Congress asked that we assess whether the changes Congress envisioned for transportation planning and the environmental review and approval of highway projects are being effectively carried out. Accordingly, we assessed (1) the progress that selected state departments of transportation, MPOs, and FHWA have made in incorporating environmental considerations in transportation planning and (2) the progress that selected states and FHWA have made in implementing changes in the environmental review of highway projects.
